  • 12 Aug 1937: DIVORCE HELD UP. Judge Has Doubts. Mr. Justice Dwyer in the Supreme Court yesterday gave his attention to a petition by James Douglas Hargreaves for divorce from Florence Amy Hargreaves, on the ground of desertion. Represented by Mr. J. Hale, the petitioner, a farmer, of Coolup, said that the marriage took place in Victoria in April, 1921. There were no children of the union. In November, 1924, petitioner was informed by his wife that she was suffering from tuberculosis. It was arranged that she should enter a sanatorium but some time later petitioner saw her with a man named Gilbert, and she admitted that she had been on familiar terms with him. About a year later petitioner went to South Australia, having heard nothing more from his wife. In July, 1926, he came to this State and made his permanent home at Coolup. In 1930 he tried to get in touch with his wife, "to see if she had come to her senses," but could not discover her whereabouts. Late last year she was located at Warrandyte (Victoria), and petitioner wrote to her twice, but received no reply. He now wished to re-marry. Mr. Justice Dwyer said that as to the period of desertion alleged to have taken place in Victoria, proof would have to be brought that desertion was a matrimonial offence under the Victorian law. And even if it were so, His Honour was dubious as to whether desertion in Victoria would give any right to divorce here. As to counsel's contention that the desertion, for a period of three years and upwards, could be regarded as having taken place since the petitioner became domiciled in this State, it was extremely doubtful whether the respondent had known her husband's whereabouts. If she lacked this knowledge, how was it possible that she could have returned to him if she had desired to do so? The hearing would be adjourned until 10.30 a.m. next Monday, to enable counsel to examine the whole position. It was possible, suggested His Honour, that an amendment of the petition might be advisable. Florence Amy Hargreaves12
  • 14 Aug 1937: FARMER'S DIVORCE. A divorce from Florence Amy Hargreaves, on the ground of desertion, was yesterday granted to James Douglas Hargreaves, a Coolup farmer, at the resumption of an adjourned hearing of his petition, before Mr. Justice Dwyer in the Supreme Court. Mr. J. Hale, for the petitioner, produced proof (required by the Judge when the case was brought on earlier in the week), that desertion was a matrimonial offence under the Victorian law. After hearing counsel's quotation of relevant authorities, and argument based on those authorities and on the facts of the case, Mr. Justice Dwyer said that as it had now been established that the action of the respondent was a matrimonial offence in Victoria, where her desertion had commenced in 1924, and as he (the Judge), was satisfied from an afidavit in the case that the respondent had had a continuing intention of deserting her husband, the petitioner would be granted a decree nisi. On Mr. Hale emphasising that the petitioner wished to re-marry, His Honour agreed to make the decree returnable in December. Florence Amy Hargreaves13
