Did John Curran lease land at Mt Misery, Victoria circa 1847? Did he become a Licensed Victualler (info Winifred's Marr Cert), if so, where did he have a hotel? When and where did John and wife Catherine die?
Are there descendants out there who can help and who know anything else about this Curran Family.1
Note See Annie's story on Howie's Creek (La Trobe Inn.)2
Name Variation John Curran was also known as John Currin.
Note* I believe that the John 'Currin' of Mount Misery is this James Curran, who died in 1850. His association with Terrence O'Connor, who had the Cardinia Creek Run would make it likely. He is also listed as an owner of the La Trobe Inn at Pakenham.

  • 6 May 1850: SUPREME COURT. MAY 3RD. Before his Honor the resident Judge. M'Honey v. Curran.—Action of Assumpsit.—Plaintiff agreed to sell defendant the La Trobe Inn, on the Gipp's Land Road for £120, to be paid for in cash £30, and three bills of £30 each. It was alleged that defendant had agreed to pay £30 for the good will, and £30 for the license of the ensuing year.
Defendant pleaded that the £30 in dispute had been paid.
Plaintiff replied, that the sum paid by defendant was not the £30 sought to be recovered.
The issue seemed to rest, as to whether there were separate contracts for the license, and for the good will.
Mr Terence O'Connor.—Proved that he he was presentat the time of sale, the terms were £120 to be paid by M'Honey, £30, cash, and three bills of £30 each, which were given or paid by him from funds of Curran in witnesses' keeping. The application for license was was made in June last, Curran not being present, the license was granted to M'Honey. Witness had paid him £30 on acconut of Curran who had taken possession of the premises, and in September following had obtained a transfer. Witness was not aware of any other £30 to be paid under the agreement.
Defendant was called, but was not in attendance.
Mr. Barry submitted, that there was no evidence, and claimed a nonsuit.
Mr. Stawell pressed his Honor to send the case to the jury. His Honor complied reserving leave for Mr. Barry to apply for a non-suit.
Verdict for the plaintiff. Damages £30. , Terence O'Connor15
  • 15 May 1850: THE DISTRICT LICENSING BENCH was then formed, James Simpson, Esq., officiating as Chairman, assisted by Messrs M'Lachlan, Jacomb, Smith, Firebrace Hutton, Payne, Sturt and Dana. Mr Dunbar, solicitor, applied to the Bench to review their decision in the case of a party named Curran holding a license for a house on the Gipps Land line of road, a renewal of which had been refused at the annual licensing meeting on the ground that the house was in a dirty state. The Bench declined to entertain the application.16
  • 3 Jun 1850: Death from Intemperance. — On Friday, an inquest was held before W. B. Wilmot, Esq., J.P., coroner for the district, upon the body of an unfortunate man, named John Curran, whose death took place under circumstances developed in the following evidence, which was adduced.
Terrence O'Connor, settler, in the Western port district, deposed. I reside about seven miles from the deceased, and have known him about nine years. Deceased has of late been much addicted to drinking , and I have noticed that his health has been breaking up.
On Sunday last I went to his house and finding him in a very weak state I remained at his house until his death, which took place on Wednesday morning last. On Wednesday morning I heard the deceased calling his wife to give him a drink, and went into his room, where I saw him lying on his bed, and gave him what he required, About half an hour from this time he expired, Whilst in my service which was for about seven years, he was a sound healthy man, but was more or less given to drinking beyond the bounds of temperance. I sent immediately after his death to acquaint the Coroner of the fact, Catherine Curran, the widow of the deaceased who was formerly a publican, residing at Western-port deposed. Deceased was my husband, and of late has been much addicted to drinking. On Tuesday night last he seemed very weak and had refused to eat anything for some days, indeed when he gave way to drink he seldom did eat anything. On Wednesday morning, early, deceased called to me and asked me for something to drink and complained of feeling very cold, I gave him some hot brandy and water but he seemed very weak and died in about half an hour afterwards.
The jury returned a verdict to the effect that the deceased's death, was accelerated by intemperance. , Catherine Elizabeth Curran Terence O'Connor17
  • 4 Jun 1850: Inquest. — On Friday last, an Inquest was held at the Farmers' Hotel, on view of the body of a person named Curran, formerly a publican at Western Port. It appeared from the evidence of a man named O'Connor, that Mr. Curran had been addicted to drink for a considerable period, and had had been in a very weak and debilitated state for some time prior to his decease. The evidence of his wife, Mrs. Catherine Curran, went to shew — that on Wednesday the 29th May, he found himself unusually weak aad indisposed, and requested some hot brandy and water to be given him, which was done, and in an hour after he expired. Verdict—" Died by the visitation af God." , Terence O'Connor Catherine Elizabeth Curran18
  • 5 Jun 1850: The late Mr. Curran. — Circumstances have become current since the death of Mr. Curran, upon whose body an inquest was held a few days since, to the effect that death was accelerated by violence. The matter requires further investigation.19

Thomas Philip Power

M, #24054, b. 1856, d. 1934
Birth*1856 Hawthorn, VIC, Australia.
Death*1934 St Kilda, VIC, Australia, #D345/1934 (Age 78) (par David POWER & Ann PILE) - as Thomas Philip POWER.1

Newspaper-Articles

  • 10 Jan 1934: The death occurred yesterday of Mr. Thomas Philip Power, of Willyama, Beaconsfield parade, St. Kilda. Mr. Power, who was aged 78 years, was born at Hawthorn, and he went to England with his parents when he was aged 6 years. His father was the late Mr. David Power, of Mount Gambier Station. After some years in England Mr. Power returned to Australia, and assisted his father at Bushy Park Station, Gippsland, before looking for a property for himself. His search led him to New Zealand, back to Melbourne, and then through much of the inland country of Victoria, South Australia, and western New South Wales.
Eventually he settled at Coolullah Station, Cloncurry (Q.), where he remained until he retired in 1914. Since then he had lived in Melbourne.
Mr. Power married Miss Violet Evelyn Moore, daughter of the late Mr. W. Trives Moore, of Royal Park. He leaves a widow, a son, and a daughter. The funeral will leave Beaconsfield parade for the St. Kilda Cemetery at 3.30 p.m. to-day.2
  • 11 Jan 1934: THE LATE T. P. POWER to THE EDITOR OF THE ARGUS
Sir,—The death of Mr. Thomas Philip Power severs a link with the first pioneer of Hawthorn. John Gardiner is generally associated with the Prahran and Gardiner district but Mr. T. H. Power settled on the Yarra close to the centre of old Hawthorn. Elgar's survey, which comprised most of Boroondara, consisting of 5000 acres taken up by Elgar, a West India merchant at £1 an acre was sold in 1853 to Mr. T. P. Power and two others for 15 guineas an acre. The Power family had then been settled for several years in its Hawthorn home, Clan-Yr-Avon which is still standing. There the late Mr. T. P. Power was born.—Yours, &c.,
    H. W. L. SCHUCHARD. Thomas Herbert Power3
  • 12 Jan 1934: THE LATE T. P. POWER TO THE EDITOR OF THE ARGUS
I Sir,-Surely Mr. Schuchard does not claim that Mr. T. H. Power was the first pioneer of Hawthorn. Mr. Power did not arrive in Port Phillip until well on in 1838. On July 1 he announced his intention to open an auctioneering and general agency business, and on September 16 he did open an auction-room adjoining Dr. Barry Cotter's shop in Queen street. John Gardiner established his home in Hawthorn on the present site of the Scotch College in December, 1838, and he was the first resident of Hawthorn. His home was for some years the centre of the intellectual society of Melbourne. There were several other residents in Hawthorn before Power.
Elgar's survey was not made until 1841, and It did not include any portion of the present city of Hawthorn. Mr. Power's early purchases from the Crown were 1,145 acres on the Merri Creek in August, 1840, at 13/6 an acre, and in the following month two sections, or 1,280 acres at Kalkallo (Donnybrook) at 12/. He is recorded as residing on the Merri Creek, near the Yarra, in 1842.—Yours, &c., A. S. KENYON. Historical Society of Victoria. Jan. 11. Thomas Herbert Power4
  • 13 Jan 1934: THE LATE T. P. POWER. TO THE EDITOR OF THE ARGUS
Sir,-I am well aware of the facts of Mr. Power's life as Mr. Kenyon states them. Gardiner's claim to be the pioneer of the whole district east of the Yarra is incontrovertible. My contention is that Power was the pioneer of Hawthorn proper in the sense of association with its development as a municipality. His first purchase of Crown land in the district was of block No. 17 of the Crown allotment on section 6, purchased on March 11, 1846, and his residence, Craig-Yr-Avon, was built on that block. Sir James Palmer purchased blocks 19, 20, and 21 on the other-or westerly-side of Yarra street from Power, and built Burwood about the same time. As Mr. Kenyon records in his valuable record of early settlement, "The Pioneer Pastoralists of Port Phillip," Power also acquired Mount Misery Station, near Berwick, in 1841, and Smith and Corrigan in their "History of Hawthorn" say that he used to boil down the cattle from that property at his Hawthorn home, where remains of the plant still survive. Mr. Power took a leading part in the establishment and administration of the municipality-two years later the borough of Hawthorn. Elgar's survey lay east of Burke road between the Yarra on the north and Canterbury road (then Delaneys road) on the south. My mention of it was to point to the extent of his property in the immediate district. I know of no record of any houses built on the Crown lands comprising the present City of Hawthorn before Power's. Residents of the district holding land under the £10 squatting lease of the year before subdivision there undoubtedly were—Hodgson a little farther up the river was one—but they could hardly count in my sense of the term, as pioneers of Hawthorn proper.
    -Yours, &c. H. W. L. SCHUCHARD.

  • 28 May 1864: Mr COHEN then proposed another £350 as a gratuity to Mrs Graham, the widow of Mr Philpot Graham, who had been nine years in the department, and had left his widow and family destitute.
This motion was lost by a majority of 20 to 19.
Mr COHEN then endeavored to obtain a smaller sum — £300. During the course of the discussion, Mr LEVEY called the vote on the previous evening of £150 to Captain Scott 'a job.' Mr VERDON resented this term, and called the hon. member to order. The term was withdrawn with some remark about the cap fitting, and an intimation that he (Mr Levey) was not aware of the deep interest the Treasurer took in Captain Scott.
Mr ORR thought the Government were anything but eager to grant boons to their supporters.
After the discussion had continued a while longer a division was taken, and the motion was carried by 20 to 19.12

John Curran, Terence O'Connor4
Verdict—" Died by the visitation af God." John Curran, Terence O'Connor5

BOURKE.—On the 26th of May, at her residence, Sutton Grange, Catherine, dearly beloved wife of Mr. James Bourke, formerly of Castle Connell, Limerick, Ireland, in the 64th year of her age.
Fortified by the rights of Holy Church. Rest in
    peace.
We saw her fading day by day.
    We saw her pass away,
We nursed her with the tenderest care,
Bat could not make her stay.
A form is from our household gone—
A voice we loved so well—
Her chair is vacant by our hearth.

Sir, I have the honor to inform you that I have visited the Mount Misery Station near the Township of Berwick in the Western Port District.
The improvements consist of a new slab house, horse paddock and cultivation paddock and a mile and a half of sapling fence which improvements I value at £150.
The ground has an appearance of being auriferous and no access would be impaired by allowing Mr Lord's 320 acres which is only value for one pound per acre.
