That the Respondent has without just cause or excuse wilfully deserted me and without any such cause or excuse left me continuously so deserted during three years and upwards. That I am now 41 years of age and was born at Camperdown in the State of Victoria and am domiciled in the State of Victoria. That the Respondent is now 40 years of age and was born at Coburg in the State of Victoria and is domiciled in the State of Victoria. That prior to the said marriage I was a bachelor and earned my living as a hairdresser and since the said marriage I have continued in that occupation and also that of a Hotelkeeper. Prior to the said marriage Respondent was a spinster and was engaged in home duties and since the said marriage Respondent was supported by me while we lived together, part of that time respondent was a licensed victualler and since the time she deserted me she conducts a boarding house. There is living issue of the said marriage a male child Jack Kirk born at Windsor in the said State now fifteen years of age. Immediately after the said marriage Respondent and I lived and cohabited together at Bacchus Marsh where I had a hairdressing business. We remained there until the year 1913 when in consequence of my ill health I sold the said business and with the consent of the Respondent went to Sydney for several months to recuperate. During that time Respondent stayed with her relatives. On being restored to good health I returned to Victoria and purchased a hairdressing business at High Street Horthcote in 1914. The Respondent and I lived and cohabited at the dwelling attached to the business and remained there for four years. At the latter part of this period Respondent conducted a Confectionery business. In or about the year 1918 I moved my business into more up to date premises in High Street Northcote and the Respondent and I then lived away from the business in a house in Helen Street Northcote. In or about 1920 I sold my business and the Respondent sold her Confectionery business. With the joint proceeds we purchased the lease and license of the Cardinia Park Hotel Beaconsfield. The Respondent and I lived and cohabited there till October or November 1921. We both worked in the business of the said hotel; in addition for about eight months I conducted a small hairdressing business at-Berwick which I used to attend four evenings a week. Up to this time Respondent and I had lived on amicable terms and by our united endeavours were in comfortable circumstances. About three months before leaving the Cardinia Park Hotel about July or August 1921 relations became strained between Respondent and myself because I called for her one night at the Central Hotel Beaconsfield where she was spending the evening. This passed over and when we sold the Hotel we purchased the Pine Grove Hotel Upper Beaconsfield. At that time the Respondent and I were again on friendly terms and we lived together at the latter Hotel where we both for a time put in the whole of our time. In the off season at the Respondents suggestion I obtained employment as Manager of hairdressing and tobacconist businesses in and around Melbourne. I returned to Upper Beaconsfield every week end and paid the whole of my earnings to the Respondent. Shortly prior to May 1923 I noticed that Respondent was neglecting ny needs about the home and I asked her what was the reason. She said "I am finished with you. "I'm sick of you." I asked her again for her reason. She said she had no reason. I asked and urged her to change her mind but she persisted in her attitude. bhe refused to take any more money from me although I continued to offer the same to her and from the 12th May 1923 she refused to have sexual intercourse with me. I continued in my employment and went home each weekend. The Respondent continued her hostile attitude towards me refusing me intercourse and neglecting my needs in the home and on two occasions she struck me and on a third occasion she and her sister both attacked me and I was considerably cut about the head and face and my clothing torn. I found that Respondent in May 1923 had made arrangements to sell the Hotel. In July 1923 I consulted my Solicitor who I am informed and believe wrote the Respondent a letter on 24th July 1923. Despite my protests the Respondent persisted in her attitude and at the end of August 1923 left the Hotel in my "absence leaving no message. I found out she had gone when I returned at the weekend. This was shortly after my Solicitor sent her the said letter. She had appointed a Manager to look after the Hotel in her place. I have only spoken to Respondent on two occasions since and she ignored me on both occasions. This occurred in the month of November 1923. After she left the Hotel I was unaware of her whereabouts for some months. I made exhaustive efforts to find her and the child. The property was sold and the proceeds settled between Respondent and I and the child of the marriage by agreement dated the 9th day of November 1923. On the 29th April 1924 I made through my Solicitor an application to Mr. Justice Mann for the custody of the child of the said marriage and an order was made for the Respondent to have the custody of the child and I was to have access to the child. I paid the Respondent fifteen shillings a week for the maintenance of the child up to the date of this order. Sexual cohabitation between Respondent and myself ceased in the month of May 1923.3 |
