    The case stated by the justices was as follows:-"The information alleged that the defendant did obstruct the watercourse of the Dandenong Creek, thereby stopping and cutting off any supply of water for the use of the public and their cattle, contrary to the statute in that case made and provided. The defendant pleaded not guilty ; and after hearing the parties, and the evidence adduced by them, we did, on the 2nd day of April, 1870, convict the defendant of the said offence, and adjudged him to pay the sum of £3 for the same, and £1 1s. costs. It was proved upon the hearing that the defendant had deepened the bed of the Dandenong Creek opposite his own property, and that he had sunk a well upon his own land close to the edge of the creek, and had made a drain from the creek to this well ; that over the well he had erected a pump, and by that means irrigated his land, and that his so doing stopped the water from flowing down to the complainant's land, which was below defendant's.
    At the close of the complainant's case, the attorney for the said defendant was heard in answer to the matter of the said information, and contended that section 17 of the Police Offences Statute 1863, under which the information was brought, did not apply to the offence, and that, even if it did, the defendant was entitled to the exemption contained in the said section ; that he acted under a fair and reasonable supposition that he had a right to do the act complained of; and also proved on behalf of the defendant that the pump had been erected for more than two years, and that there was a brackish spring in the well where the pump was erected ; and also that the defendant used the water from the well. We determined that the matter here in before stated afforded no ground of answer or defence to the said information."
    Mr. MOLESWORTH contended that section 17 of the statute only applied to artificial watercourses, and not to natural creeks or rivers.
    Mr. FELLOWS said he could not sustain the conviction.
    Appeal allowed, with costs ; determination reversed.
    The Court then adjourned.15

From Gottleib Weist, drawing attention to state of drain running at south side of his place at the Bangholme; the drain is entirely choked up, causing the water to overflow into his paddock, bringing with it furze seed in large quantities, and poisoning his property with same. He directed attention to the furze in the paddock known as the bank paddock, which was over run with furze.—The Secretary said a number of persons in the shire had taken no notice of the order to remove furze.—Cr Rogers moved that steps be taken to enforce the eradication of furze.—Seconded by Cr R. G. Keys and carried.19

Charles Weist's house, Gladstone Road, Dandenong. As I'm unsure of the date of this photo it could either be at the corner of Gladstone and Heatherton Roads, or further up the road. Born Johannes Carl Charles Weist, he was known commonly as Charles Weis. Born at Narre Warren around 1859, Charles Weist, lived basically his whole life in the Dandenong district.
His parents were among the original selectors in the Police Paddocks on Gladstone Road, when it was at its original size, taking up land there when Charles was only 3 years old. Gowrie Park, as it was known, faced both Gladstone Road and the Dandenong Creek. Charles married Ida Pauline Erdman (who was also born in Narre Warren on 21 March 1858), in 1880.
His parents, who first settled the family farm on Gladstone Road, were Herman Gottlieb Weist and Monika Wilhelmine Kleinert. Sadly, his father died in the Kew Asylum (Metropolitan Lunatic Asylum) in 1901, he had been admitted to Kew Asylum on 17th Dec 1900, suffering from senile insanity (duration 1 year) and was in frail bodily health. Charles himself carried on farming pursuits at the family farm for years before retiring in the early 1920s, moving to the corner of Heatherton and Gladstone Roads. He later sold Gowrie Park in 1924.
His wife, Ida Pauline, passed away at 54 on the 4th of Jun 1912. In the late 1930s Charles became bed-ridden, but bore his long illness with great fortitude, until he died on the 2nd of July 1941. He had four sons, Albert Edward, Herman Henry, Frederick William, and Edward Allan who died in infancy. He also had three daughters, Ida Minna [Minnie Ida] (Mrs. Wanke, Gladstone Road, Dandenong), Emma Annie Anna, and Bertha Annie who died in infancy.
His funeral took place on Friday 4th July 1941, when he was interred in the family grave in the Dandenong Cemetery. Rev. A. R. Sinclair officiated. The pallbearers were Mr. F. Exner, E. Exner, L. Sutton, V. Nash, H. Wanke, H. Creagle, K. McLennan and H. Exner.

  • 24 Apr 1889: The valuation of Chas. Weist, for several properties in the township, was reduced by mutual consent from £170 to £125, with £1 1s. 6d. costs.8
  • 15 Jul 1891: CRUELTY TO A COW.
    Mr. Mellor, representing the Society for the Prevention of Cruelty to Animals, proceeded against C. Weist for cruelty to a cow on 30th June.
    Mr. Tanner for defendant Mr. Mellor briefly stated the case to the Bench, and called Constable Deverall, who deposed that on July 1 he was informed that there was a cow lying in a drain near the market. Witness went to the place indicated and found the cow in a drain 4ft. deep. Obtained the assistance of several men and dragged the cow out.
    Joseph Murray in the employment of Howard and Scott, said he remembered Tuesday, 30th June. On that day he went out to Charles Weist's place to bring in some cattle to the Dandenong Market. Got the cattle, and they went all right till nearing the market, when one of the cows walked into a drain; in attempting to get out again the bank gave way and the cow fell down in the drain. Witness got off his horse and tried to get the cow up but could not do so, and after driving the other cattle to the market he procured the assistance of P. O'Brien, jun., but their endeavors to get the cow out failed. Witness then went back to the market and told Weist of the occurrence, and he (Weist) and his father then went to where the cow was lying and attempted to get her up, but failed. Weist asked witness what was to be done, and witness replied that he would see that the cow was taken out on the following (Wednesday) morning.
    Cross-examined by Mr. Tanner: Witness fulfilled his promise, and, with the assistance of some other men, the cow was taken out of the drain. In witness's opinion seven or eight men were required to get the cow out This closed the case, and in consideration of the fact that Weist had made endeavors to extricate the cow, the Bench dismissed the case.9
  • 2 Jun 1898: At the Dandenong court on Monday Henry Long pleaded guilty to stealing £8 from Charles Weist, and was. sentenced to three months' imprisonment.10
  • 21 Oct 1908: DANDENONG CREEK, AT DANDENONG.
    I HEREBY give notice that I intend to apply for a licence empowering me to divert water to the extent of sixteen gallons per minute from the above-named creek for irrigation purposes. Any objection to such application must be forwarded, in writing, to the State Rivers and Water Supply Commission, Melbourne, within thirty days of the date hereof.

  • 9 Jul 1941: OBITUARY. MR CHARLES WEIST LIVED HERE ALL HIS LIFE
    BORN at Narre Warren 82 years ago Mr Charles Weist, who passed away at a private hospital in Dandenong last Wednesday, has lived his whole life in the Dandenong district and was very well-known and universally respected. His parents were among the original selectors in the Police Paddocks on Gladstone Rd., taking up land there when the late Mr Weist was only 3 years old. He himself carried on farming pursuits there for many years before removing to the corner of Heatherton and Gladstone Rds. Five or six years ago the late Mr Weist became bed-ridden, but he bore his long illness with great fortitude. He is survived by four sons (Henry, Alfred, Herman and Frederick) and one daughter, Minnie (Mrs Wanke, Gladstone Rd., Dandenong).
    The funeral took place on Friday last, when the remains were interred in the family grave in the Dandenong Cemetery. Rev. A. R. Sinclair officiated both at the home and the graveside. The pallbearers were Messrs F. Exner, E. Exner, L. Sutton, V. Nash, H. Wanke, H. Creagle, K. McLennan and H. Exner. W. J. Garnar & Son had charge of the funeral arrangements.14

The funeral will leave his residence, Gladstone-road, Dandenong, on Thursday, 6th inst., at 1 p.m.
