    HIS Excellency the Governor directs it to be notified, for the information of all persons concerned , that in pursuance of the 22nd Clause of the Regulations of the 29th March, 1848, his Excellency has been pleased to approve of the Claims which have been made by the parties enumerated in the annexed list, lo the pre-emptive right to leases of the several portions of Iand referred to.
    2. It is necessary that the rent, viz., Twenty Shillings per section of 640 acres, for the remainder of the present year, for the Lands in question, be paid into the Sub-Treasury, at Melbourne, within one month from the present

  • 6 May 1850: SUPREME COURT. MAY 3RD. Before his Honor the resident Judge. M'Honey v. Curran.—Action of Assumpsit.—Plaintiff agreed to sell defendant the La Trobe Inn, on the Gipp's Land Road for £120, to be paid for in cash £30, and three bills of £30 each. It was alleged that defendant had agreed to pay £30 for the good will, and £30 for the license of the ensuing year.
    Defendant pleaded that the £30 in dispute had been paid.
    Plaintiff replied, that the sum paid by defendant was not the £30 sought to be recovered.
    The issue seemed to rest, as to whether there were separate contracts for the license, and for the good will.
    Mr Terence O'Connor.—Proved that he he was presentat the time of sale, the terms were £120 to be paid by M'Honey, £30, cash, and three bills of £30 each, which were given or paid by him from funds of Curran in witnesses' keeping. The application for license was was made in June last, Curran not being present, the license was granted to M'Honey. Witness had paid him £30 on acconut of Curran who had taken possession of the premises, and in September following had obtained a transfer. Witness was not aware of any other £30 to be paid under the agreement.
    Defendant was called, but was not in attendance.
    Mr. Barry submitted, that there was no evidence, and claimed a nonsuit.
    Mr. Stawell pressed his Honor to send the case to the jury. His Honor complied reserving leave for Mr. Barry to apply for a non-suit.
    Verdict for the plaintiff. Damages £30. John Curran6
  • 3 Jun 1850: Death from Intemperance. — On Friday, an inquest was held before W. B. Wilmot, Esq., J.P., coroner for the district, upon the body of an unfortunate man, named John Curran, whose death took place under circumstances developed in the following evidence, which was adduced.
    Terrence O'Connor, settler, in the Western port district, deposed. I reside about seven miles from the deceased, and have known him about nine years. Deceased has of late been much addicted to drinking , and I have noticed that his health has been breaking up.
    On Sunday last I went to his house and finding him in a very weak state I remained at his house until his death, which took place on Wednesday morning last. On Wednesday morning I heard the deceased calling his wife to give him a drink, and went into his room, where I saw him lying on his bed, and gave him what he required, About half an hour from this time he expired, Whilst in my service which was for about seven years, he was a sound healthy man, but was more or less given to drinking beyond the bounds of temperance. I sent immediately after his death to acquaint the Coroner of the fact, Catherine Curran, the widow of the deaceased who was formerly a publican, residing at Western-port deposed. Deceased was my husband, and of late has been much addicted to drinking. On Tuesday night last he seemed very weak and had refused to eat anything for some days, indeed when he gave way to drink he seldom did eat anything. On Wednesday morning, early, deceased called to me and asked me for something to drink and complained of feeling very cold, I gave him some hot brandy and water but he seemed very weak and died in about half an hour afterwards.
    The jury returned a verdict to the effect that the deceased's death, was accelerated by intemperance. John Curran, Catherine Elizabeth Curran7
  • 4 Jun 1850: Inquest. — On Friday last, an Inquest was held at the Farmers' Hotel, on view of the body of a person named Curran, formerly a publican at Western Port. It appeared from the evidence of a man named O'Connor, that Mr. Curran had been addicted to drink for a considerable period, and had had been in a very weak and debilitated state for some time prior to his decease. The evidence of his wife, Mrs. Catherine Curran, went to shew — that on Wednesday the 29th May, he found himself unusually weak aad indisposed, and requested some hot brandy and water to be given him, which was done, and in an hour after he expired.   • 11 Jan 1934: And the first land cultivated of which anything is known was cultivated by Mr. Terence O'Connor, near Cardinia Creek, about 1838, and he grew barley and carted it to Melbourne.
    Adverting to the early days preceding the township, and before even Berwick was thought of, and before the county east of Dandenong was surveyed, some person must have settled down as an occupier of Crown land. From the flat land on the south west side of Cardinia Creek, I often noticed in after years, in my travels, up and down the main road, at this place very old plough furrows running, across the main road from the north-west side to the south-east, into Mr. Gibb's, paddock. The furrows were about 20 in number, and about 20 feet apart. The mystery problem surrounding these furrows was explained to me about 1878. I used to notice, when in Berwick, a strong looking, very respectable old gentleman, who used to look very hard at me, as if he would like to speak to me. I thought I would chum up to him, and let him break the ice. He did so-and informed me he knew my father and my mother's first husband -John Mills -and their only daughter, who became Mrs. W. A. C. a'Beckett. He said his name was Terence O'Connor. He also stated he used to grow barley here, and convey it to Melbourne for brewing purposes. It is difficult to state how long he was here, but probably till 1856, as he must have been growing barley in the present Berwick township about 1840. He afterwards bought lot 14,640 acres, pre-emptive right.13

  • 8 Jul 1914: A very old resident of Berwick passed away on Sunday last, in the person of Miss O'Connor.
    The cause of death was pneumonia. following on a cold. No lady in the district was more highly respected, and the news of her death was received with general regret. The deceased lady, who was 80 years of age, was born at Kenmare, Ireland, and came to Berwick nearly 50 ago and took up her residence here with her brother and her uncle (Mr Terence O'Connor), one of the earliest settlers in this district, who died in 1887.
    Being of a genial and kindly disposition Miss O'Connor made a large circle of friends, by whom she will be greatly missed.
    Her remains were removed to the Catholic church yesterday morning, where an impressive service was conducted by the Rev. Father Gleeson. The interment took place in the local cemetery in the afternoon, in presence of many mourners.
    The Rev Father Gleeson read the burial service and Mr J Grant carried out the mortuary arrangements.8

  • 29 Nov 1924: Mrs. Bridget Feehan, who died on 27th inst. at Brunswick at the advanced age of 94, landed in Melbourne in 1850, her first Australian experience being a trip by bullock dray to Black Dog Creek, now Chiltern. She had a clear recollection of the so-called illumination of the city to celebrate the separation of Victoria from New South Wales, namely, tallow candles and rushlights placed in windows of the houses. After marriage she and her husband—the late Mr. Richard Feehan—entered into business in the city, which they carried on successfully during the early days of the gold era. Later they entered into pastoral pursuits at Berwick and Westernport. The site of the present Moonee Valley racecourse was in possession of her husband for years, but a venture into pastoral pursuits at Tinapagee, on the River Paroo, N.S.W., and at Beechal and Greece, in Queensland, caused severe losses. Mrs. Feehan leaves behind her six sons and four daughters, the oldest son, Mr. Maurice Feehan being manager of Wingades Station, N.S.W., and the youngest, Mr. J. F. Feehan, wool auctioneer for Dalgety and Co. Ltd., Melbourne.5

    This was a petition by Mrs. Mary Feehan, praying for an inquiry by the master in equity as to whether her husband, James Feehan, was of sane mind and capable of managing his affairs. The petition was presented through Mr. J. Ryan, the father of Mrs. Feehan.
    Mr. A'Beckett appeared for the petitioner; Mr. Lawes for Mr. Feehan.
    James Feehan was a farmer at Berwick, but he had freehold land also at Corop, and leased land at Deep Creek, Bulla. It was alleged that he had been in the Yarra Bend Asylum some years ago as a lunatic; that he afterwards obtained his release; that in August last he was again placed in the asylum by an order signed by Mr. F. Call, police magistrate. The order was made on two certificates signed by Dr. J. P. Ryan and Mr. C. S. Ryan, medical practitioners. Both these gentlemen made affidavits that Feehan was suffering from religious delusions. Mr. Paley, superintendent of the asylum, also gave similar evidence, and Mrs Feehan and two of her sons, one 19 and the other 15 years of age, gave evidence as to the conduct of Mr. Feehan. Against this aflidavits were put in by Dr. Molloy, Mr. Iffla, surgeon, an official visitor at the lunatic asylum, that Feehan was rational. Mr. H. C. Turner, bank manager, Mr. N. J. Casey, Mr. Ker, and others said that Feehan seemed to be perfectly able to transact business. It was contended on his behalf that he was not permanently insane and that his wife was too precipitate in making this application.
    His HONOUR said that this was only an application for an inquiry as to the sanity of the alleged lunatic, and it was advisable that it should take place as it would decide the charge of lunacy that was now hovering over him. According to the result of that inquiry, and whether there were reasonable grounds for preferring the accusation, he would decide the question of costs. James Feehan3

  • 10 Jul 1891: SUPPOSED CASE OF DROWNING. SUNBURY, Thursday.
    Mr. Maurice Feehan, of Deep Creek, who was well known in Melbourne, is supposed to have been drowned in the Emu Creek last night. He left Sunbury late, and stated that he intended staying at Mr. Gellie's, president of the Bullashire, if the creek was high. He evidently attempted to cross as his horse was found saddled, with marks of having been in the water, some distance below the crossing, at 2 o'olock to-day, and though inquiries have been made in all directions nothing has been heard of Mr. Feehan.
    The creek is running a banker, and until it subsides nothing can be done. A search party will start at daybreak. Mr. Feehan was a prominent member of the Oaklands Hunt Club, and was a committeeman of the West Bourke Agricultural Society.4
