Leppitt, Dickie and Carley Davis, re hardship inflicted on them owing to the action of Messrs Hogan and Kelly re road water-rights and drainage works at Toomuc creek.-Cr Martin explained matters in connection with the dispute, and said he had seen Mr. Herald (council's solicitor) who found that the council had no power of action, and his advice was to leave it alone.- Cr T. Bourke said the commissioners were dealing with the matter, and had ordered Mr. Hogan to send 500 gallons a minute down the creek. -Cr Martin said that was so, and it would endanger the property of Leppitt, Dickie and Davis.--Cr D. Bourke thought the council should inspect for themselves what had been done, and see what would be the better way to overcome the difficulty. The clerk of works gave a digest of what had been done. He thought the council should not interfere at the present time. -The President said that was what the writers had asked.-Cr Martin thought it would be advisable to inform the com missoners that they should consult the council in the matter.-Cr Wilson said it would be well to let Mr. Hogan do that. --On motion of Crs Martin and Grant, a reply to be sent to the writers stating the council would take steps to protect the road from damage.14

  • 12 Jun 1913: Mr Wm. Dickey has sold his 20 acre orchard in the Toomuc Valley to a brother of Mr T. G. Sandy, of Brierfield orchard. It is stated that probably Mr Dickey will remain in our district and take an interest in developing a small orchard property closer to the township, and if such should be the case it will be a great benefit to our young men, who could watch and learn from this experienced orchardist.   • 8 Jan 1914: OBITUARY. Death of Mr Thos. Henderson, An Old Resident of Berwick.
    We regret having to record the death of Mr Thos. Henderson, which took place at his residence, 28 Ross-St., Northcote, on the 3rd January, at the ripe old age of 82 years.
    Towards the end of the seventies, and at the beginning of the eighties, the deceased was a prominent figure in Berwick public matters. He was a leading memhber of the Rechabite Tent, and passed through all the chairs. He was also a member of the Rechabite Hall and Mechanics' lnstitute, and being a builder and contractor by trade, materially assisted in the erection of those buildings. He was a member of the School Board of Advice.
    Mr Henderson was a champion draughts player, and successfully competed against Melbourne players. He was also one of the members chosen in inter-colonial tournaments. Deceased was fond of fun and foie, and was a capital comic entertainer, making his appearance on the stage at Berwick, Dandenong, Cranbourne, Clyde and other centres.
    His wife pre-deceased him some years ago, but he married again, the subject of his choice being Miss Annie Gaskett, of Dandenong.
    Mrs Alex. Miller, of Berwick, was a daughter, and a son, Milton Henderson, issue of the second marriage, died some time ago.21
  • 10 Jan 1914: DEATH OF MR. THOMAS HENDERSON
    The death took place on Saturday last of Mr. Thomas Henderson, a very well known and highly respected resident of the southern part of the town, where he had resided for many years. He had reached the ripe old age of 82 years. As a singer of humorous songs Mr. Henderson made himself known to practically everybody in the town and district some 15 or 10 years ago and his popularity was great. About this time he married a well-known and highly esteemed local lady in the person of Miss Whitton, and the son that was born to them—Milton Henderson—inherited all the vocal talent of his father, and at a very tender age was giving remarkable performances on the concert platform, a veritable "chip of the old block," as many a one remarked on hearing him sing the popular and entertaining ditties which his father had taught him. The child, whilst popular with everybody, was the very apple of his father's eye, and when he was taken away by the hand of Death seven years ago, a deep cloud settled on the parents' life, from which they seemed ... in vain to em... Mr Henderson's merry songs were no longer heard in public, though he was tempted in later years to oblige in private with some of the old favourites. He did this even so late as New Year's Night, when, in company with Mrs. Henderson, he spent the evening with some friends in Barry street. It was on returning home from this evening that illness seized him. Mrs. Henderson at once sent for Dr. Cole, who throughout the night and during the next day used every effort, but his skill was unavailing, and he passed away on Saturday, as stated. The late Mr. Henderson was a veteran Rechabite, and had the record of having attended the annual conference as district representative of the Berwick Tent for 37 years. He was also a member of the Star of Northcote Tent since his residence in the town.
    Rev. R. W. Rock conducted a short service at the house and also officiated at the graveside. The I.O.R. service was read by Bro. W. Wilson, D.T. and P.D.C.R. There was a large attendance at the funeral and the pall bearers were the Mayor of Northcote, Cr. Henderson, Mr. Ralph Candy, Bros. W. Bell and T. Lathan, P.D.C.R's., and Bros. Snell, Leith and Newnham.22

Sir, We the selectors and residents of Gembrook and Packenham County of Mornington humbly request that you will please order that a new road may be surveyed through the selection of Mr Arthur Knight in the Parish of Packenham. This road we request will be to start from the north east corner of Mr Knight's selection, thence south west distant at about five chains more or less and being west from the two chain road and thence ending at the south east corner of the said selection. This new line of road will be on the side of a very high hill and with little expense can be made into a very good road. The present one chain road is too steep that it is almost impossible for us to get either up or down it and ought never to have been surveyed in that place. Trusting that you will give this a favourable consideration.

  • 5 Sep 1877: BERWICK POLICE COURT. (Before Messrs. Officer and J. Wilson, J.P.)
    A case of great importance to storekeepers and selectors was heard before the Berwick Magistrates, on Friday last.—The complainants, Messrs. George Brown and David Crichton, are storekeepers at Gembrook, and the defendant, Mr. John Sharples, is a school teacher residing at Sandridge, and who has selected land at Gembrook.
    Mr. Lowe appeared for complainants and Mr. Fausset for defendant. Mr. Lowe said the amount claimed was the sum of £10 2s. 7½d., for stores supplied to two men named Walker and Martin, who had been employed by the defendant on his selection, and he (defendant) had promised to stop their store account of out their wages. He had paid sums of £11 and £15 on their account, but now disputed the balance. David Crichton proved the sale of goods and that Sharples had guaranteed payment. George Brown proved a conversation with defendant, when he had offered £5 in settlement; also offered to leave the matter to arbitration. For the defence, it was submitted that defendant could not possibly be liable for debts contracted by other parties in their own name. Defendant swore he had not guaranteed payment, and had paid the sums before mentioned on orders given by the men to him.   • 31 Dec 1879: The postponed letter of Mr. Bullen, re appointment of solicitor to the Council was read, stating that the remuneration of five guineas included advice on Shire business and opinions on construction of local Government Act.-Councillor Gibb said the Municipal Association, to which the Council belonged had made arrangements for supplying legal opinions on Shire matters, and therefore there was no necessity for the appointment:-This view was generally approved of, and reply to be sent accordingly.12
  • 4 Jul 1925: The death has occurred of Mr. George Bullen, who was born in Bourke street, Melbourne, in 1842, seven years after the foundation of the city. At the time of his retirement in 1923 Mr. Bullen was one of the oldest practising solicitors in Victoria. He was admitted to the bar in 1867, and practised in various parts of Victoria for an uninterrupted period of 50 years. For a considerable period, after having practised alone, he was in partnership with Mr. George Godfrey, upon whose death Mr. Bullen's son, Rupert Francis, practised with his father.13
  • 28 Jun 1941: Messrs. L. L. Oliver and M. J. Ennis will be admitted to partnership in Bullen and Burt, solicitors, Collins st., on July 1. They have joined a legal Arm which Is nearly 100 years old, and was founded by Mr. John Cunnington in January, 1842. Mr. Cunnington practised until the early 60s, when his practice was taken over by Mr. George Bullen, who was associated with it until his death in 1925. The practice of Bullen and Burt is carried on by his son, Mr. Rupert F. Burt, and Mr. W. O. Burt.14

    A NUMBER of their friends motored up from town last Saturday night when Miss Aileen Kellaway and her brother, Harding, gave a jolly dance at their home at Upper Beaconsfield. The night was a perfect one for a dance and the big verandah, dimly lit with Chinese lanterns, an ideal spot for dancing. In spite of the long drive up, nobody felt tired, and the evening proved thoroughly enjoyable.
    Mr and Mrs Kellaway helped their daughter receive her guests in the lounge, which, like the supper room, was decorated with big bowls of roses from the lovely gardens of "Windara." Mrs Kellaway wore a handsome gown of black georgette relieved with a touch of vivid red introduced by bending on the right hip. Miss Aileen Kellaway looked charming in a frock of larkspur blue georgette hooped over the hips and finished with a trailing shoulder flower of pink and sliver. Her two sisters also wore georgette frocks, Lucy's a pretty shade of light blue with floating panels lightly beaded with silver, while Phyllis chose a dainty frock of waterlily green.
    Among the guests were: Miss Phyllis Smith, whose pretty frock of leaf green ring velvet was inlet with tangerine embossed georgette. Miss Betty MacBride, who wore a bridge coat to match with her old rose frock; Miss Lola King, whose lemon georgette was draped at one side. Miss Norah Strahan looked well in a striking frock of pink and black chiffon, defined at the waist with a lattice design of narrow sil ver lace and beads. Miss Molly Morton danced in a frock of almond green georgette, the peacock skirt with deeper satin.
    Miss Jean Couchman's pretty frock of black spotted net and satin was set off with a diamente buckle. Miss Ruth Littleton was in peacock frock of pale blue satin relieved with tangerine. Miss Nance Mitchell chose mauve floral taffeta. Miss Bobbie Blackie's frock of floral marocain over a foundation of midnight blue was edged with grey fur. Miss Phyllis Perry wore jade green banded with glittering silver beads. Miss Peggy Stringer looked sweet in autumn toned crepe de chine. Miss Dorothy Lamble's pretty dress of mauve ninon had blue ruchings. Miss Ailsa Patterson was in daffodil taffeta frock.

On 14 October 1878, Gilbert Kerr of Berwick selected 100 acres on the north side of the track opposite Schlipalius. After survey it was stated to be 96 acres 0 roods and 36 perches.
It was described as medium soils, timbered with peppermint, messmate, and stunted messmate.
His license to occupy his selection was dated 1 March 1879.
An inspection on 16 April 1880, showed it had not been fenced, there was no building, or other improvement. It was stated the applicant had left the district.
Kerr's license was revoked on 8 November 1880. Hence Kerr does not appear on the Parish Map.
Crown Allotments numbered 51,71, and 72, each being approximately 20 acres were the southern part of Kerr's 96 acre selection.3,4,5,6 
Land-Note*26 Oct 1880 GEM-D-51. An inspection of the selection by the mounted constable found that there had been no improvements to the land (no fencing, no building, no cultivation), and a note that the applicant had left the district. The license was revoked for non-payment of rent etc., and the land was again opened for selection on 3 Dec 1880.7
