1. THAT I am the abovenamed Petitioner.
2. THAT I was on the 16th day of January 1909 lawfully married to the abovenamed Respondent William Henry Carter by the Reverend Andrew Fergus Ferguson according to the Independant Presbyterian Church rites.
3. PRIOR to marriage I was a spinster residing in Newry Street Burnley in the State of Victoria and followed the occupation of a Domestic Servant.
4. THE Respondent prior to marriage was a Bachelor residing 115 Cardigan Street Carlton in the State of Victoria and followed the occupation of a Blacksmith.
5. THAT I am of the age of 38 years and was born at Perth in the State of West Australia and am domiciled in the State of Victoria.
6. THE Respondent is of the age of 46 years and was born at Warraoknabeal in the State of Victoria and is domiciled in the said State of Victoria.
7. THERE are two children issue of the said marriage William Frederick Carter a male 17 years old, Percy James Carter a male 14 years old.
8. AFTER marriage the Respondent and I lived and cohabited together as man and wife at 101 Boundary Street North Melbourne for two years and thence to Surrey Hills for about two years — during the time we resided here I was pregnant and the Respondent was very cruel to me two months before my child was born the Respondent kicked me several times in my baok and from then on I suffered from internal injuries and three years after I had to under go an operation through the result of his cruelty to me, when I came out of the Hospital I was afraid to go back to him again I was ill for 3 years after the operation and I am still in delicate health. Since then I have earned my living being employed at Rocke Tomsitts chemistry works Richmond and I am still employed there. The Respondent has been a driver living in different suburbs of Melbourne. I have been informed and believe that the Respondent has gone through a form of marriage with a Mrs. Nolan and has lived with her and I am informed and believe that a warrant has been issued for the Respondent's arrest on the charge of bigamy by the polioe. I do not know where the Respondent is or where he could be found. Cohabitation finally ceased when I went into the Hospital that would be in August 1916.
9. THAT since the celebration of the said marriage the Respondent has been guilty of a repeated act of adultery.
10. THAT since the celebration of the said marriage the Respondent has been guilty of bigamy coupled with adultery.
11. THE respondent altered the date of our Marriage Certificate striking out January and inserting September and altering the year from 1909 to 1908, the reason that he did so was I believe that our first ohild was born too soon after our marriage. I being pregnant before marriage.
11. SAME as aforesaid there has been no separations or separation between us and no deed of separation was ever executed.
12. I distinctly and unequivocally deny all collusion or connivance past or present direct or indirect with the Respondent or any person liable to be made respondent.

(Mentioned) Village BellDec 1991 WHY GUYS HILL - MRS KATHERINE ROBERTS TELLS ALL !!! The "Kath Roberts Reserve" in Beaconsfield was so named by the Pakenham Shire as a compliment to an old and well respected resident of the town. Mrs Roberts who now lives in Berwick, is a charming, vibrant lady who has very good recall, and who has kindly provided the following information:
After she married her husband Herman in 1924, she assisted him in running a General Store which was on the corner of Wood Street and Beaconsfield Avenue. Soon after war broke out in 1939, the Roberts left the store and took over the Post Office at Beaconsfield.
In the early 40's, several pensioners from the area now known as Guy's Hill, asked if they could collect their pensions from the store there, rather than go all the way to Beaconsfield. This was arranged by the Roberts.
A little later when petrol rationing was introduced, a further request was made that the tickets for petrol also be made available at the store. This however, was only possible if the store was made a branch post office. Letters were written by local people to the Postmaster General's Department requesting this and about 1941, the request was granted.
The Department then wrote to Mrs Roberts asking her to submit suitable names for the new Post Office.
Mrs Roberts recalls "the storekeepers were a delightfully odd couple named Herb and Eadie Guy and the only name I could think of which would be suitable was Guy's Hill".
Mrs Roberts submitted only the one name and it was accepted by the Department. She admits "the Lukes were rather upset and wrote to the Department". The Luke family had built and run the original store in 1930, as well as making the Montuna Golf Course which opened in 1927. At the time there were also some letters to the papers and local controversy.
In 1981 the name Guy's Hill was officially recognised by the Shire following a motion put by Councillor Keith Ewenson, who on behalf of the Council made enquiries locally and received the impression that the name was generally acceptable. He noted a local opinion that "it would cost money to change it". Older names for the area are Inebriates Hill, Middle Beaconsfield and Lukes Hill.
A mystery remains - who were the Guys. There appears little known about them apart from the fact they had the store, possibly less than two years - and that Mrs Guy ran the store and he may have been a builder. If anyone can add to this, please contact the Editor.10

  • 19 Jul 1930: DEATH OF COW DAMAGES AWARDED. At Frankston Police Court on Tuesday before Mr. W. C. Wilson, P.M., Herbert Stanley Guy, of Carrum Downs, dairyman farmer, claimed £20 damages from Arthur Nelson, of Wonthaggi, sanitary contractor. The claim was for loss sustained by Guy through the death of a cow which was injured by a car driven by Nelson on Frankston-Dandenong road on May 2 and had to be destroyed. Mr. F. B. Barlow appeared for claimant and Mr Prendergast for defendant. Edith Elizabeth Guy, wife of plaintiff, said she was driving a herd of cows from her home to a paddock on the other side of the road. Defendant approached at a high speed and one cow was struck by the car. It was pushed for some distance along the road in front of the car, which passed over its hind legs. The car did not stop although she called out to the driver, several times. She took the number of the car and her husband informed the police. Nelson said the cows left the road as he approached and made a passage for him. He slowed down to two or three miles an hour. One cow ran in front of the car, which stopped immediately. The cow got up and walked away. He stopped for a short time but could see no one in charge of the cows. As the cow did not appear to be injured he drove on. Mr. Wilson said he did not believe the evidence for the defence. A verdict was given for complainant for £14, with £5/19/6 costs. Herbert Stanley Guy17

    MR. JOHN W. RICHARDSON, of “Faldinghurst,” Upper Beaconsfield, well known breeder of Red Poll Stud cattle, has announced his candidature for the extraordinary vacancy in the Beaconsfield Riding of the Berwick Council. Son of the late Judge Richardson, he has been farming in the Upper Beaconsfield district lor the past 12 years and the “Faldinghurst” herd of Red Polls is one of the few accredited tuberculin-free herd's in the district, the strain is favourably known throughout the State.     ALTHOUGH Mr. A. E. C. Russell, of Gembrook, established a big lead on the first count, polling a particularly good vote in his own district, the distribution of Mr. Claud Harris’s second preferences gave Mr. John Richardson, of Upper Beaconsfield, a majority of 38 in the extraordinary election for the Beaconsfield Riding of the Berwick Council last Saturday.
    THE NEW COUNCILLOR, who is a son of the late Judge Richardson, and a noted breeder of Red Poll s at his “Faldinghurst” Stud, Upper Beaconsfield, will have youth on-his side and when he takes his seat next month, will be the youngest member of the council.
    THE KEEN interest taken in the election is shown by the fact that close on 800 votes were cast. There was little between the two Upper Beaconsfield rivals, the successful candidate having only 21 votes more than Mr. Claud Harris, who was the first to drop out.

  • 25 Aug 1948: SCRUB LAND CONVERTED TO A DAIRY FARM.
    What is the best thing to do with poor granitic soils carrying heath, tea-tree and inferior types of eucalypt? Some people say "Leave it to the deer and kangaroo.'' Others advise "Plant pine trees and make productive wood-lots."
    The most positive thing is to develop such areas for some form of animal production. This is not an easy job.
    Nevertheless it is being done in a pleasing, way by Cr. John Richardson and his brother, Leighton, on their 260-acre property near Upper Beaconsfield. Their problem is not merely to clear the scrub and establish a pasture under a favorable 37in.-a-year rainfall. Among other things they have to find out what grasses will be most productive under their conditions, and what fertilisers will be needed to keep the pastures going. Although not trained specifically in agricultural science, the brothers have made com mendable efforts to acquire the knowledge to help them best in their project. Not many farms are to be found in Victoria where one can have such inter-esting discussions on animal-grass-soil-fertiliser relationships and problems of heredity. The property itself is a veritable experiment station, equip ped with a microscope. The front lawn contained the first series of grass "plots." An area on the farm has been top-dressed with various kinds and amounts of artificial fertiliser. One interesting observation is that worm casts are most numerous on areas top-dressed with potash. The programme of clearing 10 acres a year was followed for 10 years until Leighton went to the war and John was fully oc cupied on farm production and maintenance. Shortage of petrol made him give up the wholemilk "round" and concen trate on butter fat. Light scrub is cleared with the heavy disc, and trees are brought to the ground with the tractor. Sales of firewood help, to pay clearing costs. The light disc is used for controlling re-growths. Once established, pastures are rarely broken up except to grow cereals for winter grazing.
    HAS HIGHER RAINFALL
    VARIOUS strains of sub clover have done well. With rye grass they have made at-tractive meadow hay mixtures White clover has flourished for the first two years and then proved rather disappointing. Why? Perhaps it uses all available potash in this period. District Extension Officer A. V. Doery. B.Agr.Sc., thinks it might do better after sub clover has grown on the soil for a few years. Cocksfoot has become estab lished on the higher land. The success of Phalaris has been confined chiefly to three acres of tile-drained soil, which formerly supported citrus. Bokhara clover and Lotus major are among other species tested by these progressive men. Although apparently warmer than country south of it, the district has a higher rainfall and later season. Paddocks are shut up as late as October for cutting up to Christmas time. Hay is elevated with an auto-matic pick-up into frames holding about two tons, which carry it to well-placed stack positions around the property. Leighton and John plan to make more of these frames and dump each full of hay at strategic positions during future harvests. There is a big hay shed near the milking shed. Cows are given enough concen trates to keep them quiet when being milked. At present the property is supporting about 60 head of stock, whose owners send as weaners for mating later with Messrs Richardson's Red Polls. Redelivery is taken about a month before the heifers calve. RED POLLS THE excellent performance of a Red Poll cross cow among their early purchases largely influenced the brothers to go in for the Red Poll. They are keen on preserving the dual-purpose qualities and guard against beefiness. Leighton has strong opinions on the limitations of a cow's worth being judged solely on show points. The herd is tested. Falding-hurst Ash (by Woodburn Peter Pan) produced 333lb. when nine years old. Another cow pro duced 391lb. as a 10-year-old. Leighton admires the utility and type qualities of the Agri cultural Department's "Victoria" herd at Werribee. Blood from it and the stud of Mr A. R. Beggs. Buln Gherin, Beau-fort, is being used. An unusual performance of the stud was the birth of twins by Caesarean operation from a cow which had its leg broken. CALVING PLAN ALTHOUGH apparently un-orthodox, Messrs Richardsons' plan for calving in autumn has a sound back-ground in an area where the normal trough of production is in February-March. On the theory that green feed is necessary for milking cows, lactations beginning in autumn will be maintained evenly throughout winter by grow ill on paddocks specially shut up for the purpose, and green cereals sown for grazing. These will be supplemented by grass hay fed every two days. Cows already under this system have produced up to 30lb of milk a day at the end of their lactation. Other excellent features of Messrs Richardson's operations are neat typewritten records, implement shed, machinery shop, ramp and trench for overhauling cars, shelter belts including chain breaks of scrub', introduced trees, peas to improve orchard fertility, plans for better water systems and an impressive array of championship ribbons. Those who have lived in this district for some decades mourn the loss during the past month of two personalities, Perc Renfree and Norm Lawson.
Also in his late 70's, Perc Renfree was an orchardist at Dewhurst, moving to Stoney Creek Road when his property was acquired for the Cardinia Reservoir project. A Changi P.O.W., Perc was a stalwart until ill-health overtook him some months ago and he was hospitalised in Melbourne.
Condolences go to both widows and the relatives of these men who will long be remembered in these hills.15

  • 23 Oct 1913: Miss Enid Renfree, the well-known Dandenong equestrienne, met with a severe accident when riding home, on Wednesday evening. Her pony suddenly bolted and got out of her control. After going some distance the inevitable happened, and Miss Renfree was thrown heavily. Fortunately she escaped with a severe shaking, and she is to be congratulated upon avoiding more serious injury.8
  • 7 Mar 1918: Wedding. A wedding of local interest was celebrated on Wednesday evening week, the 27th February, at the Methodist Church, Dandenong, by the Rev. Birch Roberts, when Miss Enid Renfree, the third daughter of Mr and Mrs Harry Renfree, of Bangholme road, Dandenong and Mr Percy Raymond Brydon, eldest son of Mr P. Brydon, of Officer, but late of Dandenong, were the principals. The bride was attired in a very tasteful tailored costume in a pretty shade of fawn cloth, hat to tone, and carried a handsome posy of white rose, water lilies and fern. Miss Jenny Renfree (sister) was bridesmaid, and wore a nice coat frock of brown tresine and a smart velvet hat, and her posy was composed of pretty pink roses and tiger lilies, with small ferns.   • 15 Oct 1914: A wedding took place on Wednesday evening last at Scot's Church, Collins street, Melbourne, between Mr William Henry Renfree, the second son of Mr. H. Renfree, Dandenong, and Miss May Costelloe, of Hawthorn. The bridesmaids were Miss Alice Renfree (sister of the bridegroom) and Miss Violet Costelloe (sister of the bride) Mr Anderson was best man, and Mr Reg. Gibson groomsman. The bride wore an extremely pretty dress of white crepe de chine, with shadow lace trimmings, made on train, also wreath and veil, and carried a nice bouquet of white roses, etc. The brides maids were becomingly gowned in white frocks, pink hats, and carried bouquets of perfection pink carnations. The bride wore a travelling dress of golden brown crepe de chine and a white hat. The wedding breakfast was held at the Cafe Francais.
    Amongst many presents received was a silver afternoon tea service from the electrical engineer's department of the General Post Office, on the staff of which Mr Renfree is employed in the clerical branch. Bridget Mary 'May' Costello14

The little old house between the Store and the Chemist, will be gone after Easter. Of recent years it has seen a variety of residents and craft sales. New owners, Mr. & Mrs. Russo of Officer, intend to build 3 new shops on this site, one of which will be a green-grocery run by Mr. Bill Wynen, formerly of Berwick.
Mr. John Glismann tells us that this land was owned by Shorthouse Coaches and the shed on the site used as a blacksmith shop. A Mr. Horner bought the area and subdivided the blocks. In the early thirties Bill Lang and John Glismann built the present house from materials taken from a shop which was being demolished on the now Roynan property in Salisbury Road. The house was built for a Mr. Paxton who operated a green-grocers store there for many years before moving to a green-grocers store in Berwick. After this period, Bill Lang bought the house, and lived there and ran the mail run for many years, his widow lived there until moving into Highland Park where she died a few years ago.

A lovely letter from Mr. John Glismann pointed out (very gently) errors in my article in the last issue. Mr. Ken Hudson wrote in on the same subject. It almost seems worthwhile making a mistake to find out that people read "The Bell"!
As far as we can ascertain from Messrs. Glismann and Hudson, the original land owner was Mr. Shorthouse who had stables on the area. He sold to J. Nathan who subdivided the land keeping the site of the now general store.
John Glismann built the original store for J. Nathan on this site using part of the Shorthouse stables for the rear wall - drawings of this building were retained by John Glismann and recently handed to the Pakenham Historical Society.
Mr. Paxton bought the block where "Langs" house now stands and Tom Gilpin and his brother Jim built the house and shop on this site for him.
If anyone has more information on this matter we would be delighted to hear from you.10

(Mentioned) Village BellOct 1983 "STONYCROFT" stood on the north-east corner of the intersection of Split Rock and Berglund Roads. We are indebted for information to Mrs. Susan Pitman, the recent resident, and to Mr. Larry Osborn of Nar Nar Goon North, who has photographs taken when the house and garden were looking their best.
The house was built by Mr. Walford (not to be confused with Professor Halford, another early resident), about 1880, as a house for his coachman. At the same time he built his own residence, "The Fernery", on the opposite side of Split Rock Road, 100 yards towards the Split Rock. That house was later moved to its present position at the corner of Salisbury and Sugar Loaf Roads. The two houses were generally similar, Mr. Walford's being on a larger scale with an additional pair of rooms at the back. A central passage went from front to back, with living rooms on one side and bedrooms on the other. At one side of the front door was a bay window, at the other a verandah. The weatherboard construction was rather rough, as one would expect in the early 1880's in what was then a remote place.
Dwelling for a moment on "The Fernery", the journalist "Vagabond" referred to "Mr Walford's capital spring of fresh water" in an "Argus" article in 1885. The "Illustrated Guide to Upper Beaconsfield" published in 1899 had a picture of "The Fernery", and showed the position of "Walford's Fernery" on a map (reproduced in the recent publication "In the Wake of the Pack Tracks). However in the text, the "Guide" referred to "Robertson's Fernery", so presumably he had followed Walford.
A later owner of "Stonycroft" was Mr. Simmons, who sold to Mr. H.J. Osborn in 1919. At that time there was an orchard of 8 or 9 acres, and a still for distilling eucalyptus oil, situated near the creek for its supply of cooling water.
The Osborn family resided until 1970, when they sold to Dr. Bailey. Mr. and Mrs. Osborn were keen gardeners, and established a properly laid out garden. To care for it, run-off water was led in from the roadside to a lily pool, and from there piped to a large concrete tank; it was probably this tank that subsequently gave rise to speculation about a cellar. Later a dam was formed by the creek, and water pumped up from there.
Dr. Bailey used the place as a holiday house, but did not live there. He converted the old coach stable into a garage by adding side walls, but otherwise the buildings were little changed, and became overhung with trees. The garden, once cared for, went back to nature.
Susan and Tom Pitman purchased the property in 1981, with a view to restoring it. They found walls of rough sawn boards, originally covered with hessian, which had later been covered with caneite. In places there were traces of old wallpaper, and in the passage a stencilled border made by Mrs. Osborn.
Tidying the garden and restoring the house were well advanced when the bushfire destroyed it all beyond the possibility of repair. When rebuilding, a site was chosen further from the road, and the style of construction was modern, mud brick and pine.9

The latter carried the day, and the motion lapsed. The serious plight of the apple industry was outlined to members by Mrs. Osborne (Upper Beaconsfield). The consumption of apples in Australia, she said, was half an apple a head daily. The diet of many families was faulty, and more apples on the menu would find a market for fruit that was going to waste, and help to build a healthier race.   • 3 Aug 1938: Mr. John Payne. The death occuried yesterday of Mr John Payne at his home in Athelstan road, Camberwell. He was aged 82 years Mr Payne was the founder of Payne's Bon Marche, Bourke street.
    Born at Baltimore, County Cork, Ireland, Mr Payne, at the age of 12 years, began work as a draper's assistant. In 1875 he came to Australia in the sailing ship Barthanope. He was employed in a store in Melbourne for several years. In 1878 he opened his first business in the city.
    In 1885 he moved into Bourke street and established Payne's Bon Marche The business expanded rapidly and in 1909 he bought the site of the present store and erected a four-story building. He retired more than 20 years ago after having successfully established the business. Mr. Payne donated the land and the money required for the building of St Mary's Church of England, South Camberwell. Mr. Payne was a widower. He leaves one daughter and four sons,
    A service will be conducted at his home at 2.45 p.m. on Wednesday by the Rev. R. Fenwick Brown, assisted by the Rev. Roscoe Wilson, after which the funeral will leave for the Melbourne General Cemetery. The funeral arrangements are being made by Messrs.. H. King and Son.22
  • 4 Aug 1938: Mr. John Payne. Many friends and representatives of Melbourne business interests attended the funeral of Mr. John Payne in the Church of England portion of the Melbourne General Cemetery yesterday. There were more than 600 present at the graveside, and two floral cars were needed for the many wreaths.
    Mr. Payne, who was aged 82 years, was the founder of Payne's Bon Marche, Bourke street. He died at his home in Athelstan road, Camberwell, on Tuesday.
    The services at his home and at the graveside were conducted by the Rev. R. Fenwick Brown, assisted by the Rev. Roscoe Wilson.
    Pall-bearers were Messrs. T. C. Alston, A. Campbell, T. Currie, D. Jones, Urquhart, J. Nettleton, and H. Hall.
    The chief mourners were Mr. Payne's four sons, Messrs. J. W. Payne, H. J. Payne, N. Payne, and W. H. Payne.
    Funeral arrangements vere made by Messrs. H. King and Sons.23
