  • 6 Jun 1938: SIX MONTHS FOR DUMPING TRUCK
    At the Sale General Sessions on Thursday, before His Honor Judge Foster, Alfred Francis Bramley was charged with having at Jumbuk on 7th May unlawfully and maliciously damaged a motor truck the property of Universal Guarantee Pty. Ltd., Co. In this case the Crown alleged that the accused Bramley had a motor truck which was insured for £150. He had tried to get the truck up to a certain spot on the Jumbuk road, but being unable to do so, he had on the 7th of May got two men named Dan Fisher and Frank James to tow the truck up to the place. He then dumped the truck over an embankment and set fire to it. On the 10th of May Bramley made a claim for the insurance on the truck. The accused pleaded guilty to the charge. Mr. H. H. Montefiore, of Yarram, who appeared for accused in appealing for leniency said accused was a married man with an adopted child. Any punishment that would be inflicted upon him would cause more suffering to his wife than to himself. His Honor: It always does in such cases. Continuing, Mr. Montefiore said accused was being pressed for payment of arrears on the truck and thinking it would be a way out of the difficulty he had decided on the spur of the mo ment in order to retain his equity in the truck to dump it. There had been a lot of publicity attached to the case which should have a deterrent effect on other people. If given a chance ac cused would pay some of the instal ments due on the truck. His Honor said he felt sorry for ac cused's wife, but the law made no pro vision for the wife in such cases. On the other hand the dumping of the truck had been deliberately planned and the Crown alleged it had been carried out with the assistance of two other men. He could not find any redeeming feature in the case and accused would he sentenced to six months imprisonment.
    ALLEGED ACCOMPLICES Dan Fisher and Frank James were charged that in company with Alfred Francis Bramley they unlawfully and maliciously damaged a truck the property of Universal Guarantee Pty. Co. Ltd. Mr. E. H. E. Barber appeared for both the accused who pleaded not guilty. In outlining the case for the Crown Mr. M. Cussen said Bramley was buying the truck on the hire purchase system and at the time of the offence he owed £121 to the company. Bramley was in financial difficulties and he set fire to the truck hoping to collect the insurance. The accused men, James and Fisher were accessories before the fact. If they did not assist in dumping the truck and setting fire to it they helped Bramley to carry out the work and were equally guilty with him. They admitted to the police that they knew Bramley was going to dump the truck in order to collect the insurance. Edward Hall, Secretary of Universal Guarantee Pty. Ltd. Coy. gave evidence to the effect that his company had sold Alfred Francis Bramley, of Stoney Creek, a Chevrolet motor truck No. 35366, under hire purchase agreement. Certain instalments had been met, and when the remaining instalments were paid, Bramley would become the owner of the truck. At the present time Bramley owed £121 8 10 on the truck. He knew the truck had been insured for £150 with the Victorian Automobile Chamber of Commerce Insurance Coy. Accused had no authority to burn or destroy the truck. George H. Carman, assessor, of Caulfield, deposed: I remember the 16th May. Acting under instructions from the Victorian Automobile Chamber of Commerce Insurance Company, I went to a spot on the Jumbuk road, beyond Yinnar. When I arrived there I found a Chevrolet truck registered No. 35366, and engine No. 2346165, about 50 feet down bank, off the road. The truck was partly destroyed by fire. I examined the track of truck down through ferns and could trace the tyre tracks back from the edge of the bank across and down the road to where it had started to turn towards the bank for about 20 feet. Damage to the truck was aboutt £80. I asked Bramley if he was the driver of the truck and he said he was. I asked him if he was driving it near Church's lane on the Jumbuk road and he said he was trying to tow his Chevrolet truck up the hill with it, but as he could not manage it by himself he left it on the side of the road. I asked him if the green truck was taken there on Saturday, 7th May and he said, "Yes. I had it to tow truck up the hill." I asked him who was with him at the time and he said a man named James, of Yarram. He said James drove the Fargo truck whilst he steered the Chevrolet. First-Constable Pearce, stationed at Boolarra, deposed: On 16th May, in company with Constable Davis, Carman and Bramley, I went to a spot on Jumbuk road about six miles from Yinnar, where accused Bramley indicated to us where a truck he had been driving on the night of 7th May had caught fire and gone over the embankment saw a Chevrolet truck No. 35366 resting on a log about 40 yards a below the road. Examined the truck and found two tyres from near side wheels were missing. On off side of wheels of truck were two very old worn out tyres. The cabin and engine wiring of truck had been burnt. From my observations and position of truck I questioned the accused Bramley who at first denied that he had dumped the truck and set fire to it. After further questioning Bramley said. "All right, I will tell the truth. I did burn the truck. I tried to do it on Friday night. I went down to get the truck, and was going to burn it then, but I could not manage it on my own. On the Saturday night I got two men Dan Fisher and Frank James to help me. With their truck they towed my truck up to the Jumbuk road from where it was standing in Church's lane. When we got to the Jumbuk road I unhooked the tow chain and drove my truck up under its own power behind them to the spot where I intended to put it over the bank. Fisher and James waited at their truck while I set fire to my truck and put it over the bank." Bramley also said. "I got a piece of rag, wrapped it around a stick, dipped it in petrol, lit it and then put it on the floor under the dust board. Then put the truck in second gear, steered it over the bank and jumped out." I was present at the Morwell Police Station when accused Fisher was questioned by Detective Webb and Constable Davis. Detective Webb said to Fisher: On night of 7th May, a truck owned by Mr. Bramley was burnt on the Jumbuk road and it is alleged that you were present at the time. Fisher said. "I was in a truck in front. We missed Bramley and on going back found him stand ing on the road and the truck down over the bank." Detective Webb: "You knew Bramley was going to put the truck over and went with him to tow it up." Fisher replied. "I didn't have anything to do with it. I didn't put a hand on it." Detective Webb said, "But you knew when you went down there what Bramley was going to do? You knew he was in financial difficulties and was going to put the truck over the bank?" Fisher said. "'Yes I knew that. Bramley told us that he knew a good place up the road and he was going to dump the truck over." Detective, Webb said "When did Bramley first tell you that he was going to put the truck over?" Fisher replied. "When we were coming home from a football match at Sale he told us when we were at Church's lane near the truck. We took Bramley home to Jumbuk and afterwards the three of us returned to where the truck was. Bramley put water in the radiator of truck and set it going. James drove the Fargo and we towed Branmley's truck up to the Jumbuk road where Bramley undid the tow chain and drove the truck up the road behind us to the spot where he was going to put it over. We wait ed beside the Fargo truck until Bram ley put his truck over the bank. We then walked back and stood on the road and watched Bramley set fire to his truck. Later that day I was at Willung with Detective Webb and Mr. Carman when accused Frank James was interviewed. Detective Webb re later the story as told to us by Bramley and Fisher in the presence of Bramley and James said, "I knew that Bramley was going to dump the truck. He told me on the Friday night that he intended to do it but could not manage it. I went with him and Fisher in the Fargo truck on the Saturday night to where the truck was in Church's lane. I drove the Fargo truck and towed Bramley in the Chevrolet truck, but did not want to have any thing to do with it as I did not like the idea. In reply to Mr. Montefiore witness said he interviewed Fisher for about a quarter of an hour. He said he took no actual part in the disposal of the truck but knew what was going to happen. The police did not try to get a written statement from him as they had got one the night before which was incorrect. Detective Webb questioned James on his own. He may have said: I don't want anything to do with it. In the presence of the two accused. Bramley said they took no part. I destroyed the truck on my own. Detective Webb corroborated the evidence of Constable Pearce. He said to Fisher: If you didn't want to be in it why did you not remain at Bramley's home? He replied: I did not like to be in the house with another man's wife. He said Bramley told him he was going to dump the truck. In an interview with James at Willung he said it had been arranged to dump the truck. Fisher said if he had known there was going to be trouble he would have kept out of it. James said he knew Bramley was going to claim insurance on the truck. Dan Fisher, one of the accused, on oath, said he had only known Bram ley five or six weeks. He was prac tically a stranger to him. About four miles from Bramley's house. Bramley pulled up the truck they were riding in and said his truck was about half a mile down the road and he was going to take it home that night. He said: I'll have to go home and get some water for the radiator. They drove to Bramley's home and got the water and towed Bramley's truck up a hill. He and James then went on in their truck and after going some dis tance they waited for Bramley. As he did not come they went back to see why he was delayed and found him on the road and the truck was over the cliff Ion fire. He didn't know that Bramley was going to dump the truck. On May 16 he was questioned by Constable Pearce and he denied having had any thing to do with the truck. The next day he was further questioned by the police and he refused to make a state ment. Detective Webb said he would put him in the lock up and go and get James. He had no interest in the truck and did not know Bramley was in financial difficulties. To Mr. Cussen: I had no idea Bramley was going to dump the truck. I thought he was going to take it home. I was astonished to see the truck on fire. James asked Bramley what hap pened to the truck and he replied he did not know. Bramley wanted me to go down the bank but I wouldn't in case the petrol tank burst. Bramley said the truck burst into flames before it went over the embankment. Frank James swore that the evid ence of Fisher was true. I did not tell the police that I knew Bramley was going to dump the truck. I only knew Branmley for about six weeks. To Mr. Cussen: The evidence of the police is not true. I didn't know the truck was insured. Mr. Carman, recalled, by Mr. Cussen, said both the accused made the admissions to the police that they knew Bramley was going to dump the truck. In the course of questioning the accused the police acted properly and the accused were well treated by them. In the course of his address to the jury His honor said if the accused pulled Bramley's truck up the hill with the knowledge that he was going to dump it they were as guilty as Bramley. The police and Carman swore that they made admissions which implicated them. For the defence it was stated that Bramley was a comparative stranger to them and it was hardly likely that they would help him for friendship. The second point raised was that they got a tin of water from Bramley's home which induced them to infer he was going to drive car home. On the one hand they had the evidence of two police officers and that of an independent wit ness and on the other hand the evidence of two interested persons. It was for the jury to say whom they believed. After a short, retirement the jury brought in a verdict of not guilty in each case.18

Charles was the son of Percival and Jane Constable of Army Road. He was an orchard
manager in Pakenham Upper and also worked at Plummer’s garage in Pakenham East.
Charles married Elsie Stuart in 1934. During WW2, he served as an RAAF flight mechanic
and fitter, including with 80 Squadron in the Netherlands East Indies. In the 1960s and
early 1970s, Charles was an orchardist at Beaconsfield Upper.5
