  • 3 Dec 1915: In Memorian. MR. J. E. PITTOCK.
    When Jonathan Edward Pittock was called to his rest, the Methodist Church lost one of her most loyal sons, the Protestant cause one of her sturdiest champions, the widow and orphan a generous friend, and every worthy movement an earnest supporter. Bro. Pittock was a native of Hadleigh, in Suffolk, where he was born in 1848 of Baptist parentage. At an early age, he came with his parents to Victoria, and settled in Geelong. He was converted in the Pakington-st. Primitive Methodist Church, when a young man, through the instrumentality of Mark Tonkin, a local preacher. He always regarded that as the happiest, as well as the most decisive event, in his experience.
    His earnest spirit led him into the paths of usefulness. He became a local preacher, worker in Sabbath school, and secretary of various church interests ; in fact, he occupied in turn every office open to a layman and filled them all with faithfulness and efficiency. He was many times, before and after Methodist union, representative to Conference. For some years he was superintendent of the Pakington-street Primitive Methodist Sunday school, then he filled similar office in the Newtown school, and later on he established a Sabbath school in connection with the Protestant Orphanage and acted as superintendent till his last illness rendered attendance impossible. He was a committeeman and ex-president of the Orphanage, and the fatherly interest he took in the children was reflected in their affection for him and the pathetic sight of orphans weeping at the graveside when he was laid to rest. He was a trustee and member of the Newtown Society at the time of his death, a generous and systematic contributor to the church funds, in warm sympathy with the work of the ministerial and pastoral office, and all that advanced the spiritual as well as the material interests of the church. The family altar was a recognised institution in his home, and his domestic life was particularly hanpy and blessed. He was a prominent worker in the Sons of Temperance and Loyal Orange Lodges. His funeral was very largely attended, Methodists and other ministers, representatives of public bodies in Geelong, Bros.. R. T. Vale, O. R. Snowball, M.L.A., J. A. Baker, A. T. Ramsay and other representatives of the L.O.L. of Victoria. H. Francis and other leaders in the Sons of Temperance; and a numerous body of citizens, thus showing their respect for the character and labours of a godly man.
    A largely attended 'In Memoriam' service was held in the Newtown Methodist Church on Sunday, evening, October 17th, when the Rev. H. S. Heath preached an appropriate sermon on Isa. xxxii. 2 : "And a man shall be as an hiding place from the wind and a covert from the tempest, as rivers of water in a dry place, as the shadow of a great rock in a weary land."
    Many testimonies to our late brother's worth and usefulness have been received by the family from public men throughout Victoria, and from old scholars who remember with gratitude the benefits received while under his influence. "The memory of the just is blessed." H.14

    NOTICE is here by given, that under and by virtue of certain process issued out of the Supreme Court of the State of Victoria and directed to the Sheriff, requiring him to levy certain moneys of the real and personal estate of JAMES DUNCAN of 68 Hawksburn-road Hawksburn medical practitioner, and Ivan Vallance Robertson of 1 Enfield road, North Brighton, journalist, the said Sheriff will, on Tuesday the first day of February, 1927, at the hour of eleven o'clock in the forenoon CAUSE to be SOLD at the police station Greville street, Prahran (unless the said process shall have been previously satisfied or the said Sheriff he otherwise stayed)
    All the right, title estate, and interest of any of the said James Duncan, in and to house property in Hawksburn-road Hawksburn being lot 82 on plan of subdivision No 957, lodged in the Office of Titles and being part of Crown Portion 33 parish of Prahran county of Bourke, and being the whole of the land now comprised in certificate of title volume 5010 folio 1,001,937.

  • 4 Jun 1927: Doctor and Nurse Charged
    Melbourne, Saturday.—Dr. James Duncan and Nurse Eva Manning were yesterday on a charge of having illegally used an instrument on a woman. Evidence was given that after the operation had been performed the woman was taken to hospital, where a child was born the same day. The child is still living.15
  • 6 Jun 1927: USED INSTRUMENT. WOMAN'S ALLEGATION AGAINST DOCTOR AND NURSE.
    MELBOURNE , Saturday.
    Dr. James Duncan and Nurse Eva Manning were charged at the Prahran Court yesterday with having used an instrument on a woman with intent. The principal witness said she was now married. On April 27 she went to Duncan's surgery at Toorak and asked him if he could "fix her up." She gave him £20. He told her to go to Tinterne-avenue, Toorak, She went to the address given and saw Mrs. Leslie, the woman before the Court as Eva Manning. Duncan and Manning came into the bedroom and Duncan used an instrument on her. Later Manning told her to get dressed. There was a taxi cab outside in which she was going to a private hospital. At the hospital witness was examined by Dr. Bretherton. Later the same day she gave birth to a male child which was still living.16
  • 28 Oct 1927: ALLEGED MALPRACTICE. Doctor Arrested.
    MELBOURNE, Thursday-Two girls were removed to hospital to-day by the police, and later charges of malpractice were laid against Dr. James Duncan, aged 69 years, of Hawksburn Road, and Eva Manning, aged 45 years, of Cromwell Road, Hawkesburn.
    They were remanded until November bail being fixed at £300 each.17
  • 14 Dec 1927: THREE YEARS' GAOL. Guilty of Malpractice.
    MELBOURNE, Tuesday. - Two charges of malpractice were preferred against Dr. James Duncan, of Hawksburn road, Hawksburn, and Eva Manning, nurse, of Cromwell road, Hawksbum, before Judge Winneke in the Court of General Sessions to-day.
    The jury found each of the accused guilty on one charge, with a recommendation to mercy.
    Judge Winneke said that Duncan had disgraced his profession, and it appeared that he had been the prime mover in the matter. He would sentence each to three years' imprisonment.18
  • 15 May 1928: MEDICAL MAN'S LOSSES. Mining and Other Speculations. Dr. James Duncan Examined.
    An examination was held before Judge Moule in the Insolvency Court yesterday in the insolvent estate of Dr. James Duncan, formerly of Hawksburn-road, Hawksburn, but who is at present serving a sentence of three years in the Geelong gaol. The estate was sequestrated on 9th January last. The assets were shown in insolvent's schedule as £10,397, consisting of real property £3480, personal property lield as security £1450, personal property not held as security £8295, and book debts £3171. The liabilities were stated to be £6257. Mr Coppel (instructed by Messrs. Robertson and Ramsay) appeared for the trustee (Mr. P. J. Kent), and Mr. Duncan (Messrs. Wisewould and Duncan) for Mr. T. Robertson, whose name was mentioned in connection with an underwriting agreement.
    Mr. Kent in his report to the court said he could not say what the assets would realise. Insolvent had told him that he had kept cheque and pass books, and he professed to have given the trustee all the necessary iniormation and assistance in his power. Insolvent had set down the causes of his insolvency as losses in business, speculations, adverse investments, unsuccessful legal actions, inability to readjust finances, and pressure of creditors.
    Dr. Duncan was 70 years of age, a medical practitioner, and said he became liable to pay his debts in December, 1927. He had lived at Hawksburn seven or eight years. When he went there he was in a fairly good financial position, and it was only during the last five years that he went in for speculation, which led to his insolvency. His first loss was in the Jenrolet Pty. In this he lost £1030 of capital and £800 legal expenses. He lost £1500 in the Lake Bunga oil syndicate; Household Necessities Pty. Ltd., £200 or £300; Paint Spray Pty. Ltd., £200; Emu Motor Cycle Co., £150; Sydney-road Freeholds, £200 or £300, and in addition, insolvent thought, he incurred liabilities of £1500 to £2000. The Dromana Green Granite Pty. cost insolvent £3000. The Brighton Granite Works cost insolvent £150 to £180. The first mortgage on insolvent's house at Hawksburn was the balance of the purchase money; the second mortgage was to pay costs in a civil action, and the third was to pay the costs of a criminal case. Dr. Duncan lent Progress Press Pty. Ltd. a sum of money, but he paid for no shares in it, although he held 15,000. In the Delite Cake Co. he lost £1500. He formerly held one-half share in the concern before it was floated into a company, and he then lost a further £800.
    Insolvent said Nurse Manning had lent him sums of money at different periods. In October, 1924. she lent him £200, and in 1925 she lent him two sums of £250 and £400, and in 1926 he got £100 from her. He could not remember the dates when these sums were borrowed. He had not repaid any of those sums. The moneys were paid to him in cash. Some of the money was paid to his solicitors. It did not go through his bank. He paid his solicitors £850 altogether. The payments were made on account of costs. Nurse Manning had never asked him to repay any of the amounts lent.
    His Honor: Was any interest to be charged on these amounts?
    Insolvent: Yes, 7 per cent. I suggested the interest at 7 per cent. No interest has been paid. I cannot say why Nurse Manning is not claiming interest in her proof of debt.
    Continuing, insolvent said he had never given Nurse Maiming any money to mind for him. She drew the money she lent him from the State and Commonwealth savings banks. He could not say why she was claiming less than he amount he had borrowed from her. He had been ill, and his memory was not now as clear as it was. He had not made any note of the amounts he borrowed from Manning.
    His Honor: Why did you not pay her back in 1925 the money you borrowed in 1924?
    Insolvent: I do not know.
    You say that you became unable to pay your debts in 1927; why then before that did you not pay her some of the borrowed money ?— She never asked for the money.
    In further answer to Mr. Coppel insolvent said that Manning lent him the sums in the amounts stated, and not in the sums of £5 and £10 at a time. The £850 he paid his solicitors was for costs over a period of three years. The first £200 borrowed from Manning was for a pressing need, but he could not now remember what that need was. In regard to Sydney-road Freeholds Ltd. the company was promoted and registered; but very few shares were sold. The 40,000 shares in it were underwritten. The persons concerned in that were Litchfield, Robertson, Jenkins and himself. Litchfield and Robertson agreed to underwrite the 40,000 shares. A few shares were sold to persons other than the promoters. The land had been purchased in Sydney-road for the purpose of erecting on it a Palais de Danse. The object of the company was to take over certain benefits of an agreement made be tween witness and Litchfield and Robertson. Litchfield had incurred expenses in connection with the company. He did not owe Litchfield £563 and Robertson £933. He could not say why they were not included as creditors in his schedule. He owed Litchfield about £50, and Robertson about £300 or £400. The company had not been wound up, but the land had been taken over by the original owners. He agreed, with other members of the syndicate to pay one-quarter of the amount lost by the underwriting syndicate. Nothing had been done to have that account taken. Jenkins went away when things looked troublesome. He thought there was some arrangment, and Litchfield took over Jenkins's share. He did not know where Jenkins was at present. Jenkins was in partnership with Litchfield as an accountant.
    Mrs Eva Manning, nurse, said she had lent insolvent sums of money extending over four years. The first amount of £200 was lent when he was in trouble, after the death of his wife. He did not say what he required the money for. She lent him other sums amounting to £1000. The money was lent as a friend, and the matter of interest was left to the insolvent. Mr. Coppel said that Mr. Litchfield, and Mr. Robertson had agreed to withdraw their proofs of debt for £566 and £933.
    His Honor said the withdrawals of these proofs seemed to be wise. Had they been persisted in they would have opened up a wide field.
    Insolvent, recalled, said he had been interested in the Golden Valley Mining Syndicate, which had leases in New South Wales. After some progress was made the works were closed down. The granite quarries at Dromana contained good green granite, and he thought, that it was worth more than £175, the value placed upon it. He put about £2000 into the development of the quarry, but all he had got out of it was between £400 and £500. The quarry was formed into a company, but the company had gone into liquidation since his insolvency.
    The examination will be continued today.19

    CARDINIA PARK HOTEL. Inspector O'Brien appeared for the Board; owner, Mary Dinely ; Selina Lanigan Oscar licensee. Mr Brayshay for the licensee.
    John Payne, retired draper, deposed that he knew the district and at one time owned the freehold of the hotel and 500 acres; sold the hotel with two acres of land about two years ago, and since then another 22 acres; there had been wonderful improvements in the district, and there was considerable increase in business; had sold about 300 acres in small blocks, up to £40 per acre; the hotel was well conducted and the meals were excellent.
    Alfred Hutchinson, manager surgical department, Bourke street, deposed that he visited the hotel every week end; it was a large week end resort, and from 14 to 16 people were accommodated at week ends; 3 years ago he stayed at the Pine Grove, but he preferred the Cardinia Park Hotel ; the hotel was in front of the Cardinia Park; there was good shooting and fishing.
    Robert Shaw, cabdriver, deposed that he traded between Beaconsfield and Upper Beaconsfield, and he drove the mail coach which passed the door ; he had been driving the coach for ten years and frequently took passengers to the Cardinia Hotel—sometimes a dozen at week ends and during the summer; the trade of the hotel was increasing, as the Cardinia Park was opposite, and at Christmas he drove a number of people to the Park, where they were camped for a week or more.
    Selina Langan Oscar, licensee of the Cardinia Park Hotel, deposed that she purchased the ingoing for £150, and the lease expired in 1918; there were 28 acres with the hotel, and she paid £2 per week rent; gas was laid on with hot and cold water ; since Xmas the income had increased 100 per cent; there had been considerable increase in bar trade; the whole house had been renovated at a cost of £1500; from six to 10 people stayed for week ends, and from 50 to 60 meals a week were served ; a bore had been put down for water, and there was a trough in front of the hotel ; campers in the public park patronised the hotel ; there was fishing in the Cardinia creek; there was a telephone service to the hotel; had no previons experience in hotel-keeping.

  • 6 Nov 1925: Florence Evelyn Loft, 35 years, of Greville-street, Prahran, sought divorce from Eric Arthur Loft, 34 years, of Oak-grove, East Malvern, on the ground of desertion. Petitioner said that her husband's conduct became so bad in 1920 that she was forced to leave him. She obtained a maintenance order against respondent. In March, 1922, she met her husband by appointment, and cohabitation took place on one occasion on her husband promising to make a home for her. A little while later respondent said married life was like a mill stone round a man's neck. He wanted to go and come as he pleased, and would not make a home for her.   • 28 May 1936: THEFT OF ELECTRICITY. Fine of £ 25 imposed.
    Pleading guilty to a charge of having between September 1, 1930 and October 27, 1935 fraudulently used electricity, Eric Arthur Loft, racehorse trainer of the Cardinia Park Hotel, Beaconsfield, was fined £25, in default imprisonment for three months, with £5 3/ costs, by Mr R E Stapleton PM at the Malvern Court yesterday.
    Mr Breen solicitor for the Electricity Commission described it as one of the worst cases that had yet been detected. Loft, he said, had held an A grade electrician's licence. When Loft vacated premises at Oak grove, Malvern, in October of last year, officers of the commission who went to reconnect the electricity supply for the new tenants found that lights were already burning in the house. A search was conducted and an elaborate system of "bridging out" by which the main had been tapped without the current passing through the meter was discovered. When interviewed Loft denied all knowledge of the wiring, but said, "All the commission is concerned about is the amount of which it has been robbed. Tell me what that is and I will pay it."
    Joseph Henry Foster a superintendent employed by the commission said that radiators, an electric cooker and other appliances had been freely used in the house. It was estimated that over the period of five years named in the charge the commission had been defrauded of approximately £300.15
  • 25 Aug 1939: UGLY MAN CONTEST. To raise funds to erect a community hospital at Dandenong hotelkeepers in the surrounding districts are conducting an ugly man competition.
    Last night a hospital ball was held at Berwick by two of the contestants Messrs Dick Ellis of the Hotel Central and Eric Loft of Cardinia Park Hotel.
    The setting was the Kings Hall and the organisers were assisted by Mrs C Loft and Miss Thelma Thomas as ticket secretaries and Miss Lesley Ellis as general secretary.16
  • 24 Apr 1940: Highway Signs Ban. Cr. McBride Denies Inconsistency
    IN emphatically refusing to grant Mr E. Loft, of Beaconsfield, permission to erect a hoarding on or adjacent to the Princes Highway, the C.R.B. took the opportunity to define its attitude on the whole question of these roadside hoardings. It is definitely hostile to them, and pointed out that there existed a by-law which gave it power to regulate, restrict, prevent or control the exhibition of such advertisements on or in the vicinity of all State Highways.
    Defending himself against any suggestion of inconsistency on the subject, Cr McBride explained his attitude in regard to a previous application from another publican. The licencee of the Pine Grove Hotel, Upper Beaconsfield, had sought permission to erect an 8ft x 4ft sign on a main road not on the Highway. He had told him that there was "nothing doing,” but that they were prepared to allow him to erect a signboard about 3ft x 6ins.
