THAT I was on the 16th day of January 1909 lawfully married to the abovenamed Respondent William Henry Carter by the Reverend Andrew Fergus Ferguson according to the Independant Presbyterian Church rites. 3. PRIOR to marriage I was a spinster residing in Newry Street Burnley in the State of Victoria and followed the occupation of a Domestic Servant. 4. THE Respondent prior to marriage was a Bachelor residing 115 Cardigan Street Carlton in the State of Victoria and followed the occupation of a Blacksmith. 5. THAT I am of the age of 38 years and was born at Perth in the State of West Australia and am domiciled in the State of Victoria. 6. THE Respondent is of the age of 46 years and was born at Warraoknabeal in the State of Victoria and is domiciled in the said State of Victoria. 7. THERE are two children issue of the said marriage William Frederick Carter a male 17 years old, Percy James Carter a male 14 years old. 8. AFTER marriage the Respondent and I lived and cohabited together as man and wife at 101 Boundary Street North Melbourne for two years and thence to Surrey Hills for about two years — during the time we resided here I was pregnant and the Respondent was very cruel to me two months before my child was born the Respondent kicked me several times in my baok and from then on I suffered from internal injuries and three years after I had to under go an operation through the result of his cruelty to me, when I came out of the Hospital I was afraid to go back to him again I was ill for 3 years after the operation and I am still in delicate health. Since then I have earned my living being employed at Rocke Tomsitts chemistry works Richmond and I am still employed there. The Respondent has been a driver living in different suburbs of Melbourne. I have been informed and believe that the Respondent has gone through a form of marriage with a Mrs. Nolan and has lived with her and I am informed and believe that a warrant has been issued for the Respondent's arrest on the charge of bigamy by the polioe. I do not know where the Respondent is or where he could be found. Cohabitation finally ceased when I went into the Hospital that would be in August 1916. 9. THAT since the celebration of the said marriage the Respondent has been guilty of a repeated act of adultery. 10. THAT since the celebration of the said marriage the Respondent has been guilty of bigamy coupled with adultery. 11. THE respondent altered the date of our Marriage Certificate striking out January and inserting September and altering the year from 1909 to 1908, the reason that he did so was I believe that our first ohild was born too soon after our marriage. I being pregnant before marriage. 11. SAME as aforesaid there has been no separations or separation between us and no deed of separation was ever executed. 12. I distinctly and unequivocally deny all collusion or connivance past or present direct or indirect with the Respondent or any person liable to be made respondent. The "Kath Roberts Reserve" in Beaconsfield was so named by the Pakenham Shire as a compliment to an old and well respected resident of the town. Mrs Roberts who now lives in Berwick, is a charming, vibrant lady who has very good recall, and who has kindly provided the following information: After she married her husband Herman in 1924, she assisted him in running a General Store which was on the corner of Wood Street and Beaconsfield Avenue. Soon after war broke out in 1939, the Roberts left the store and took over the Post Office at Beaconsfield. In the early 40's, several pensioners from the area now known as Guy's Hill, asked if they could collect their pensions from the store there, rather than go all the way to Beaconsfield. This was arranged by the Roberts. A little later when petrol rationing was introduced, a further request was made that the tickets for petrol also be made available at the store. This however, was only possible if the store was made a branch post office. Letters were written by local people to the Postmaster General's Department requesting this and about 1941, the request was granted. The Department then wrote to Mrs Roberts asking her to submit suitable names for the new Post Office. Mrs Roberts recalls "the storekeepers were a delightfully odd couple named Herb and Eadie Guy and the only name I could think of which would be suitable was Guy's Hill". Mrs Roberts submitted only the one name and it was accepted by the Department. She admits "the Lukes were rather upset and wrote to the Department". The Luke family had built and run the original store in 1930, as well as making the Montuna Golf Course which opened in 1927. At the time there were also some letters to the papers and local controversy. In 1981 the name Guy's Hill was officially recognised by the Shire following a motion put by Councillor Keith Ewenson, who on behalf of the Council made enquiries locally and received the impression that the name was generally acceptable. He noted a local opinion that "it would cost money to change it". Older names for the area are Inebriates Hill, Middle Beaconsfield and Lukes Hill. A mystery remains - who were the Guys. There appears little known about them apart from the fact they had the store, possibly less than two years - and that Mrs Guy ran the store and he may have been a builder. A Changi P.O.W., Perc was a stalwart until ill-health overtook him some months ago and he was hospitalised in Melbourne. Condolences go to both widows and the relatives of these men who will long be remembered in these hills.15 |

Village Bell* | Apr 1988 | NEW SHOPS FOR UPPER BEACONSFIELD. The little old house between the Store and the Chemist, will be gone after Easter. Of recent years it has seen a variety of residents and craft sales. New owners, Mr. & Mrs. Russo of Officer, intend to build 3 new shops on this site, one of which will be a green-grocery run by Mr. Bill Wynen, formerly of Berwick. Mr. John Glismann tells us that this land was owned by Shorthouse Coaches and the shed on the site used as a blacksmith shop. A Mr. Horner bought the area and subdivided the blocks. In the early thirties Bill Lang and John Glismann built the present house from materials taken from a shop which was being demolished on the now Roynan property in Salisbury Road. The house was built for a Mr. Paxton who operated a green-grocers store there for many years before moving to a green-grocers store in Berwick. After this period, Bill Lang bought the house, and lived there and ran the mail run for many years, his widow lived there until moving into Highland Park where she died a few years ago. How interesting to have a green-grocers shop on the very site of the original green-grocers store. William John Lang9 |
(Mentioned) Village Bell | May 1988 | THE OLD LANG HOUSE REVISITED A lovely letter from Mr. John Glismann pointed out (very gently) errors in my article in the last issue. Mr. Ken Hudson wrote in on the same subject. It almost seems worthwhile making a mistake to find out that people read "The Bell"! As far as we can ascertain from Messrs. Glismann and Hudson, the original land owner was Mr. Shorthouse who had stables on the area. He sold to J. Nathan who subdivided the land keeping the site of the now general store. John Glismann built the original store for J. Nathan on this site using part of the Shorthouse stables for the rear wall - drawings of this building were retained by John Glismann and recently handed to the Pakenham Historical Society. Mr. Paxton bought the block where "Langs" house now stands and Tom Gilpin and his brother Jim built the house and shop on this site for him. If anyone has more information on this matter we would be delighted to hear from you.10 |

(Mentioned) Village Bell | Oct 1983 | "STONYCROFT" stood on the north-east corner of the intersection of Split Rock and Berglund Roads. We are indebted for information to Mrs. Susan Pitman, the recent resident, and to Mr. Larry Osborn of Nar Nar Goon North, who has photographs taken when the house and garden were looking their best. The house was built by Mr. Walford (not to be confused with Professor Halford, another early resident), about 1880, as a house for his coachman. At the same time he built his own residence, "The Fernery", on the opposite side of Split Rock Road, 100 yards towards the Split Rock. That house was later moved to its present position at the corner of Salisbury and Sugar Loaf Roads. The two houses were generally similar, Mr. Walford's being on a larger scale with an additional pair of rooms at the back. A central passage went from front to back, with living rooms on one side and bedrooms on the other. At one side of the front door was a bay window, at the other a verandah. The weatherboard construction was rather rough, as one would expect in the early 1880's in what was then a remote place. Dwelling for a moment on "The Fernery", the journalist "Vagabond" referred to "Mr Walford's capital spring of fresh water" in an "Argus" article in 1885. The "Illustrated Guide to Upper Beaconsfield" published in 1899 had a picture of "The Fernery", and showed the position of "Walford's Fernery" on a map (reproduced in the recent publication "In the Wake of the Pack Tracks). However in the text, the "Guide" referred to "Robertson's Fernery", so presumably he had followed Walford. A later owner of "Stonycroft" was Mr. Simmons, who sold to Mr. H.J. Osborn in 1919. At that time there was an orchard of 8 or 9 acres, and a still for distilling eucalyptus oil, situated near the creek for its supply of cooling water. The Osborn family resided until 1970, when they sold to Dr. Bailey. Mr. and Mrs. Osborn were keen gardeners, and established a properly laid out garden. To care for it, run-off water was led in from the roadside to a lily pool, and from there piped to a large concrete tank; it was probably this tank that subsequently gave rise to speculation about a cellar. Later a dam was formed by the creek, and water pumped up from there. Dr. Bailey used the place as a holiday house, but did not live there. He converted the old coach stable into a garage by adding side walls, but otherwise the buildings were little changed, and became overhung with trees. The garden, once cared for, went back to nature. Susan and Tom Pitman purchased the property in 1981, with a view to restoring it. They found walls of rough sawn boards, originally covered with hessian, which had later been covered with caneite. In places there were traces of old wallpaper, and in the passage a stencilled border made by Mrs. Osborn. Tidying the garden and restoring the house were well advanced when the bushfire destroyed it all beyond the possibility of repair. When rebuilding, a site was chosen further from the road, and the style of construction was modern, mud brick and pine.9 |
