  • 20 Sep 1899: POLICE NEWS. BERWICK POLICE COURT. WEDNESDAY, SEPT. 13. Before Messrs. J. Wilson, W. Fuller, and A. S. Robertson, J's.P.
    Martin Olsen, a foreigner, was charged with having broken into the house of George Christie on the 2nd inst., and stolen a tent and a pruning scissors, of the value of 10/. George Christie stated that he left his house at Upper Beaconsfield on the date mentioned at 7.15 a.m., securely locking the door. When he returned, between 10 and 11 the same evening, he found one of the windows broken in, and the articles mentioned missing; the tent produced was his ; he knew it by the patchwork, ropes, and string upon it ; he had had it in his possession for seven years; the scissors were on his table when he left home ; they belonged to a man named Lewis, who lent them to another person, and they were left with him until the owner called for them : he found a peculiar button on the floor of his house, which he handed to Constable Steele.
    John George Lewis, of Upper Beaconsfield, organbuilder, identified the scissors as his property; he identified them by a peculiarity in the manufacture of the blades, and valued them at 5/ or 6/.
    Henri Ernest Martin, contractor, Beaconsfield, said that the prisoner called at his place at 10.20 a.m. on the the 2nd, and asked for work : he came to witness from the eastern end of the paddock and left again by the western : at that time prisoner was carrying nothing but a walking stick ; at 4.30 on the same day he saw the prisoner carrying a bundle which looked like calico tied up loosely or a tent ; prisoner was about 100 yards away at that time; prisoner told him that he had been working at Backhouse's place. Alfred Schlipalius stated that he saw prisoner near his father's place at about 2 o'clock on the 2nd; he was then going towards Christie's place, and was not carrying a swag; he saw no one else travelling on the road.
    Terence Kirwin, laborer, saw prisoner about noon on the 2nd inst; witness offered him a couple of day's work, but it was not accepted; asked prisoner where his swag was, and be replied that he did not have one; went with prisoner to Sykes' Hotel to have a drink, and returned to cricket ground, where prisoner asked for 1/ which was given him; witness noticed particularly the coat which prisoner was wearing and the buttons upon it; they had a peculiar fastening; the button produced by Christie was very similar to those on prisoner coat ; he never saw buttons like them before.
    Constable Steele, of Berwick, said that he had examined Christie's place, and found that the kitchen window which had six panes of glass in it had had five of the number broken; one of the crossbars was also broken; it must have been broken from the outside ; the hole made was large enough to admit a man; saw the prisoner in a paddock at Gembrook where he was working, and asked him where he was on the 2nd inst, and he replied "down the road at Beaconsfeld;" searched prisoner's camp and found the tent produced by Christie; asked where he got the tent, prisoner said he bought it from a Frenchman but he had no receipt; he then arrested prisoner ; on the way to the watchhouse, whilst crossing Stony Creek bridge, prisoner said that that was the place where he bought the tent from the Frenchman; on the 5th inst. Christie gave him a button; he compared it with those on prisoner's coat, and found that it was identical with them; there were three buttons missing from prisoner's coat.
    John Tyler also gave evidence that he saw the prisoner at Beaconsfield between 3 and 4 o'clock on the date mentioned, carrying a bundle which looked like a tent; prisoner dropped the bundle and came on and had a conversation with him about work.
    Prisoner was committed for trial.

  • 7 Dec 1923: MARRIAGES. Mr. H. A. Schlipalius to Miss L. L. Warren. On Wednesday evening, October 24, the marriage of Mr. Harold Arthur Schlipalius, to Miss Leila Violet Warren, youngest daughter of Mr. and Mrs. Warren, Barkly Avenue, Malvern, was celebrated at the Congregational Church, Malvern. The bride, who was given away by her uncle, wore a becoming gown of charmeuse and georgette, trimmed with seed pearls, ornament of pearls at side of draped skirt, also a wreath and veil, with a court train. Miss Schlipalius (the bridegroom's sister) and Miss Carrie Dennett were bridesmaids. Miss Schlipalius wore a smart frock of powder-blue crepe de chine, with georgette sleeves, trimmed with gold tissue, and Miss Bennett wore mauve silk trimmed with silver tissue. They both carried bouquets of carnations and fern, Little Miss Hopkins was train-bearer in pink crepe de chine, trimmed with frills. Mr. A. McMicken was best man, and Mr. H. Warren (brother of the bride) groomsman. During the signing of the register, Miss Min Mclvor sang "Because."
    The reception was held at the Rechabite Hall, Prahran. The bride's present to the bridegroom was a gold watch. The bridegroom's present to the bride, a gold expansion wristlet watch and string of pearls, bridesmaids, strings of pearls; train-bearer, silver filled gold bangle. Stevenson and Sons had been detained by the Customs authorities pending an examination. We are authorised to state that there was not the slightest vestige of truth in the rumour. It appears that it is usual for a large number of letters and packages of printed matter to be sent by the ship direct to the agents of the ship (in this case Messrs. Siddeley and Co.) for the consignees, and up to a recent period the practice has been to allow delivery to take place without any interference on the part of the Custom; authorities. A short time ago, however, instructions were given that these letters and papers were to be sent to the Custom-house, presumably for the purpose of inspection, if the suspicion was entertained that dutiable articles were concealed in any of the packets. This practice was pursued yesterday, but all the letters were delivered unopened. Messrs. Stevenson and Sons deny the state ment which appeared in a morning contemporary, that they asked the Government to allow them a day's grace to demand the goods seized by the Customs authorities. The firm allege that they protested formally at the time the goods were taken possession of, and at once gave notice of action against the Government for illegal seizure. It is consequently contended that any demand for the goods afterwards would have placed the firm in a false position.
    The Government have at length apparently made up their mind to proceed criminally against the persons concerned, in resisting the Customs authorities in the storming of the warehouse on April 8. An information was filed yesterday in the Central Criminal Court against George Stevenson, George Frederick Brind, Daniel Macnamara, Walter Macfarlane, and Adam "Wilkinson, as follows :
    In the Central Bailiwick, colony of Vic- toria, to wit, George Briscoe Kerferd, Esquire, the Attorney-General of our lady the Queen, presents that George Stevenson, George Frederick Brind, and Daniel Macnamara, at Melbourne, in the said bailiwick, on the 8th day of April, in the year A.D. 1876, unlawfully did assault Michael Frederick Gordon, the said Michael Frederick Gordon then being an officer of customs, and then being in the due execution of his duty as such officer of customs, against the form of the statute in such case made and provided ; and the said Attorney-General doth further present that this presentment is preferred under the direction of the Commissioner of Customs.
    Second Count.-And the said Attorney General doth further present that the said George Stevenson, George Frederick Brind, and Daniel Macnamara, at the place afore said, afterwards, to wit, on the day and year aforesaid, unlawfully did assault Richard Horatio Dawson, then being an officer of customs, and then being in the due execution of his duty as such officer of customs, against the form of the statute in such case made and provided; and the said Attorney General doth further present that this pre sentment is preferred under the direction of the Commissioner of Customs.
    Third Count-And the said Attorney General doth further present that the said George Stevenson, one Walter Macfarlane, and one Adam Wilkinson, at the place aforesaid, afterwards, to wit, on the day and year aforesaid, unlawfully did assault Hugh Miller Guthrie, the said Hugh Miller Guthrie then being in the due execution of his duty as such officer of customs, against the form of the statute in such cases made and provided ; and the said Attorney-General doth further present that this presentment is preferred under the direction of the Commissioner of Customs.
    Fourth Count-And the said Attorney- General doth further present that the said George Stevenson, Walter Macfarlane, and Adam Wilkinson, at the place aforesaid, afterwards, to wit, on the day and year aforesaid, unlawfully did by force and violence resist and obstruct Hugh Miller Guthrie, the said Hugh Miller Guthrie then being an officer of customs, and then being in due execution of his duty as such officer of customs, against the form of the statute in such case made and provided ; the said Attorney-General doth farther present that this presentment is preferred under the direction of the Commissioner of Customs.
    As the case against Mr. Wilkinson is included with that of the others charged, he, consequently, will not be tried separately, and it is doubtful whether the trials can take place during the present Criminal Sittings. The defendants, however, when called upon will have to appear and give bail for their appearance, otherwise a Bench warrant will be issued for their arrest. At the Police Court prosecutions against the firm for evasions of the Customs Act, Mr, O'Loghlen and Mr. M'Farland will appear on behalf of the Crown.25
  • 23 Jun 1876: The trial of Mr. George Stevenson, of the firm of L. Stevenson and Sons, and Messrs. Brind, Wilkinson, Macfarlane, and Macnamara, charged with assaulting and resisting customs officers while in the execution of their duty, was concluded at the Central Criminal Court yesterday. His Honour Mr, Justice Fellows in summing up withdrew all the law points from the jury as matters for the decision of the Supreme Court in case of a verdict of guilty. As to the facts ol the case he told the jury they had not to consider at all whether any frauds had been committed on the Customs. If Mr. Guthrie had reasonable cause for believing, and did believe, that such frauds had been going on, and that his duty as an officer of customs required him to enter and search Mr. Steven son's warehouse, he was there in the execution of his duty. As to the first assault on the customs officers, Gordon and Dawson, his Honour directed the jury that if they had even been quietly put out of the warehouse without any violence whatever, the assault was committed. He also said that though the jury did not believe that Wilkinson had struck Mr. Guthrie with the piece of wood from the door, if they believed that he pushed him, that was sufficient to convict the defendant of an assault. The jury retired at 20 minutes to 6 o'clock, and at a few minutes past 6 returned with a verdict of not guilty on all the counts of the presentment. There was a great demonstration of applause in court when the foreman (Mr. W. W. Shelley) announced the verdict, and the defendants were loudly cheered as they left the court. The court was densely thronged, and the cheers were deafening, and continued for nearly a minute. When the crowd got outside the precincts of the court they indulged in three hearty cheers for Mr. Stevenson and the other defendants, and three groans for the informer Trowell and the Government.26

385. To the Chairman.—I was a contractor in Melbourne, but have been resident here for the last four or five years—within 1 1/4 miles from here. I have 116 acres altogether; I cultivate nearly 20 acres, growing fruit on about 4 acres, and the rest grain and hay. I use it myself. I send the fruit to Melbourne when we can get a market ; I do not send much. The cost is not a great deal when you get it to the railway station, but the difficulty is getting it there. The road is not a bad one, but the hills are very steep and you cannot shaft the stuff well. I was in favour originally of the line coming from Beaconsfield, but I think now the Oakleigh to Gembrook line would be the best ; it is shorter, and the difficulty of construction would not be so great. My sons have placed on the market four 6-ton trucks a week, and I dare say they might do more than that now. They had the market but they could not supply, because of the difficulty of getting the stuff from here to the station. The cost of that was so great to them that they got no profit.

  • 14 Apr 1888: The mayor of Prahran, Cr John Beatty, Esq., entertained the councillors and officers of the city, together with representatives of the local press, at Thorn's George Hotel, Chapel street, on Monday at noon, Cr W. H. Goff of the Berwick shire council, and Mr John Buchan, an ex-councillor of Fitzroy, were also present by invitation. A capital dinner was provided by Host Thorn, with which all present were well pleased. After the usual loyal toast had been honoured, Cr Goff proposed "Success to the City of Prahran," remarking that few cities had progressed so satisfactorily as Prahran had, and he expressed the hope that under the new ward system even greater strides would be made. The mayor, who responded, referred to the amount of hard work the Prahran councillors were called upon to preform. He thought that if rate payers really knew the time their representatives spent in the public interests they would be more appreciated. Councillor Forbes proposed "Kindred Institutions", to which Cr Goff replied on behalf of the Shire of Berwick. After luncheon, the councillors took a run round the city for the purpose of allocating the forty new lamps which are about to be erected. William Henry Goff16
  • 25 Aug 1888: CR. BEATTY. JOHN BEATTY, ex-Mayor, was born in Enniskillen, County Fermanagh, Ireland, on 12th day of January, 1834, and arrived in Sydney with his parents on the 13th July, 1837. He was brought up to the building trade; his father being a builder and contractor in Sydney. In 1848 Mr Beatty left Sydney for Adelaide, and on the opening of the goldfields in 1852, in Victoria, he came overland from Adelaide to Bendigo, and in 1853 took up his residence in Windsor, where he has since resided. In June, 1858, he married Miss E. Armstrong, who died on July 16th, 1887, leaving 9 children and himself to mourn their loss. Cr Beatty had on several occasions been requested to stand as a candidate for the city council but refused; in August 1885, however, he contested the election, but was defeated. In 1886, he was returned as third on the poll, being only two votes behind Cr John Turner—the votes being Turner 1757, Beatty 1755. He was a warm advocate of the ward system, and at the recent election was returned to the council by 1131 votes, the highest number recorded in favor of any one candidate in any of the wards. In addition to his usefulness as a public man, Cr Beatty has always taken a great interest in religious matters, the Sunday-school movement being a particularly attractive sphere of usefulness to him, and his efforts in pro moting the future welfare of the youth of the district earn for him universal commendation. Cr Beatty has been for many years a leading figure in the management of the United Methodist Church, Windsor, by the members of which he is highly teamed. It must be gratifying to our worthy ex-mayor to find that after a residence of thirty-five years in this district his actions have been such as to earn for him the respect and esteem of all classes of the community.1
  • 4 Jan 1893: A petition was received from a number of ratepayers in Upper Beaconsfield protesting against the futher expenditure of money on St Georges road, as proposed by the council.—Cr. Goff argued that the proposed work was necessary, and should be carried out. With regard to the work asked for on the main road from Shorthouse's to Lennie's, it would not benefit Lennie, and was not as important as that on St. George's road.—The president said that the people had been misled with regard to the proposed deviation of St. George's road through the late Mrs. Lowe's (Lawes') property, as it was provided for in the loan and would have to be carried out.—Several letters from ratepayers were read, asking the council to proceed with the work, and Cr. Goff remarked that the writers of these letters represented about £20 per annum rates.—Cr. Gibb said the road was wanted, and those people who would benefit by it were fully entitled to it. The object of the opponents was to keep the traffic their way, no matter what inconvenience they caused others.—Cr. Goff : Yes, they are acting with a dog in the manger spirit. He (Cr. Goff) moved a that the engineer prepare plans and that the Beaconsfield members be empowered to accept tenders for the work that day fortnight ; also for work on road leading to Brittingham's.—Seconded by the president and carried.

  • 17 Sep 1904: DEATH OF EX-MAYOR BEATTY. A PROMINENT CITIZEN. RESIDENT FOR 49 YEARS.
    The death of ex-Mayor Beatty, which took place at his residence, 35 Union-street, Windsor, on Saturday morning last, removes from amongst us one who had played an important part in the history of Prahran. The old gentleman had been a sufferer from rheumatic troubles for some two years back, and had latterly only been able to sit at his own fireside, content to wait for "the call which meets us all." His end was peaceful, in the midst of his beloved ones. The funeral took place on Monday afternoon, at the St Kilda General Cemetery, where deceased was laid to rest beside the body of his wife, who had predeceased him some 17 years. Before the cortege left the house, a ceremony was conducted by the Rev. Joseph White, at which the re latives and close friends were in attendance. The funeral moved off at 3.30 p.m., and the three mourning coaches were filled with those nearest to the deceased and the chief mourners. At the grave services were rendered by the Revs Joseph White, John Barton, and Dr Watkin, D.D., all friends of the deceased. Amongst those who were at the grave side were Messrs. Donald Mackiunon, M.L.A; Thomas Luxton, M.L.C; Mayor Chambers, Crs. Bangs, Upton, and Nathan ; ex-Crs. Simmons, Furneaux, Ellis, and H. Young ; Mr Witt, J P., chairman of the local Bench ; Mr John Hinde, secretary of the Metropolitan Gas Co., and who was town clerk of Prahran whilst Mr Beatty was in the council ; Rev Arthur Paul, representing the Presbyterian ; Rev Dr. Watkin and Rev Joseph White, Methodists ; Rev John Barton, Congregational ; and a large number of the old identities of Prahran were present to do honour to the memory of an old friend. The floral wreaths were very beautiful, and noticeable amongst those sent were wreaths from the Prahran City Conncil and Windsor Methodist Church. There were over 50 private vehicles joined in the funeral. By the request of the family there was no pall or pall-bearers. The conduct of the mortuary arrangements were in the capable hands of Mr A. A. Sleight, of the Junction, St Kilda.
    The late Mr John Beatty was born in Enniskillen, County Fermanagh, Ireland, on January 12th, 1834, and arrived in Sydney with his parents on the 13th July, 1837, by the ship "Adam Lodge," so that he might almost have been called a colonial in every sense, since it was at the early age ot three years that he reached the antipodes. Mr Beatty was brought up to the building trade under his father, who was a builder and contractor. In 1848, the deceased removed to Adelaide, where he resided for some three or four years, but, with the opening up of the goldfields in Victoria in 1852, he joined the 'overland rush' to Bendigo. After trying his luck there for a while he took up his residence in Windsor in 1853, and had till the time of his death remained a citizen of Prahran. In June 1858, Mr Beatty was married to Miss E. Armstrong, who died on July 16th, 1887, leaving nine children and her loving spouse to mourn their loss. The late ex-mayor Beatty had always taken a deep interest in the municipal welfare of his adopted city, and was looked upon as a level headed authority on many civic matters. He had frequently been requested to allow himself to be nominated as a candidate for civic honors, but it was not till August 1885 that he decided to contest a seat in the Prahran Council. On this occasion, however, he was defeated. In 1886 he again went to the poll, and was successful in gaining a seat as third from the top. In addition to his usefulness as a public man, John Beatty took a very great interest in religious matters until failing health and age interfered with his activity. His work in connection with the Sunday School movement remains a lasting monu ment to his memory. As a leading figure in the management of the United Methodist Church, Windsor. Mr Beatty was held in high esteem. In all branches of civic administration the late citizen left his influence for the good of posterity, and it was by the work of men of his calibre that Prahran has climbed to the high position she holds as a progressive centre. Beatty avenue, opposite Toorak station, was named after the late gentleman. In 1887-8 Councillor John Beatty was chosen as Mayor of the city, and fulfilled the duties of the office with credit to himself and honor to the city. It fell to his lot to be the officiating chief magistrate when the foundation stone of the new Prahran Town-hall was to be laid. On 24th July, 1888, Mayor Beatty in the presence of a thoroughly representative gathering declared the foundation stone "well and truly laid." After four strenuous years of municipal life, Cr Beatty retired in 1890, and was succeeded by Mr J. H. Maddock as one of the represen tatives of the Windsor Ward. With the death of "dear old John Beatty," as he was to all his intimates, goes another of the grand links with the pioneers of this state. He has gone to his well-earned rest, after a toilsome long life that knew its vicissitudes, and pleasures, its cares, and joys, at the ripe age of 71 years, mourned by bis family, his friends, and the citizens. Though gone from amongst us, the late ex-mayor's memory will ever be honored by the residents of Prahran.20

Anecdote*Another early family mentioned by Mr Lang is the Beatty family who lived near the Pine Grove Hotel. To present day usage and before the universal use of engines their method of cutting firewood would seem unique. They employed a horse works similar to which chaffcutting was carried out in those days. Two horses moved around a circle, each attended to an end of a horizontal iron arm which was pivoted in the centre and rotated. This in turn transmitted power by a geared shaft which turned a pulley to a belt-driven circular saw. In this manner the sawing was done by horse power.1
