Note* Her mother: This is a portrait of Elenore Johanne Scholz of Scoresby North. She was born at Leutmannsdorf, Silesia, Germany, on 15th February 1807 with the maiden surname of Fellenberg. Elenore married John Gottlieb Scholz in Silesia, Germany, in 1831. The couple had fourteen children. They arrived in South Australia during 1845, and then to Victoria during 1853. John died in a farm accident at Ringwood on 1st February 1884, aged 76. Elenore was a midwife. She died at Scoresby North on 8th July 1887, aged 80. The couple are buried at Box Hill Cemetery, Church of England section *, grave 0058. Researched by Glen Turnbull.1

Sir, We the selectors and residents of Gembrook and Packenham County of Mornington humbly request that you will please order that a new road may be surveyed through the selection of Mr Arthur Knight in the Parish of Packenham. This road we request will be to start from the north east corner of Mr Knight's selection, thence south west distant at about five chains more or less and being west from the two chain road and thence ending at the south east corner of the said selection. This new line of road will be on the side of a very high hill and with little expense can be made into a very good road. The present one chain road is too steep that it is almost impossible for us to get either up or down it and ought never to have been surveyed in that place. Trusting that you will give this a favourable consideration.

  • 31 Jan 1900: Berwick Police Court. Jan. 24: Alf. Shorthouse was granted a stage coach licence, to run between the railway station and Upper Beaconsfield.58
  • 25 Jan 1902: Some children gathering fruit in the garden of Mr. Shorthouse, mail contractor, Beaconsfield, left a mattock in the branches. It fell as Mr. Shorthouse was passing beneath, inflicting serious injury to his head. The scalp was deeply cut, the skull laid bare, and an artery severed.59
  • 5 Aug 1903: Berwick Police Court.
    Shorthouse v. Burd, for the recovery of £9 on the sale of a horse. Plaintiff was cross-questioned and gave his evidence in a straight-forward manner. Defendant entering the witness-box asked to be al lowed to refer to his diary evidently not having a leg to stand on. The upshot was verdict for plaintiff with costs.60
  • 28 Oct 1903: During the heavy thunderstorm last Wednesday, Mr. Shorthouse, a resident of Beaconsfield, was struck by lightning. For a time he was completely prostrated, but we are glad to hear he has almost recovered.61
  • 27 Jan 1904: Messrs. Paternoster and Shorthouse went on a fishing excursion to Wallace Creek, and brought back 120 fine specimens of black fish. Simon Paternoster62
  • 6 Jul 1904: A nephew of Mr. Walker of Manuka Park had a nasty experience last Friday. He was riding past the Shire Hall, Berwick, his pony shied and threw him, and started off for home, one foot of the boy being caught in the stirrup. In this position he was dragged for nearly mile. As they passed Mr. Cameron's place, the pony gaining pace, Mr. Hugh Cameron who was in the garden, kicked off his boots and gave chase, heading the animal off on to the Beaconsfield road. Mr. Alf. Shorthouse who was near the intersection of roads at the Gippsland Hotel, noticed them approaching ran to meet them on the bridge, and making a dexterous spring on to the pony's neck brought it to a standstill. It was just in time, as the boy was exhausted with keeping his head off the ground, which he had managed to do all the time. His body was fearfully cut and lacerated, and after being attended to and rested at the hotel he led his horse home. Mr. Cameron, who had come up to the scene of rescue, after being assumed that all was well, made the best of his way back through the mud and rain which was falling heavily.   • 27 May 1910: COACH STRIKES STUMP. BEACONSFIELD UPPER, Thursday.
    Mr Shorthouse, sen., proprietor of the Beaconsfield coach, was on his way to meet the early train on Wednesday, when the horse shied, and, colliding with a stump threw the driver out. Mr Shorthouse was found lying on the road and in pain. Dr Langmuir of Berwick, found no bones broken, but that the muscles of the neck and chest had been much strained. There was also a wound in the scalp.64
  • 25 Aug 1911: RUN OVER BY A WAGGON. BERWICK, Thursday.
    A young man named Andrew Carter, employed by Mr. Shorthouse, of Upper Beaconsfield, met with a serious accident yesterday. He was loading some chaff on to a waggon at Beaconsfield railway station, when the horses bolted, and he was thrown on to the roadway. One of the wheels passed over his leg, badly fracturing it, and injuring him in other parts of the body. He was taken to St. Vincent's Hospital by an ambulance sent out from the city.65

  • 28 Feb 1917: The half-yearly meeting of the Red Cross and War Relief Society at Beaconsfield Upper was held in the Assembly Hall last Thursday. The President (Mrs Marsh) occupied the chair and there was a good attendance. Mrs Harvey-Smith, the secretary, furnished a report of the work done during the year, which was most satisfactory. The Society has been in existence about 18 months, and during that period have prepared and sent away about 2000 articles, of various descriptions. Every month a box is sent to the Lady Mayoress's Patriotic League for the boys in the trenches. Two boxes were sent last month. In addition to the goods sent to Melbourne, the branch has made a gift of some article for every recruit who has left the district, The treasurer (Mrs Harvey-Smith) reported that after meeting all expenses the branch had a substantial credit balance at their banker's on which to commence their next half year. A vote of thanks was passed to Mrs Crowther who generously provided afternoon tea at all meetings. For this the branch charges each member 3d, and by this means they have raised the substantial sum of £14. A vote of thanks was also passed to Mrs Shorthouse for her free carriage of parcels and goods to and from the railway station.   • 3 Aug 1917: Many of your readers will be sorry to learn that Mrs Shorthouse, sen., is seriously ill. At the time of writing she had improved a little.45
  • 5 Jul 1918: BEACONSFIELD UPPER. — A very old resident of Beaconsfield, Mrs. A. G. Shorthouse, has died at the age of 64 years. The family has been identified with the district for 45 years, and settled there when there was only one house to be seen, that of Professor Halford. When people began to select, and a good many were coming and going, the necessity for a mailbag arose, and this was the first despatched by Mr. Shorthouse by donkey transport.46

Rushall was renting it back to A W Shorthouse. The principal under mortgage was £326.9.4 at the time of Rushall's death. It appears that Shorthouse was behind in rent to Rushall, the rent was barely covering the outgoings (insurance & interest on mortgage).24 
Note*a 1930 Lysle Silvester Tabuteau. Lysle went to live with his grandparents Boss and Amy, who brought him (and his sister?) up. Boss had left UB in 1926 after the liquidation sale and a brief unsuccessful return, and moved to Port Albert where he became the licensee of The Ship Inn Hotel for one or two years and then moved to the old Courthouse. Lysle started school at Port Albert c1932/3.25 
Noteabt 1933 Later Boss obtained a job at Noojee timber mill, and would ride there and back each week. Lysle: Both Boss and Arthur worked at Stoll's timber mill - looking at the distance now he thinks that they might have come home monthly rather than weekly - Lysle was only 6 years old at the time.
Later they moved to Buln Buln East and then Buln Buln where Boss' brother Bert was living, and later to a farm at Shady Creek.25,26

David Russell, whose untimely death is reported elsewhere, worked most of his life with the Berwick owned business of Loveridge's, and succeeded his father as Manager of the B. U. store on Bill’s retirement shortly after his 70th birthday.
Bill Russell recalls the scene at Charing Cross around the outbreak of World War 1:
The Milk Bar (presently leased by Tom Van der Dolder, previously by Allens and Cooks, and owned retrospectively by Beckwith, Stuckett, Pingo, Colles and Mrs G. Thompson) was a confectionery and fruitmongery conducted by Horner and Funnell. Immediately adjacent (now Mick O’Riley and Anne McKay's art/craft enterprise) was a grocery conducted by Bill Berglund, whose father created “The Towers” on the road after his own name.
Across Halford Road was Tom “Sport” Brady’s hire coach shed (now still exhibiting well-weathered petroleum advertisements). A former garage owner in Melbourne, Tom retired to B. U. and lived in a small in-built section of the building which was formerly the co-operative fruit packing shed at Beaconsfield railway station. Across the Emerald Road, now Jack Stephen’s butcher's shop, was “Boss” Shorthouse’s headquarters for a Royal Mail and passenger horse coach/bus service. (Later Bill Berglund’s grocery moved to this site).
Alongside it, now Loveridges, was John Nathan’s general store. (Nathan’s first store opposite the Cenotaph, now Cr Keith Ewenson’s, was burnt down. He set up next door to the Salisbury Road Hall, then moved to the Loveridge’s site in 1929. Here John Glissman had constructed the present building, employing some of the timber from the Village's first school.)
Bill Russell, who lived with his family in Berwick, came into Loveridge’s employment as counter hand and delivery man in the early 1930’s when Loveridges bought the business from Nathan.
Trading at that time continued to 10 pm. on Saturday nights to cater for the influx of weekend holiday-makers. Wednesdays were closed days. Bill slept in the store for a month then brought his family to rent "Rosemont" in A’Beckett Road (now Mrs Atkinson's).
When Bill Noblet managed Loveridge’s (succeeding Syd Dean), Bill Russell moved into the Berglund shop and cottage at the rear, and subsequently purchased it. When Mrs. Russell died about 18 years ago, the former grocery shop (then acting as a bed-sitting room) was leased to Jack Stephens. Prior to this Jack was a taxi cab operator in Emerald.
Among Bill Russell’s regular chores some 40 years ago was the delivery of 44 gallon drums of lime-sulphur to the many orchards, by horse and dray. Later it was in the comfort of a 13 model Ford motor truck.
Bill ultimately took over the management of Loveridge’s for 4 years, before son David was to give him a well earned rest. Like the publicity he received when phasing out of a long association with the store, Bill's mother Celia came very much into the limelight when she celebrated her 100th birthday at the Pine Grove Hotel.

  • 9 Jul 1914: Berwick Police Court. Wednesday, June 21. Before Messrs W. Harris, P.M. and a'Beckett, Smith and McLellan, J's P. Manning v.' Shorthouse, claim for goods sold and delivered. The amount claimed in this case was small, being less than one pound, but the principle at stake was important. Complainant said that Shorthouse had got meat from his shop for other people, whom he, Manning did not know, and whom he therefore would not trust. Shorthouse thereupon said "well, book it to me." Manning booked it to him and now Shorthouse could not see why he should pay for it. Defendant Shorthouse said that Manning knew the meat was for other people and that he, Shorthouse, was only a carrier. He admitted that he told Manning to book it to him. Mr Macpherson, who appeared for complainant, on the above facts being brought out before the Court, asked for a verdict for the amount claimed. He sub mitted that the distinction was clear between a guarantee where one man says to another "supply this third man with meat, and if he does not pay you, I will," and the straight out incurring of a debt by the first man where he says "supply this third man with meat and book it to me." The first case would be a guarantee to answer for the debt of another man and must have writing to evidence it The second case would be the sttaight out assumption of the debt by the first man himself. After some short discussion the P M. said an order would be made for the amount claimed and costs. He remarked that Shorthouse could recover the amount from the persons to whom he took the meat.48

World War I

Charles Edgard Shorthouse enlisted on 16 Jul 1915, aged 33 years and 9 months. He was a veterinary student at the time. He was discharged on 18 Feb 1916 on account of being medically unfit. He suffered from pulmonary tuberculosis, which first manifested c1901, when there was no apparent cause. He had a second attack at camp in Flemington due to exposure. There was evidence of consolidation on the right side. The medical officer stated that "this man is very anxious to remain. Could a ... billet as vet be found for him?"1

  • 22 Jun 1912: Domestic Differences.
    At the Prahran Court on Monday, before Mr Curwen-Walker (chairman), Messrs Hutton, M'Kinnon and Captain Panter, J's.P., Annie Shorthouse, charged her husband, C. E. Shorthouse, with leaving her without adequate means of support. The defendant did not appear. Mrs Shorthouse, who was represented by Mr Nigan, stated that she was married in August of last year. Last month she only received 26/- from her husband, and for the previous month 27/-. The house she was living in was the property of her former husband. The Bench made an order against defendant for the payment of £1 per week, with one surety of £25 ; costs, £1/3/6. Mrs Shorthouse also asked that defendant be bound over to keep the peace. She also detailed occasions when, she alleged, he had assaulted her. Charles Armstrong, a neighbour, also alleged in stances of assaults by defendant on his (defendant's) wife.
    The Bench bound defendant over to keep the peace for 12 months, himself in one surety of £25, and another in a like amount ; costs, £1/1/0. Annie Lane19
  • 27 Jun 1912: Charles Edgar Shorthouse.—A warrant of commitment has been issued by the Prahran Bench against Charles Edgar Shorthouse for imprisonment, in default of not finding surety of £25 to comply with an order of maintenance to pay 20s. weekly for the support of his wife.
    Description:—Horse dealer, about 30 years of age, 6 feet high, medium build, dark complexion and hair, clean shaven; generally wears a grey sac suit and grey felt hat.—O.4459A. 22nd June, 1912.20
  • 24 Jul 1915: ARREARS FOR MAINTENANCE. Annie Shorthouse summoned her husband, Charles E. Shorthouse, for £41/13/-, being arrears of maintenance money made under an order of the court for her maintenance. Mr. Nigan appeared for complainant, and Mr. Stevens for defendant. For the defence, it was stated that defendant had joined the Australian Expeditionary Forces, and therefore it was not in the power of the Bench to send him to gaol. An order was made for the payment of the arrears, defendant to be imprisoned until the order was complied with. Annie Shorthouse21
  • 10 Aug 1918: SLIPPERY SHORTHOUSE. ANNIE AFTER HIM AGAIN FOR ARREARS.
    "Pay Up, or Prison," is the Bench's Pronouncement.
    At the Prahran Court on Monday, before Messrs. F. A. Sargeant (chairman), S. Bangs, H. Lavery, and J. G. Cooke, Js.P., a case with some rather peculiar features was heard, the complainant being Annie Shorthouse, of Highbury-grove, East Prahran, and the defendant her husband, Charles Henry Shorthouse, whose address was given on the summons as Upper Beaconsfield, or Bendigo, and who was sued for £29 12s. 10d., arrears of maintenance up to July 8, 1918.
    Mr. Nigan, who appeared for the complainant, said the defendant was a veterinary surgeon, and well known in the country districts. The summons was served on him in Bendigo.
    Mr. Abrahams, for defendant, said that his client disputed the claim on the grounds that, since the order was made, the parties had been living together as man and wife, and that thefefore, the order lapsed.
    The complainant said that on June 17, 1912, an order was made by the Prahran Court for defendant to pay her £1 per week maintenance. He obeyed the order for some time; but then fell into arrears, and on July 19, 1915, she sued him for £41 10s. arrears. An order was made for that amount, in default imprisonment until it was paid. The defendant then enlisted, and APPEALED AGAINST THE ORDER, but the Court of General Sessions ordered him to pay for her maintenance out of his military pay, and if he did not do so, the appeal was to be struck out. Witness received military pay from defendant up to February, 1916, when he was discharged from the forces. Since then she had received the money very irregularly, and on July 6 the sum of £29 12s. 10d. was due.
    To Mr. Abrahams: Witness lived in a five roomed house in East Prahran with her two daughters by a former marriage. Her mother also lived at the house. Defendant was in the habit of coming home under the influence of drink; but she never at any time, since the order was made, occupied the same room with him. If he came into her bedroom she left it, and slept on a couch in another room.
    Defendant, on oath, described himself as a horse dealer. He also attended horses suffering from dental troubles. At the present time he was living at the Terminus Hotel at Bendigo. He returned to live with his wife in July, 1917, and since that date had occupied the same bed with her on several occasions. When the front bedroom was occupied by his wife's mother, he slept in a single bed with his wife.
    To Mr Nigan: He was before the Court in July, 1915, when he was sued for arrears of maintenance. On that occasion he said that he had
    COHABITED WITH HIS WIFE, and on that occasion the Bench did not believe him. He could not say what his earnings were as a horse dealer; but they did not exceed £2 5s. per week. He was not a veterinary surgeon, and did not claim to be one. He could not say what his earnings were for attending to horses' teeth troubles.
    William Edward Rance said that he remembered calling at Shorthouse's house at a quarter to seven one morning and saw Mrs. Shorthouse. Witness asked her to call her husband, and she told him to go into the bedroom where Shorthouse was in bed.
    To Mr. Nigan: Witness could not say whether Mrs. Shorthouse occupied the same bed that night.
    Edward William Tucker said that between January and April, 1917, he called for defendant one morning, and knocked at the window. Mrs. Shorthouse asked who was there. Witness told her, and she called out "Get up, Shorty; Rance and Tucker are here for you."
    Mr. Nigan: Do you say that defendant slept in the same bed as his wife that night?
    —No.
    The Chairman said that the Bench did not believe a word that defendant had sworn.
    Defendant had been before them on several occasions, and given the same evidence. The Bench did not believe him on this occasion, and would make an order for the amount claimed: in default, imprisonment till it was paid.
    Mr Abrahams asked for time.
    Mr. Nigan objected. The defendant was a slippery customer, and if time was allowed it would be difficult to locate him.

Sat. October 5 1901. "It is almost time to walk up to the cricket ground. We have transferred our matches from Shorthouse's paddock to the recreation ground, which we bought from Mr Priestley.
This morning I have been driving one of Dad's drags down to the station at Beaconsfield to pick up passengers who are staying at Salisbury House for the weekend. It looks like a really busy weekend for the local guest houses as over two hundred folk from Melbourne arrived on the two trains.
The road is not in very good condition though and a couple of old folk were almost jolted out of the cart by a wheel rut.
Cricket starts at 3.00pm and I have put on my club tie to wear with my other cricket clothes. I'm really looking forward to playing against the Cardinia Creekers from down the hill. We had a visit from Hugh Trumble last week so the chaps are really keen. Hugh recently took a hat trick for Australia (as they are now called after all the states combined). The test was against England of course.
Our club has been going for eight years now since being formed for the first time. The fellows enjoy playing in the Berwick and Dandenong Cricket Association, which was formed for the first time two years ago. We have agreed to arrive-early today as we have to pull out a lot of bayonet grass before we can play, to make the ground smoother. My bowling hand will be a little the worse for wear after that effort.
Dad (Bert) is opening the innings today with Hans Glismann. They have formed a great opening partnership despite being a lot older than the rest of us and Hans' knees aren't much good any more -he knows how to turn an easy three into a risky single.
We have fourteen players registered but are struggling to field a team today because of the number of Melbournites visiting the Village for the weekend. Spring turns Upper Beaconsfield into a virtual haven as people come up here to enjoy the rarefied air which is supposed to be good for your lungs. There are pretty walks in the fern gullies below Salisbury House which are very popular.
Well I'd better pack my bat and pick up the plate of scones with jam and cream for afternoon tea otherwise I'll be late. The Cardinia Creekers will be a pushover so I don't want to miss the fun."

Upper Beaconsfield cricket was certainly very different in Federation Victoria to that of the infant years of the 21st century - one hundred years later.10

  • 12 Aug 1937: DIVORCE HELD UP. Judge Has Doubts. Mr. Justice Dwyer in the Supreme Court yesterday gave his attention to a petition by James Douglas Hargreaves for divorce from Florence Amy Hargreaves, on the ground of desertion. Represented by Mr. J. Hale, the petitioner, a farmer, of Coolup, said that the marriage took place in Victoria in April, 1921. There were no children of the union. In November, 1924, petitioner was informed by his wife that she was suffering from tuberculosis. It was arranged that she should enter a sanatorium but some time later petitioner saw her with a man named Gilbert, and she admitted that she had been on familiar terms with him. About a year later petitioner went to South Australia, having heard nothing more from his wife. In July, 1926, he came to this State and made his permanent home at Coolup. In 1930 he tried to get in touch with his wife, "to see if she had come to her senses," but could not discover her whereabouts. Late last year she was located at Warrandyte (Victoria), and petitioner wrote to her twice, but received no reply. He now wished to re-marry. Mr. Justice Dwyer said that as to the period of desertion alleged to have taken place in Victoria, proof would have to be brought that desertion was a matrimonial offence under the Victorian law. And even if it were so, His Honour was dubious as to whether desertion in Victoria would give any right to divorce here. As to counsel's contention that the desertion, for a period of three years and upwards, could be regarded as having taken place since the petitioner became domiciled in this State, it was extremely doubtful whether the respondent had known her husband's whereabouts. If she lacked this knowledge, how was it possible that she could have returned to him if she had desired to do so? The hearing would be adjourned until 10.30 a.m. next Monday, to enable counsel to examine the whole position. It was possible, suggested His Honour, that an amendment of the petition might be advisable. James Douglas Hargreaves17
  • 14 Aug 1937: FARMER'S DIVORCE. A divorce from Florence Amy Hargreaves, on the ground of desertion, was yesterday granted to James Douglas Hargreaves, a Coolup farmer, at the resumption of an adjourned hearing of his petition, before Mr. Justice Dwyer in the Supreme Court. Mr. J. Hale, for the petitioner, produced proof (required by the Judge when the case was brought on earlier in the week), that desertion was a matrimonial offence under the Victorian law. After hearing counsel's quotation of relevant authorities, and argument based on those authorities and on the facts of the case, Mr. Justice Dwyer said that as it had now been established that the action of the respondent was a matrimonial offence in Victoria, where her desertion had commenced in 1924, and as he (the Judge), was satisfied from an afidavit in the case that the respondent had had a continuing intention of deserting her husband, the petitioner would be granted a decree nisi. On Mr. Hale emphasising that the petitioner wished to re-marry, His Honour agreed to make the decree returnable in December. James Douglas Hargreaves18

  • 26 May 1898: Upper Beaconsfield.—A very successful and well attended garden fete was held on the 7th April in the grounds of "Salisbury House," kindly lent for the occasion by the Misses Hedrick, in aid of the Children's Hospital. A variety of amusements were provided. Fancy, flower, fruit, confectionery and refreshment stalls were all well patronised, and the business greatly enhanced by Short's Military Band, which played the latest music during the afternoon. The other attractions were tennis, croquet, fine art gallery, archery, etc. In the evening a concert was held in the Assembly Hall, where there was an excellent programme of songs and recitations, rendered by local musicians and assisted by Miss Henriette Ridley, a wellknown Melbourne vocalist, who sang two songs and joined Mr. Elcoate in the duet "The Sailor Sighs," which was pronounced the gem of the evening. Miss Hedrick was hon. treasurer and Mr. Glismann hon. secretary, and may both be complimented on the success which crowned their efforts.   • 13 Nov 1901: It is currently reported here that the Misses Hedrick, who have for the past few years so successfully conducted "Salisbury House," Upper Beaconsfeld, as a first class boarding establishment, have purchased "Manuka Park," lately the residence of Mr. Malwyn a'Beckett, and intend adapting and improving the same so as to make it comfortable to their patrons.   • 22 Jun 1912: Domestic Differences.
    At the Prahran Court on Monday, before Mr Curwen-Walker (chairman), Messrs Hutton, M'Kinnon and Captain Panter, J's.P., Annie Shorthouse, charged her husband, C. E. Shorthouse, with leaving her without adequate means of support. The defendant did not appear. Mrs Shorthouse, who was represented by Mr Nigan, stated that she was married in August of last year. Last month she only received 26/- from her husband, and for the previous month 27/-. The house she was living in was the property of her former husband. The Bench made an order against defendant for the payment of £1 per week, with one surety of £25 ; costs, £1/3/6. Mrs Shorthouse also asked that defendant be bound over to keep the peace. She also detailed occasions when, she alleged, he had assaulted her. Charles Armstrong, a neighbour, also alleged in stances of assaults by defendant on his (defendant's) wife.
    The Bench bound defendant over to keep the peace for 12 months, himself in one surety of £25, and another in a like amount ; costs, £1/1/0. Charles Edgar Shorthouse10
  • 24 Jul 1915: ARREARS FOR MAINTENANCE. Annie Shorthouse summoned her husband, Charles E. Shorthouse, for £41/13/-, being arrears of maintenance money made under an order of the court for her maintenance. Mr. Nigan appeared for complainant, and Mr. Stevens for defendant. For the defence, it was stated that defendant had joined the Australian Expeditionary Forces, and therefore it was not in the power of the Bench to send him to gaol. An order was made for the payment of the arrears, defendant to be imprisoned until the order was complied with. Charles Edgar Shorthouse11

    "Pay Up, or Prison," is the Bench's Pronouncement.
    At the Prahran Court on Monday, before Messrs. F. A. Sargeant (chairman), S. Bangs, H. Lavery, and J. G. Cooke, Js.P., a case with some rather peculiar features was heard, the complainant being Annie Shorthouse, of Highbury-grove, East Prahran, and the defendant her husband, Charles Henry Shorthouse, whose address was given on the summons as Upper Beaconsfield, or Bendigo, and who was sued for £29 12s. 10d., arrears of maintenance up to July 8, 1918.
    Mr. Nigan, who appeared for the complainant, said the defendant was a veterinary surgeon, and well known in the country districts. The summons was served on him in Bendigo.
    Mr. Abrahams, for defendant, said that his client disputed the claim on the grounds that, since the order was made, the parties had been living together as man and wife, and that thefefore, the order lapsed.
    The complainant said that on June 17, 1912, an order was made by the Prahran Court for defendant to pay her £1 per week maintenance. He obeyed the order for some time; but then fell into arrears, and on July 19, 1915, she sued him for £41 10s. arrears. An order was made for that amount, in default imprisonment until it was paid. The defendant then enlisted, and APPEALED AGAINST THE ORDER, but the Court of General Sessions ordered him to pay for her maintenance out of his military pay, and if he did not do so, the appeal was to be struck out. Witness received military pay from defendant up to February, 1916, when he was discharged from the forces. Since then she had received the money very irregularly, and on July 6 the sum of £29 12s. 10d. was due.
    To Mr. Abrahams: Witness lived in a five roomed house in East Prahran with her two daughters by a former marriage. Her mother also lived at the house. Defendant was in the habit of coming home under the influence of drink; but she never at any time, since the order was made, occupied the same room with him. If he came into her bedroom she left it, and slept on a couch in another room.
    Defendant, on oath, described himself as a horse dealer. He also attended horses suffering from dental troubles. At the present time he was living at the Terminus Hotel at Bendigo. He returned to live with his wife in July, 1917, and since that date had occupied the same bed with her on several occasions. When the front bedroom was occupied by his wife's mother, he slept in a single bed with his wife.
    To Mr Nigan: He was before the Court in July, 1915, when he was sued for arrears of maintenance. On that occasion he said that he had
    COHABITED WITH HIS WIFE, and on that occasion the Bench did not believe him. He could not say what his earnings were as a horse dealer; but they did not exceed £2 5s. per week. He was not a veterinary surgeon, and did not claim to be one. He could not say what his earnings were for attending to horses' teeth troubles.
    William Edward Rance said that he remembered calling at Shorthouse's house at a quarter to seven one morning and saw Mrs. Shorthouse. Witness asked her to call her husband, and she told him to go into the bedroom where Shorthouse was in bed.
    To Mr. Nigan: Witness could not say whether Mrs. Shorthouse occupied the same bed that night.
    Edward William Tucker said that between January and April, 1917, he called for defendant one morning, and knocked at the window. Mrs. Shorthouse asked who was there. Witness told her, and she called out "Get up, Shorty; Rance and Tucker are here for you."
    Mr. Nigan: Do you say that defendant slept in the same bed as his wife that night?
    —No.
    The Chairman said that the Bench did not believe a word that defendant had sworn.
    Defendant had been before them on several occasions, and given the same evidence. The Bench did not believe him on this occasion, and would make an order for the amount claimed: in default, imprisonment till it was paid.
    Mr Abrahams asked for time.
    Mr. Nigan objected. The defendant was a slippery customer, and if time was allowed it would be difficult to locate him.
    The application for time to pay was refused. Charles Edgar Shorthouse12

    BRYDEN AMY TABUTEAU Petitioner,
    -against-
    SYLVESTER HAROLD TABUTEAU Respondent.
    It BRYDEN AMY TABUTEAU of Port Albert in the State of Victoria, make oath and say as follows:-
    1. I am the above-named Petitioner.
    2. I was on the sixteenth day of January, One thousand nine hundred and twenty-six lawfully married to the above-named Respondent at St. Mary's Church, Caulfield in the said State by Canon Langley according to the rites of the Church of England.
    3. The Respondent has since the celebration of the said marriage been guilty of a repeated act of adultery with a woman or women unknown to me.
    4. I am now twenty-four years of age. I was born at Hawthorn and I am domiciled in the State of Victoria.
    5. The Respondent is now aged about twenty-nine years and he was born at Bendigo and is domiciled in the State of Victoria.
    6. I was a spinster prior to marriage and was undergoing training as a nurse. Since marriage, save as is hereinafter stated, I have lived with and been supported by the Respondent.
    7. The Respondent was a bachelor before our marriage, and he followed the occupation of a clerk. He has since marriage followed the occupations of a clerk, a laborer and a salesman.
    8. There is living issue of the said marriage namely Lysle Sylvester Tabuteau a male who was bom at Brighton in the State of Victoria on the twenty-fifth day of October, One thousand nine hundred and twenty-seven and Barbara Amy Tabuteau a female who was born at Belgrave in the said State on the third day of July, One thousand nine hundred and twenty-nine.
    9. Immediately after our marriage the Respondent and I lived and cohabited as man and wife at a home in Glen Eira Road, Caulfield. After three months residence at that home, we moved to a flat in Darling Street, South Yarra where we remained for about four months. The Respondent then expressed dissatisfaction with his position in Melbourne, and went to work on a farm at Berrigan in the State of New South Wales, leaving me with his sister in Elwood. During his four months absence I was maintained by his said sister. On his return from Berrigan he asked me to accompany him back to that town. I agreed to do so and we worked as a married couple there for about four months, when, by reason of my pregnancy, we returned and lived with the Respondent's said sister. About three weeks after my confinement we went to live at Belgrave aforesaid where the Respondent had secured employment with the State Electricity Supply Commission. Within the first six months of our residenoe there, the Respondent prevailed upon me to spend a holiday with my mother who lived at Beaconsfield.
    Before the agreed holiday had expired however, the Respondent came to take me home saying that he had been visited by some female friends and desired to apprise me of that fact before I heard about it from other people who might cause me to place a guilty construction on his conduct. Some trouble arose between the Respondent and me beoause of his excessive sexual demands and because of his neglect of me and attention to other women at social functions which we attended.
    10. In or about the month of November, One thousand nine hundred and twenty-eight I again became pregnant and at about the same time the Respondent informed me that he was suffering from hydrocele which had been caused by a fall. When I discovered that he was using a syringe and taking medicine however, I demanded an explanation and he then confessed that he was suffering from a venereal disease. This, he alleged, was a recurrence of a disease which he had contracted prior to our marriage and which recurrence had been brought about by the hydrocele. I accepted this explanation.
    11. One night at about 10 o'clock in about the month of January, One thousand nine hundred and twenty-nine I heard the Respondent's and women's voices issuing from a darkened tennis pavilion near our home. I made my presence known to him and then went home. He arrived some time later and when I demanded an explanation he stated that he was merely having a "spot" with two other men whom he named and two girls.
    I subsequently ascertained that at least one of the named men was not in the Pavilion as asserted by the Respondent.
    Though my confinement was approaching, the Respondent continued to absent himself from home almost nightly until a late hour, leaving me in the house with only my child.
    12. In the month of December, One thousand nine hundred and twenty-eight we moved from Belgrave to Lockwood where we lived together until about May, One thousand nine hundred and twenty-nine when the Respondent became unemployed. He informed me that he would seek employment in Melbourne and left me in the house at Lockwood. I expected to hear from him within a few days. He did not return to me and left me without any money and my relations maintained my child and myself. Three weeks after his departure, I bore my second child in a Hospital in Belgrave. The Respondent came to see me two days after the birth of my child in response, as I have been informed and verily believe, to a telegram sent by the Doctor who attended me. I then told him that I was disgusted by his conduct and that I believed certain rumours that I had heard oncerning his misconduct with other women. He denied the truth of those rumours and later sent his brother Basil to ask that I should forgive him.
    I saw the Respondent again and he then said that he had acted "rottenly" in the past, but would behave in future if I forgave him. I ultimately agreed to overlook his bad conduct and upon my recovery he took me with our two children to a flat in Glenhuntly Road, Elwood but we only remained there for three days when we moved to a house which I rented at Bell. We resided together in that house until the month of September, One thoueand nine hundred and twenty-nine when he went to the State of Western Australia saying that he intended to seek employment there and that he would send for me when he was in a position to make a home for me. He sent me small sums of money thereafter, aggregating about Fourteen pounds, until the month of April, One thousand nine hundred and thirty since when I have not received any money from him. Because I was suspicious of the Respondent, I employed Enquiry Agents in Western Australia to watch the Respondent and from their reports to my Solicitor I believe that the Respondent lived at the "Premier Hotel", Pinjarra with a woman whom he represented as his wife, in or about the month of August, One thoueand nine hundred and thirty. The Respondent is still resident in Perth, Western Australia.
    13. Sexual relations between the Respondent and me finally ceased in about the month of August, One thousand nine hundred and thirty.
    14. I do not know the name or names of the woman or women with whom the Respondent committed adultery, nor do I know how his acquaintance with her or them originated.
    15. Save as aforesaid there have been no separations between the Respondent and me nor has any Deed of Separation been executed between us.
    16. I distinctly and unequivocally deny all collusion or connivance past or present, direct or indirect with the Respondent or any other person liable to be made Respondent.

  • 5 Jan 1929: MANY MEET DEATH Tragic Accidents - SYDNEY, Tonight. Death has stalked abroad during the past 36 hours. Following the loss of three lives in the gale on Friday night there were two tragic accidents today. Trapped in a hail of broken glass and splintered woodwork, two persons were killed when two motor cars met in a terrific crash on Parramatta road, Flemtington. Ten other passengers in the cars were taken to hospital. Crashing into a telegraph pole at Lawson, a motor bus, bound to Sydney from Katoomba, was badly damaged. Two women were hurled through the windscreen and killed, and many others, were injured. A party of mourners bound for Rookwood Crematorium met death when close to their destination. Mrs. Alice Gay, an aged woman, died practically under the signpost directing motorists to the crematorium. A car driven by Mr. Norton Shorthouse was proceeding along Parramatta road from Sydney, and a second car, driven by Mr. Charles Gay, was bound from Parramatta for Rookwood Cemetery. Shorthouse had with him Mr. Frederick Perkins and his daughter and son, and Mr. William Healey and his daughter. In Gay's car were his mother and sister, Mrs. Brindley, and her daughter. Mr. Gay was about to turn into Marlborough street, and according to witnesses he gave a signal while he was turning. A new car driven by Mr. Shorthouse crashed into him side on. The crash was terrific and was heard half a mile away. Mrs. Gay and her son received a shower of glass from the windscreen, and Mrs. Gay immediately collapsed unconscious. Her neck and skull were fractured.

  • 27 Jul 1887: A Trip to Beaconsfield
    Last week one of our representatives paid a visit to the Cardinia Park Hotel, Beaconsfield, kept by John Milne. Leaving Dandenong by the 3.30 train, there is nothing to attract notice, except immense sheets of water, between Hallam's Road and Narre Warren. Alighting from the train at Beaconsfield station the visitor is saluted with a heavy shower of rain, and I look round to see if I can find any good Samaritan, and fortunately an old friend is exposed to view, in the person of Mr Glismann, who is always ready with his faithful 'Tommy" to carry the pleasure seekers to the sylvan dales and alpine altitudes of that thriving township.
    After a few cursory remarks about the weather, Mr Glismann invites me to take a seat in his wagonette, which is gladly accepted as a shield against the storm, which is raging fitfully all around. After about a quarter of an hours travelling we pass the palatial residence of Mrs Armytage, better known as "Holm Park" with its lofty abutments facing the "Cardinia Park" and standing as a paradigm of the future of Beaconsfield. This place previously belonged to Andrew Keating, who twenty-seven years ago migrated from Collingwood and set to work to claim this primeval waste, which was then completely covered with water and ti-tree scrub. We then pass Mr Anderson's residence, about a mile further on, who is also going in for improvements. Another half mile over, and the Cardinia Park hotel is reached. The building which is of brick, stands on the corner of the Berwick and Beaconsfield roads, and about three miles from the Beaconsfield railway station.
    On being introduced to Host Milne, we are admitted through a large hall door into the private parlour, when a good view of the interior is placed before us. On each side of the hall door and over the fanlight, large bunches of hops are carved in the stained glass, which the proprietor informed us, were put there as a momento to the late George Miller, who formerly owned the place and built the old wooden hotel, which preceded the present brick structure. He was the first who introduced the growing of hops in the district some twenty years ago, and for that purpose had a broad acreage reclaimed from its wild state and converted into a hop plantation, from which were taken some splendid specimens of hops, and the place, which previously was the haunt of the dingo and the kangaroo, became a place of mirth and labour, and instead of the nocturnal howling of those denizens of the forest the voices of boys and girls reverberated through the trees as they pulled the hop from its tendril and placed it in a receptacle, in which it was carried to the hop house to dry. He was also successful in obtaining several prizes and an hon. mention for his first attempt.
    Two of the houses which he built for drying the hops still remain to be seen, and since his death no enterprising person has taken any steps in the matter, nor has anyone attempted to resuscitate the declination. The proprietor then showed us through the building, which contains fourteen rooms, a kitchen, and cellar. The rooms are large and well ventilated, and the windows fastened with patented spring locks, and nothing is left undone to secure the comport of boarders and visitors, who will find comfort in the place and civility from the proprietor. On the north side of the building, and adjacent to the bar, is a large billiard room in course of erection, which will be another source of amusement.
    About 100 yards from the hotel is the Cardinia creek, where fishing and shooting is to be found in abundance, and scenery in all its rural beauty is to be found there, and the Cardinia park terminates nearly opposite the hotel.
    We then inspect the brick yards, which are about a quarter of mile from the hotel, where a good specimen of brick can be procured at a reasonable rate.
    Reece and Co. are at present employed making a large quantity of bricks and tiles which are for sale, and persons desirous of dotting the little township of Beaconsfield with villa residences cannot do better than visit the brickyard, and see for themselves, as the proprietor has on sale bricks and some splendid sand for building purposes at very cheap rates.
    And as the shades of evening were fast making their appearance, and the night promising to be by no means favourable, we returned to the hotel just in time for tea.
    During tea the conversation was principally on the bad state of the roads in and around Beaconsfield, and our old friend, of stage coach notoriety, said that during his twelve years of experience in this place, (Glismann selected 1875) he had never seen things so bad as they were at the present time, and as to the roads, why (says he) you will require a pair of horses to take a passenger on some parts of the road now. Train time is now approaching, we bid adieu to the blazing fire, kind friends and comfortable parlour to face the rain which was coming down heavily, and a drive of about half an hour brought us to the Beaconsfield railway station and after bidding my kind friend goodbye, and taking a seat in the train, in a few minutes more I was at home, after my "Trip to Beaconsfield."   • 19 Oct 1916: Cr Martin said that, at the previous meeting, he had stated that it was inadvisable for persons of alien abstraction to be associated with any of the recruiting committees. One person had taken the remarks as applying to him; and had approached him (the speaker) on the subject, and in fairness to the person he wanted the facts made known to the ratepayers. The man was looked upon as being of German abstraction, but such was not the case. He desired to express regret if he had caused pain, although he had (at the time) not mentioned any name. The facts were that Mr Hans Glismann, of Beaconsfield, was born in Heligoland, when it was a British possession, but had afterwards been ceded to Germany in exchange for parts of Africa. Mr Glismann, who came of British parents, had taken part in the Crimean war, and his grandfather was a Dane, a race of people for whom he had the greatest respect. He would ask the Press to place the facts before the ratepayers.29
  • 5 Apr 1920: BEACONSFIELD UPPER-Mr Tom Glismann, a very old colonist and one of the earliest men to settle in Beaconsfield Upper died last week. Mr Glismann who was 84 years of age was a Crimean naval veteran. He came to Australia over 60 years ago. A grandson is serving in the Australian navy.30

  • 1 Apr 1896: Apropos of the exhibition, I understand that the gentleman who has filled the post of honorary secretary since the inception of the association, tendered his resignation some time ago to the committee. He was, however, begged to retain the position and consented to do so as it seemed that there was no one else at the time who could conveniently be detailed for the necessary work. It seems that as these considerations in his opinion now no longer apply he has again pressed the point upon the attention of the society.
    The matter, I believe, was to be brought forward on Saturday night last, but up till the time of writing I am unfortunately in ignorance of what occurred, and therefore unable to state who, if anyone, has been appointed to fill the vacant post of honor. Mr Hans Glissman, who has been most indefatigable in the somewhat arduous work lately devolving on him as secretary of the sub-committee in connection with the forthcoming display, is considered by many as the most likely to be chosen.   • 26 May 1898: Upper Beaconsfield.—A very successful and well attended garden fete was held on the 7th April in the grounds of "Salisbury House," kindly lent for the occasion by the Misses Hedrick, in aid of the Children's Hospital. A variety of amusements were provided. Fancy, flower, fruit, confectionery and refreshment stalls were all well patronised, and the business greatly enhanced by Short's Military Band, which played the latest music during the afternoon. The other attractions were tennis, croquet, fine art gallery, archery, etc. In the evening a concert was held in the Assembly Hall, where there was an excellent programme of songs and recitations, rendered by local musicians and assisted by Miss Henriette Ridley, a wellknown Melbourne vocalist, who sang two songs and joined Mr. Elcoate in the duet "The Sailor Sighs," which was pronounced the gem of the evening. Miss Hedrick was hon. treasurer and Mr. Glismann hon. secretary, and may both be complimented on the success which crowned their efforts.
