Between MARIE MORGAN Petitioner -----and ----- JOSEPH OSBORNE MORGAN Respondent
I Marie Morgan |formerly Marie Griffiths| of Metung in the Colony of Victoria wife of the abovenamed Respondent make oath and say ; —
1. That I was lawfully married to the abovenamed Respondent on the 19th day of February 1869 by the Reverend Amos Brassier a Clergyman of the Church of England at Bairnsdale in the said Colony of Victoria.
2. That I am now of the age of 47 years haying been born in London England on or about the 31st day of 1846.
3. That the Respondent is now of the age of 47 years, having been born in London aforesaid in the year 1839 as I am informed and verily believe.
4. That previous to my said marriage I lived with my parents and was of no occupation and I arrived in the said Colony of Victoria in the year 1868 and continued to reside with my parents until my said marriage That I have been domiciled in the said Colony of Victoria for a period of 2 years and upwards.
5. That the Respondent at the time of our said marriage was a Cordial Manufacturer end earned his living as such but I am unable to say what occupation he now follows.
6. That there has been no issue of cur said marriage.
7. That after our said marriage the Respondent and I continued to live and cohabit at Bairnsdale aforesaid for about 11 years when he deserted me as hereinafter set forth.
8. That about three months after our said marriage the Respondent became addicted to drinking habits and habitually absented himself from home in the evenings returning to our house early in the mornings in a state of intoxication.
9. That about four years after our said marriage the Respondent whilst in a drunken condition repeatedly assaulted and beat me with his clenched fist - blackened my eyes, knocked me down and sat upon me, and on one occasion he got a razor and held it to my throat stating he would kill me - I managed to get away from him and being afraid of my life if I longer resided with him I left the Respondent and went to Melbourne
10. About a month afterwards the Respondent came to Melbourne and on his promise of better behaviour in the future I consented to return to live with him at Bairnsdale aforesaid where wo continued to live and cohabit together for a further period of two years.
11. After the expiration of the said period of two years referred to in the preceding paragraph the Respondent again violently assaulted me - threatened my life and tore my clothes off me, and being afraid of my life I again left him and returned to Melbourne and obtained a situation at the Drapery Establishment of Mr Mark Foy in Smith Street, Collingwood - After I had been there for a period of about four months the Respondent discovered where I was employed and he came out to Foys Establishment and induced me to leave with him in a Hamson Cab: when in the Cab he without any provocation on my part caught me by the throat and threatened to kill me, I called to the Cabmen to drive me to the house of a Mrs Dr Hickson - When I got out of the Cab the Respondent attempted to follow me and became so violent and abusive that a Policeman took him in charge and he was fined 20|- next morning at the City Police Court.
12. That shortly after this the Respondent again persuaded me to return to him where we resided at Bairnsdale aforesaid with my sister Mrs Payne for a period of four months when the Respondent violently assaulted and beat me and threw me out of the house on to the Verandah where I remained all night.
13. That at various other times until the year 1880 I resided with the Respondent but I was unable to do so continuously in consequence of his cruelty towards me whereby my life was frequently endangered.
14. That in 1880 cohabitation finally ceased - the Respondent left Bairnsdale aforesaid and went to Omeo in the said Colony and I have since the year 1880 maintained and supported myself by my own exertions.
15. That in the year 1882 I resided in Powlett Street East Melbourne and maintained myself by keeping boarders - On the 17th day of October in that year I applied to F. Call Esquire Police Magistrate for the City of Melbourne for a Protection Order on the ground that the said Respondent had deserted me from the 30th day of June 1880 and the said Police Magistrate ordered that the earnings and property acquired by me from such last mentioned date should be protected from the said Respondent and his Creditors and that the same should belong to me as if I was a feme sole - The said Protection Order was deposited in the Registrar Generals office for the said Colony on the 1st day of November 1882 and is numbered 1371.
16. That I believe the Respondent remained in Omeo for a period of about four years when I was informed by one Richard Shannon of Omeo Cattle Dealer that the Respondent left there to proceed to Sydney and I have since caused inquiries to be made at Omeo and in Sydney as to the whereabouts of the Respondent but have been unable to procure any information regarding him.
17. That no Deed of Separation has ever been executed between me and the Respondent and no separations have ever taken place save and except those hereinbefore referred to.
18. That the Respondent has without just cause or excuse wilfully deserted me and without any such cause or excuse left me continuously so deserted for a period of three years and upwards and I have since the said 30th day of June 1880 maintained and supported myself by my own exertions.
19. That the reasons I have not instituted proceedings sooner are that I was not possessed of means so to do.
20. That I distinctly and unequivocally deny all collusion or connivance past or present directly or indirectly with the Respondent or any person liable to be made a Respondent or Co-Respondent.

Inquest | 3 Nov 1932 | Inquest held 1932/1139 Brita Charlotte Berger: Cause of death : Pedestrian fatality. REPORT of J.A. Brown. P.C. 1st Constable 6664. Relative to death of Brita BERGER,aged 35 years. 1. I have to report that at about 7.15 pm today, Brita Berger, aged 35 years, Household Worker, 449 St Kilda Road,Melbourne was walking across St Kilda Road,from East to West, at The intersection of Arthur Street, when she was knocked down by a Motor Bus travelling North. 2. I removed her to the Homoeopathic Hospital, in the Civil Ambulance, where she was admitted by Dr Bartak, suffering from a depressed fracture of the skull and abrasions. She died about twenty minutes after admission. 3. The Motor Bus was driven by Honnor Page of 27 West Street, Middle Brighton, who stated that the deceased walked across the tram line right in front of the bus, and that she stopped and hesitated and endeavoured to move backwards, when she was struck by the right hand head lamp of the bus and thrown across the mudguard, carried along for some distance and thrown on to the roadway. 4. The relatives are aware of the death. 5. I am making further enquiries into this case, and will later prepare a brief of evidence for the Coroner. Honnon Page states I am a motor Bus Driver, residing at 27 Wells Street, Brighton. I am employed by George and Lewis Page, Motor Bus Proprietor, driving a Motor Bus from Middle Brighton to the City. At about 7.18 p.m.on Saturday the 15th day of October 1932, I was driving Motor Bus Number 77004, North along St Kilda Road on the centre roadway. As I approached the intersection of Arthur Street, and St Kilda Road, I would be travelling at about 28 miles per hour. I had just drawn about level with the south end of the plantation at Arthur Street, when I felt a slight bump on the front of the bus, then suddenly a dark object appeared on the front of the bus on the driving side. I called out "What's that" One of my passengers replied I think you have hit something. I then brought the bus to a standstill at the North corner of Arthur Street. I got out of the bus and ran back, and I saw the form of a person lying on the roadway about 10 paces at the rear of the bus. I immediately ran to a private home opposite and rang for the ambulance. As I approached the intersection I had my eyes on the roadway ahead of me and I did not see any person about, and I do not know where the lady came from or how she came to be struck by the bus. It had been raining heavily, and was raining lightly at the time of the accident. The roadway was greasy, and the visibilty was bad, owing to the shadows of the trees on the wet road. My wind screen wiper was working, and had been working all the trip and the remainder of the glass on the windscreen was wet. I had about 15 passengers aboard the bus, and when I felt the slight bump, I thought that I must have struck some object left lying on the roadway, and owing to the fact that the road was very greasy I did not apply my brakes suddenlly for fear of skidding the bus into the palntation and the trees growing on it. I had both the head lights on the bus burning at the time of the accident. I have been licenced to drive a Motor Car for three years, and I have held a Hackney Carriage Licence for over two years, and I have been driving a Motor Bus from Middle Brighton to the City for the past two years. My licence No 363386 is current to the 9th July 1933. He also stated that the bus was owned by his brothers.5 |
