  • 11 Dec 1931: REMOVING TIMBER FROM ESTATE. At Heidelberg court yesterday John Alexander McLennan, farm employe, of Plenty-road, Heidelberg, was charged with having cut down firewood with the intention of stealing it.
    James Dudley Seymour, land owner, of Martin-street, Heidelberg, stated he was part owner and trustee of an extensive properly known as the Cleveland Estate, three miles from Heidelberg. On visiting the estate on 20th August he found that some trees bad been cut down and the timber pushed through a fence and stacked on the roadside ready for removal. Defendant had received no authority to remove the timber.
    Defendant was fined £1, in default seven days' imprisonment.11

Mr Garrett Flood Nagle succeeds Dr Tierney for the district of North Melbourne.4
  • 12 Jun 1863: A lady holding the office of Registrar for the city of Melbourne would to strangers be as much a curiosity as the hirsute female of M. Sohier's establishment. To the initiated, however, the phenomenon has a ready explanation : The Ministry have appointed all the available Irishmen, to Government situations, and they have now commenced the list of Irishwomen. We have heard of a self-acting church organ that through the awkwardness of the manipulator played the Morning Hymn over twelve times to an impatient congregation and a long-suffering parson, who with the last cadence sprang up to proceed with the services of the day, but the perverse instrument with equal alacrity started off with the 'Old Hundredth,' and to the dismay of the parishioners it was discovered that until the role of twenty-four tunes, twelve times repeated, had been exhausted, there would be no cessation of the automatic psalmody. The public has endured the repetition of Irish appointments with exemplary patience, it was hoped that, at some period; or other, every individual of correct nationality and opinions would be provided for, and that then there might be a chance for a down-trodden Englishman, or suffering Scot ; but lo ! the Ministry have begun a new tune. There being no more Irishmen to provide for at present, they have passed on to Irishwomen, until the dearth shall have become known in that blissful region where the species is indigenous, and from whence a fresh male migration may be shortly expected. Although aware of the prodigality with which appointments have been made, we did not imagine that the list of Irish applicants was so near exhaustion. The Ministry ought to have husbanded their resources better, or secured a timely, importation. Had they not happily thought of Irishwomen, there is some probability that they would have been driven to a selection from Englishmen, immensely to the detriment of the public service.
    The appointment of Mrs Ellen Tierney to the Registrarship of the most populous division of the city, is certainly the most scandalous abuse of the patronage on which the Chief Secretary has yet ventured. We are ready to admit that the lady may have claims on the consideration of Mr O'Shanassy, but she has none on the public. It is very sad that she should be left unprovided for, but her destitution it no reason why she should have the reversion of her late husband's situation, and a salary of £350 per annum. If Mrs Tierney is entitled through her poverty to succeed her husband, the poor widows of other deceased public officers are equally entitled. If she may perform the functions of her office by proxy, and enjoy a considerable income after paying a subordinate, other bereaved ladies may claim a similar right of dower. It would be rude to doubt Mrs Tierney's capacity to perform the duties of Registrar, but we may be allowed to question the propriety of paying so large a salary for work that a female can accomplish. If Mrs Tierney is competent to be Registrar, it is plain that a junior, clerk, at a salary of £150, would do equally well, and £200 per annum would be saved to the public. Neither is there any necessity for Mrs Tierney's colleague, Mr Nagle. A lady being able to record the births and deaths, and celebrate some of the marriages in South Melbourne, it is clear that a gentleman of ordinary business abilities would be capable of taking charge of both divisions, as Dr Tierney did, and a salary of £350 would be ample remuneration. It is under stood that that gentleman's income varied from £650 to £900 during the four or five years he held his appointment, and it was not unreasonable to expect from him some provision for his family, more particularly as he persistently alleged himself to be in possession of a sufficient qualification for a seat in the Upper House, and made himself appear to be the ostensible owner of considerable landed property. Whatever may be the claims of Mrs. Tierney on public consideration, they ought to have been preferred to the Parliament, or if it be true that the Chief Secretary promised Dr Tierney on his death bed to provide for his widow, she ought to have had some occupation adapted to her sex. Whatever may be the lady's abilities, it is impossible that she can perform her duties to the satisfaction of the public. An accurate registration of births and deaths is of the utmost importance, and mistake or omission may involve serious consequences hereafter. But apart from this aspect of the case, the appointment is a gross abuse of the patronage. No other female but Mrs Tierney would have been considered even an eligible applicant, and she has obtained the post over the heads of a score or two of others, simply because she was the wife of Dr Tierney, the friend of the Chief Secretary. Her poverty is her qualification, and her personal intimacy with the family of Mr O'Shanassy the secret of her preferment. We are assured that several gentlemen of great respectability, and unquestionable competency, applied for the vacant office, but they were contemptuously set aside. No one can refuse sympathy to Mrs Tierney, and no one would grudge her an appointment in which she might earn a respectable livelihood, regretting at the same time the hard necessity forced upon her. But it is monstrous that any female should be created Registrar of the city, with an income of £350 per annum. There is only one excuse for so flagrant a breach of public trust, namely, that there is no eligible Irishman remaining unprovided for. Mr Nagle's qualifications are undoubted. Being the brother-in-law of Mr D. S. O'Connor, and he being the protégé of Mr Hugh Glass and the leader of the Loddon land raid, he had unquestionable claims on the Government. Besides, he had had some connection with the Catholic newspaper, which alone is a sufficient recommendation. The appointment of Registrars for the city of Melbourne will, however, we trust, be almost, if not quite, the last exercise of patronage by Mr O'Shanassy.5
  • 25 Jul 1867: Women's rights are certainly recognised in Victoria as much as in any part of the world, and we have now several lady officials. Mrs Ellen Tierney, as registrar for a populous division of Melbourne, has chronicled the entrances and exits for some years, and Friday's Government Gazette announces the appointment under the hand of Mr M'Culloch of Mrs Knell to a deputy-registrarship at Queenstown, Caledonia Diggings, formerly held by her deceased husband. The O'Shanassy administration were, it will be remembered, subjected to much animadversion on the appointment of Dr Tierney's widow, but the present Ministry appear to have seen fit to "go and do likewise."6
  • 19 Aug 1882: In the " London Town Talk" of The Argus of this day week, it is mentioned that the appointment of a lady to the office of registrar of births and deaths, at Leicester, has been causing great stir as being the "first step to the removal of female political disabilities."
    It is one of the curious repetitions of history that the identical words might be used regarding an appointment formerly made in Melbourne. Sir John (then Mr.) O'Shanassy nominated Mrs.Tierney (now Mrs. Prendergast) to the office of registrar of births and deaths at Melbourne. It was the first appointment of a woman to a Government situation, it caused great stir, it was the first plunge which led to the subsequent employment of women in many administrative departments in Victoria; and, for the encouragement of our friends at home, I believe I am right in saying that the lady registrar has performed her duties at all times admirably.7
