  • 23 Aug 1890: Death of father: DEATH OF MR A. P. CHAUNCY.
    It is with feelings of deep regret that we have to record the death of Mr Auschar Phillip Chauncy, which took place at his residence, Bright, at an early hour on Tuesday last. Mr Chauncy had been ailing for nearly twelve months, and although several changes of scene and climate were tried, and all that medical skill could accomplish was done, the dreaded visitor—Death—would not be denied. Quite a gloom was cast over the township, and, in fact, the whole district, when the sad event became known, and all business places in Bright have remained partially closed out of respect for the deceased. Mr Chauncy was born at Heathcote (then known as McIvor) on the 10th June, 1855, and was therefore 35 years of age at the time of his demise. In 1867 he, in company with his brother, went to the Church of England Grammar School, in Melbourne, and remained there for about three years and a half, making rapid progress in his studies under the tuition of the late Dr Bromby. A few years later Mr Chauncy proceeded to Omeo, where he practised his profession as licensed surveyor. There he quickly became very popular, and was elected to a seat in the Omeo Shire Council, subsequently making his way to the presidential chair, the duties of which he discharged with credit to himself and those he represented. About the year 1882, Mr Chauncy made application for the position of secretary and engineer to the Shire of Bright, at that time rendered vacant by the resignation of Mr G. S. M'Kenzie, and in this he was successful. His popularity increased rapidly as his many good qualities became known, and in his capacity as shire secretary and engineer Mr Chauncy accomplished a vast amount of good work, chief of which may be mentioned the new portion of the Omeo road. Many other important works were also planned and carried out under his supervision. He held the office of secretary and engineer to the Bright Shire Council for about six years, when, owing to some misunderstanding with a few of the members, he resigned. Mr Chauncy took an active part in all local institutions, and anything having for its aim the advancement of the interests of the district always met with his warmest support. He was an energetic member of the Bright Racing Club, and did a great deal during the past few years towards keeping the club in existence. Cricket is another branch of sport to which Mr Chauncy has contributed a large measure of support, and for the past few years he occupied the position of president of the Bright club. Mr Chauncy was one of the gentlemen instrumental in securing the piece of ground known as the Bright Public Park, and the improvements made have been carried out under his supervision. The deceased gentleman was also mainly instrumental in establishing the Bright Free Library, has always since its inception occupied one of the principal offices in connection therewith, and has done a great deal in the matter of procuring grants, books, magazines, and anything that might tend to make the institution attractive. The Bright Tourists' Club, by Mr Chauncy's death, loses one to whom it owes much. The Bright Literary and Debuting Society, of which the deceased was an officer, postponed its ordinary meeting on Tuesday last, after it had been decided to forward a letter of condolence to Mrs Chauncy. The deceased was a member of the Church of England, in the work of which he evinced a deep interest, and here again his demise will leave a gap not easily filled. Many other minor organisations owe their existence in a measure to Mr Chauncy's exertions. He was a thorough gentleman in every respect, always ready and willing to help anyone deserving of and requiring assistance, and one to whom it would be impossible to impute a selfish motive. The deceased was married in 1882, and leaves a widow and five children — four girls and a boy — to mourn their loss. The funeral took place on Thursday afternoon, the cortege moving from the deceased's late residence to the Masonic Hall about half-past two, where the service of the Masonic Lodge was read, after which the processsion wended its way to the Bright Cemetery, the hearse being followed by a number of deceased's relatives and a large concourse of friends, including the members of the local Masonic Lodge — of which the deceased was an active member, occupying the position of Immediate Pastmaster at the time of his death — many of whom travelled a long distance in order to pay their past tribute of respect to one who was so highly and deservedly esteemed for his many sterling qualities, and one whom it will be found difficult to replace. At the grave the burial service of the Church of England was impressively read by the Rev. J. Woods, and that of the Masonic Order by Bro. the Rev. W. L. Fenton, J. W., assisted by the Bro. B. K. Smart, P.W.G.M — " Observer."12

    SIR,—As the result of a complaint by Mrs Clements to the Berwick Council about my dairy herd damaging her hedge, I wish to flatly deny this. Mrs Clements has never complained to me, nor have I spoken to her for at least twelve months, let alone abuse her. I would like Mrs Clements to know that I have lived in this street for thirty years and have never allowed my herd to annoy anyone.—Matthew Cummins, Elgin Street, Berwick. Amelia Elizabeth Clements33
  • 11 Feb 1948: Death Of Early Berwick Resident
    ALTHOUGH he was born at Epping, Mr. Matthew Laurence Cummins, 73-year-old Berwick resident whose death was reported on February 8th, went to school at Berwick and lived in that district from then practically right up till the time of his death. A retired farmer, he had lived in Elgin St. for some time, and was well and favorably known right throughout the district. He had been ill for some months and the end came at the. D. and D. Hospital. He leaves a widow, one son Laurence, and one daughter, Moira (Mrs T. Moore) to mourn their loss. The funeral to the Berwick Cemetery took place yesterday, and was very large and representative. Rev. Fr. Pooley offered up the prayers at the graveside and the pall-bearers were Cr. C. Greaves Messrs J. Moore, E. Henry, W. Harbour, H. Nixon, D. Jones, A. Rex, J. Hicks, J. J. Coucher and H. Pateman.
    W. J. Garnar and Son directed the funeral.34

  • 21 Jan 1932: One of the worst bush fires in the memory of the oldest residents occurred here on Friday and Saturday, when a devastating fire swept over the district. On Friday, a fire, which had been burning in the scrub, fanned by a strong north wind, menaced the residence of Mr. McMillan, and in response to a call for help, about 50 men were soon engaged in a fierce fight to save the house and outbuildings. This they managed to do, and the fire then jumped the main road and threatened the residence of the Misses McLean; a break was burned, and the house was safe. On Saturday morning another fire commenced near Miss McLean’s boundary fence, and soon the residences of Messrs. Blair, Boker and Gilpin, and a number of others were in danger. A large band of willing workers managed to save the houses, but unfortunately they could not save the fine lemon orchard of Mr. McMillan, which was destroyed, also a week-end residence of Mr. Harkins. The heat was so great when the place got alight that it was im possible to get near it. In the after noon a sudden change of wind to the south caused the township to be menaced, and a desperate call for help was sent out, and in reply volunteers from Berwick, Narre Warren and Dandenong came to augment the local Bush Fire Brigade, until there were over 200 men, under the direction of Constable Barrett, and other leaders, engaged in the desperate effort to save the homes of Madame Montigue, Messrs. McBride, McDonald, Harvey-Smith, Rev. T. Greenwood, Robinson, J. Campbell, Major Campbell, Miss Elliott, J. Deville, C. Ellis, Claydon, Wright, Binding and Brown. The worst fight was at “Kyogle,” Mr. McDonald’s house; at one time it was felt that this fine residence would go, but the determined fight put up by the willing workers saved it. Here it was that anxiety was felt for one band who had become surrounded by flames, but they managed to get clear, although some of them succumbed to heat and smoke after getting out. The fine garden and plantation of Major Campbell was swept by the fire, despite the efforts of the workers, and hundreds of pounds worth of valuable plants and trees were destroyed, and the fine house was only saved by the superhuman efforts of the fire fighters. Miss Elliott’s house got alight, and part of the roof had to be stripped off before the fire could be put out. Mr. Ellis had the fence and pavilion attached to his tennis court destroyed, and the fire swept through his orchard, only being stopped within a few feet of the house. The house of Mr. Wright was saved by burning a break, as was Mr. Brown’s house and lemon orchard.
    On Sunday afternoon a small fire developed in Salisbury Gully, but it was soon got under control; whilst this was being put out an urgent call for help came from “The Towers,” Mr. Berglund’s property. A large body of men were rushed out, and the fire was got under control before very much damage was done. On Sunday a fire, which had started on the Saturday in Cordner’s Gully, crossed the Officer rd., and threatened the orchard of Mr. F. Love, but it was kept out, and, with the exception of the loss of some fencing, not very much damage was done.   • 10 Feb 1936: TOWN MENACED BY FIRE. TWO HUNDRED FIGHT FLAMES. BEACONSFIELD UPPER OUTBREAK.
    BEACONSFIELD UPPER Sunday - A bush fire menaced the township of Beaconsfield yesterday, but 200 fighters checked the spread of the flames and a heavy downpour of rain virtually extinguished the fire which was the most serious one. In the district this summer.
    Had it not been for the good work of the bush fire brigade assisted by volunteers, considerable loss of property might have occurred.
    The fire began on Friday in the gully below Mr McMillan's house on the main road from Beaconsfield to Beaconsfield Upper. A south east wind carried the fire up a gully to the back of the properties of Messrs Wright and Binding. It was checked there by beaters but crossed the road and damaged the orchard of Mr Walter Brown. The wind dropped in the evening and it was considered that the danger had passed.
    On Saturday morning, however, the south west wind carried the fire up another gully and only excellent work by the brigade and others saved the houses of Miss Elliot and Lieut Colonel Campbell. The wind was working round toward the township. To prevent that danger the brigade under the direction of the captain (Mr a'Beckett) burnt a break of about three quarters of a mile.     WITH REGRET we record the death at his home, “Lyndhurst,” Beaconsfield Upper, of Mr. Joseph Henry Dowling, a well-known resident of that district for the past 17 years. The late Mr. Dowling, who was 69 years of age, passed away on October 12th, after having been in ill health for the past year. Born in Dublin, he came to Beaconsfield Upper 17 years ago and in the intervening years won a warm spot in the hearts of a wide circle of district friends. They know the deep loss Mrs. Dowling, her son and daughter have suffered, and sympathise deeply with them. Many attended the funeral to pay their last respects when the remains were privately interred in the Berwick Cemetery on October 13th. Rev. W. P. Daunt read the burial service and the pall bearers were: Judge Bevan, Messrs. A. Hamilton, W. Ashby, S. Begg. W. C. Begg, P. M. Hamilton, G. H. Jones, F. Tallant, A. Robb, and J. T. Chapple.
    Funeral arrangements were in the hands of W. J. Garnar and Son.15

    The bridegroom, only son of Mrs. J. Dowling, of Upper Beaconsfield, was attended by Dr. J. Nixon and Mr. V. Wakley, the bride's brother.22

    The recent fete of the Church of England Ladies’ Guild was held in perfect weather, on the grounds so kindly lent by Mr. and Mrs. R. P. Francis. The lawns, sheltered by shady trees and protected from the cool winds, was a delightful spot. Introduced by Mr. Thorogood, Mrs. Crotty, wife of Canon Crotty, of St. Kilda, in a very happy appropriate speech declared the fete open. The principal stalls were: Fancy Goods, presided over by Mrs. Harvey Smith; produce, Mesdames Marsh and Knapton; cake, Miss Murfit and Miss Gladys Binding; book stall, Mrs. Colles; and what was a delight and pleasure to all, and especially the children, was a junior Cole’s, presided over by Mesdames Dowling (2), where articles ranging from one penny to 2/ were stocked, and the children had a great time. The afternoon tea was in charge of Mesdames Binding, Barnes, and Miss Elliott, and being well patronised, spoke well for its preparation. There was also ice cream and a few other inducements for the youngsters to part with their cash. The gentlemen in waiting were Messrs. Thorogood, J. Glismann and Binding, who worked so well in preparing and erecting stalls and seating accommodation. Proceeds resulted in a very substatial addition to the church funds. The new vicar (Rev. Patton) made his first appearance in the district, and was greeted by the church officials, and introduced to his parishioners.   • 8 Nov 1884: POLICE COURT. Tuesday. Before Messrs. Pyne, Howarth, Halls, and Amor.
    John Lindsay Waugh was charged on the information of Charles Gibbings Kent for that he did, on the 26th October, maliciously declare and threaten the complainant in the following words: 'the first time I meet you after receipt of this, unless you give me the information I desire, I shall very quietly proceed to thump you,' and afterwards, upon the same date, the said John Lindsay Waugh did violently ill-use the complainant by beating him with his fist about the face and head, and that from the above premises complainant was afraid that the said John Lindsay Waugh would do him some grievous bodily injury, and therefore prayed that he be required to find sureties of the peace towards him the said complainant.
    Mr. Waugh contended that the Bench must dismiss the case, as they had no jurisdiction ; as to the information, he admitted to having used words and performed the act complained of, but this did not affect the present case, wherein it was necessary that a man take steps as soon as possible after the assault had been committed ; this the complainant had not done. Mr. Waugh
    quoted Plunkett, and maintained that complainant would have to prove, not what had been done in the past, but what was meant to be done in the future.
    Mr. Kent said immediately after the offence had been committed, he took action in the matter, and the present Bench was the first the case could have come before. He might mention that he had never before been mixed up in an unpleasant affair of the kind, and consequently did not know what course to pursue. He was now, however, acting under legal instructions from a firm of solicitors in Sydney.
    Mr. Waugh said he also was acting under legal instruction.
    Mr. Kent said he was totally innocent of any knowledge as to how proceedings like the present should be conducted, but it seemed to him that something must be done ; if superior force was to prevail, and he could not obtain the protection of the Bench, it would be necessary for him to go about with a revolver in his pocket.
    After some further argnment, The Bench decided to hear the case.
    Mr. Waugh pleaded guilty to the assault, but wished a note made of his objection to the case proceeding upon the other grounds.
    C. G. Kent deposed : He was a bank manager, residing in Grenfell ; on Sunday morning, 26th October, he received the letter (produced) from Mr. J. L. Waugh ; he immediately replied by letter to the effect that his (Mr. Waugh's) communication was about to be handed to sergeant Maloney ; about a quarter of an hour afterwards he interviewed sergeant Maloney, with a view of showing that he (witness) had no desire to be a party to a breach of the peace ; about half-past 2 that day the assault complained of was committed, and he subsequently laid the information which he had heard read. He wished to state he had no animus against Mr. Waugh, but believed him to be a man of ungovernable temper, and he was afraid that on another occasion he (Waugh) would use violence, against him.
    By the Bench : He had been threatened previous to the assault, but not afterwards ; he had fear of future danger, most unquestionably.
    Defendant was a man of most ungovernable temper, and witness had received injuries from him which medical testimony could prove. He did not comply with the request contained in the letter, as he did not know the information required.
    Mr. Waugh, in answer to the Bench, said he did not wish to go into the box. With reference to the assault, he had done what he said he would, and had no desire to further molest Mr. Kent.
    This was the case.
    The magistrates retired to consult, and after an absence of over an hour, intimated their intention, in consequence of a division of opinion, to adjourn the case till next Tuesday, for a fuller Bench.
    His worship Mr. Pyne, speaking for himself, said he regretted that gentlemen occupying such positions should appear before the Court in such a case, and suggested that the parties should come to a settlement over the matter.
    Mr. Kent said he much regretted the affair himself, and he had never been placed in such a position before.
    Mr. Waugh also regretted having to take part in such proceedings.
    Mr. Kent wished to know whether, as the Bench were divided, there was any likelihood of a decision being arrived at.
    Their worships intimated that a full Bench would be summoned for Tuesday.8

  • 6 Nov 1913: Alleged Ill-Treatment of a Boy. Schoolmaster Exculpated.
    At the Berwick Police Court last week Thomas Gilpin, on behalf of his son Leslie, aged 9 years, proceeded against E. Williams, head teacher of the Beaconsfield State school on a charge of assault. Mr. Macpherson appeared for complain ant and Mr Rhoden for defendant.
    The statements adduced in evidence were that the boy Leslie Gilpin attended the Beaconsfield school. On the 14th inst some trouble arose at the school over a pencil and the boy was strapped on the legs. Mrs. Gilpin said that the boy's legs were bruised and he was generally upset by the strapping.
    Dr. Langmore who examined the boy, said he found marks of the bruises but could not say that they were due to any excessive punishment.
    Two lads, Bernard Sugden Rudduck and Walter Rogers, who were at the school on the day when the boy was punished also gave evidence. At the close of the case for the prosecution Mr. Rhoden asked that the case be dismissed and that his client should not be called. He said the boy had not been excessively punished, no more than needed to ensure proper school discipline. Mr. Harris, P.M., said the Bench were of opinion that no assault had been proved and there was nothing for the defendant to answer.   • 21 Jan 1932: One of the worst bush fires in the memory of the oldest residents occurred here on Friday and Saturday, when a devastating fire swept over the district. On Friday, a fire, which had been burning in the scrub, fanned by a strong north wind, menaced the residence of Mr. McMillan, and in response to a call for help, about 50 men were soon engaged in a fierce fight to save the house and outbuildings. This they managed to do, and the fire then jumped the main road and threatened the residence of the Misses McLean; a break was burned, and the house was safe. On Saturday morning another fire commenced near Miss McLean’s boundary fence, and soon the residences of Messrs. Blair, Boker and Gilpin, and a number of others were in danger. A large band of willing workers managed to save the houses, but unfortunately they could not save the fine lemon orchard of Mr. McMillan, which was destroyed, also a week-end residence of Mr. Harkins. The heat was so great when the place got alight that it was im possible to get near it. In the after noon a sudden change of wind to the south caused the township to be menaced, and a desperate call for help was sent out, and in reply volunteers from Berwick, Narre Warren and Dandenong came to augment the local Bush Fire Brigade, until there were over 200 men, under the direction of Constable Barrett, and other leaders, engaged in the desperate effort to save the homes of Madame Montigue, Messrs. McBride, McDonald, Harvey-Smith, Rev. T. Greenwood, Robinson, J. Campbell, Major Campbell, Miss Elliott, J. Deville, C. Ellis, Claydon, Wright, Binding and Brown. The worst fight was at “Kyogle,” Mr. McDonald’s house; at one time it was felt that this fine residence would go, but the determined fight put up by the willing workers saved it. Here it was that anxiety was felt for one band who had become surrounded by flames, but they managed to get clear, although some of them succumbed to heat and smoke after getting out. The fine garden and plantation of Major Campbell was swept by the fire, despite the efforts of the workers, and hundreds of pounds worth of valuable plants and trees were destroyed, and the fine house was only saved by the superhuman efforts of the fire fighters. Miss Elliott’s house got alight, and part of the roof had to be stripped off before the fire could be put out. Mr. Ellis had the fence and pavilion attached to his tennis court destroyed, and the fire swept through his orchard, only being stopped within a few feet of the house. The house of Mr. Wright was saved by burning a break, as was Mr. Brown’s house and lemon orchard.
    On Sunday afternoon a small fire developed in Salisbury Gully, but it was soon got under control; whilst this was being put out an urgent call for help came from “The Towers,” Mr. Berglund’s property. A large body of men were rushed out, and the fire was got under control before very much damage was done. On Sunday a fire, which had started on the Saturday in Cordner’s Gully, crossed the Officer rd., and threatened the orchard of Mr. F. Love, but it was kept out, and, with the exception of the loss of some fencing, not very much damage was done.
