    About 200 members of the Victorian Mounted Rifles paraded at the Victoria Barracks yesterday afternoon in order that Colonel Price, the commandant of the regiment should select a detachment for sending to London to take part in the Queen’s Diamond Jubilee celebrations in June next.
    In all 23 rank and file were selected, three more than will he sent, the extra men being chosen as a precaution against accident. The detachment was inspected by Sir Charles Holled Smith this morning, and he approved of the selection.     I, CARL JOHAN HJALMAR NISSEN, Hotelkeeper, Married, now residing at William street, in the district of Perth, do hereby give notice that it is my intention to APPLY at the next Licensing Meeting, to be holden for this district, for a PUBLICAN'S GENERAL LICENSE for the sale of liquor, in the house and appurtenances thereunto belonging, situated at Adelaide-terrace, in the City of Perth, on Lots 10, 11 and 12, subdivision A, containing six sitting-rooms and nineteen bedrooms, exclusive of those required by myself and my family, rented by me from the Swan Brewery Company, Limited, now unoccupied, and at present licensed under the sign of the Ozone Hotel, and which I intend to keep as an Inn or Public House.   • 11 May 1904: HOURS OF WAITRESSES
    At the District Courts yesterday C. J. H. Nissen, a restaurant-keeper was prosecuted for working a waitress 72.5 hours per week, and was fined. One of the justices, however, expressed an unfavorable opinion of the Factories Act, but both Sir Samuel Gillott and Mr. Harrison Ord consider that the department was fully justified in entering a prosecution. Sir Samuel Gillott said that 60 hours a week was in all conscience long enough for a waitress to work. The Act, he claimed, was being temperamentally administered, but a prosecution was the only way when the Act was ignored to enforce compliance. Mr. Harrison Ord pointed out that it was only in cases where a palpable attempt to evade the Act had been made that prosecutions were ordered. On other occasions an explanation was first sought from the employers, and when given were in a large percentage of cases accepted.58
  • 15 Sep 1910: ALLEGED BREACH OF TRUST. LAW CASE OVER A WILL. Melbourne, September 14.
    The hearing of an action, in which the trustees of a will were charged with breach of trust in the administration of the affairs of an estate, was begun in the Banco Court to-day before Mr. Justice a'Beckett. The plaintiffs were Kensa Greta Maria Grunden and other infant children of Knut Adolph Grunden, deceased, of Elizabeth-street, oyster saloon-keeper, and the defendants were Carl Johan Nissen, of the Exchange Hotel, William-street, and Wilhelm Pallin, of Elizabeth-street, who were sued as trustees of the will, and the name of August Sheldon had subsequently been added. The plaintiffs claimed that as beneficiaries under the will the defendants had retained £220 for commission out of the estate, had expended £193 in alleged improvements on certain real estate at Glenbrook; had paid out money belonging to the trust estate to the defendant Pallin for work alleged to have been done and for expenses incurred by him and for gratuity to him; had displayed negligence and mismanaged the business; had failed to keep proper accounts, and had improperly invested money on in sufficient security.
    The defence was a denial of all the material allegations.
    In opening the case Mr. Weigall said the profits of the business had previously amounted to £1.000 a year, but latterly they had greatly decreased. Nissen had been appointed manager at a salary of £4 10/ per week, and the plaintiffs claimed that the expenditure had greatly increased.
    His Honor—Do you menn that there has been too great an expenditure in anchovy sauce?
    Mr Weigall referred the court to the items of $60? for a tombstone over the testator's grave, and to £97 for funeral expenses. Both these items were alleged to be excessive.
    His Honor—What do you want the court to do?
    Mr. Weigall—We request that the present trustees be asked to resign; that new trustees be appointed; that the defendants immediately pay £800 or £900, which we say has been improperly taken out of the trust estate, and that accounts be taken. His Honor—Various breaches are charged, against them?
    Mr. Weigall—Pallin credited himself with £110 commission, and meals for the staff were purchased from Nissen's hotel.
    His Honor—Did you expect the staff to live on oysters alone? (Laughter.)
    Mr. Weigall said it was also charged that Pallin gave himself a Christmas box.
    His Honor—Not more than once a year I hope. (Laughter.)
    Mr. Duffy (for the defendants)—We are quite willing to show accounts. The estate at the time of the testator's death was sworn at £2,156, and it is now worth £3,856.
    Mr. Weigall—Why did you not say so before?
    Mr. Duffy—I knew I had a surprise for my friend, but I could not interrupt him whilst he was reciting a three-volume sensational novel. (Laughter.)
    Mr Weigall—What was the profit made last year?
    Mr. Duffy—£1.131.
    Efforts to settle the action having failed, Mr. Weigall proceeded to hand in a number of documents to the court.
    The case stands partly heard.59
  • 12 Dec 1914: Narcissa's bay colt foal, by Mazagan (imp.), owned by Mr C. J. H. Nissen, died a few days ago at Blackwood Park.60
  • 21 Jan 1916: Mr. C. J. H. Nissen appears to have a smart filly in Lady Narcissa, which won last Saturday's two-year-old event at Caulfield. Lady Narcissa is the first of Narcissa's foals. Mr. Nissen had bad luck with the subsequent progeny of the Havoc mare. Her second foal was a colt by Mazagan, and therefore a full brother to Lady Narcissa, but it died on the day that Mr. Nissen returned from a trip round the world, in 1914. In October last Narcissa produced twin foals, a colt and a filly to The Scribe, but they lived for only a few days. Narcissa has been mated with Bobadil this season. An exchange adds that Mr. Nissen's connection with the turf as an owner dates back to the early nineties. He had the management of Lord Charles Scott, when that horse won the Standish Handicap.61
  • 22 Jun 1917: Mr. C. J. H. Nissen's mare Narcissa, by Havoc—Flower Girl, broke her off fetlock at Blackwood Park a few days ago, and was destroyed.62
  • 31 Jan 1918: After a splendid finish, Lady Narcissa defeated the favourite, Sauci, by half-a-head in the Park Handicap at Sandown. It was up to Lady Narcissa to score a win, as she invariably runs a good race, but had not scored for exactly two years to the day. Lady Narcissa was bred by her owner, Mr. C. J. H. Nissen, a Melbourne boniface, who always has a horse in training. J. Lang, who prepared Lady Narcissa, is a son of the old-time mentor, Billy Lang. All going well, Lady Narcissa is a certain starter in the Australian Cup.63
  • 28 Oct 1922: THE TURF. Lady Narissa, the 1919 Wagga Cup winner, owned by Mr C. J. L Nissen, Melbourne, has produced a colt foal to Red Dennis.64

    Homeward bound after a trip to Europe, Mr. C. J. H. Nissen, a Victorian racehorse owner, reached Sydney on the Mirraboolta to-day. Mr. Nissen was not greatly impressed by the racing he saw abroad, but had some interesting comments to make on the sport in Sweden. The totalisator was introduced to that country in recent years, but the Swedes are not a gambling race, and investments of 2s or 2s 6d satisfy most people. Stakes are small, and there are no bookmakers.68

  • 18 Jul 1941: HOSPITALS BENEFIT FROM WILL
    Ultimately the whole of the estate of Mr. Carl Johan Hjalmar Nissen, late of Foster-street, St Kilda will go to metropolitan charities. Mr. Nissen, who left real estate £3175 and personal property £18,291, provided in his will that his widow and sister should receive the income of his estate for life, and upon the death of the surviving beneficiary, £200 should go to the Lost Dogs' Home, £200 to the rest home for horses at Ashburton, and the balance should be held for the Melbourne, Austin, Women's, Prince Henry's, Children's and Eye and Ear hospital, in equal shares.70

  • 7 Sep 1917: BODY FOUND ON ROAD. BEACONSFIELD UPPER, Thursday. - A post-mortem examiniation was held at the Pine Grove Hotel on Wednesday by Dr Griffith, of Berwick, on the body of A. McMillen, who was found dead on the main Gembrook road near Beaconsfield Upper, on Tuesday midday by school children. Dr. Griffith found that death was caused by the effects of drink and exposure. There was no injury likely to have caused death. The body was that of a healthy man, aged about 50. Evidently the body had lain where it was found for about a fortnight.6
  • 7 Sep 1917: Beaconsfield Upper. A gruesome discovery was made by two boys who were bird-nesting while on their way to school on Tues day last. They were going through a patch of scrub near the road when they came upon the body of a man. The police were communicated with and in a short space of time Constable Lombard, of Berwick, and Dr Langmore, arrived on the scene, when an examination of the body was made. Death must have happened about a fortnight ago. The man was a stranger in the district; and it is thought he was employed at the storage basin in the Haunted Gully. The body was clad in a blue jacket and vest with moleskin trousers, and appeared to be that of a man about 60 years of age. The doctor ordered the removal of the body to the Pine Grove Hotel, where a magisterial inquiry will be held. Up to the time of writing the body has not been identified.7

    An inquiry touching the death of a man whose body was found alongside the road was held before Mr W. J. Harvey-Smith, J.P., at the Pine Grove Hotel on Thursday, 6th instant, when the following evidence was given:
    J. T. Jackson deposed—I am the foreman in charge of the construction works at the reservoir, Beaconsfield, and I live at the camp. I identify the body as that of a man named Alexander McMillan. He was a laborer working under my supervision at the construc tion works. I saw him last alive about five weeks ago, when he was transferred from the construction gang to the channel gang, and he would then come under the supervision of Mr Flood, who had charge of the channel gang. His health at that time was normal. I found him generally a quiet and orderly man and a good worker. He was, I am told, in the habit of having a periodical outburst of drinking, when he would drink to excess. I could not throw any light as to the time he left the camp. He started work at the resevoir on May 11th.
    D. Thomson deposed—I was, on Tuesday the 4th, working in a paddock adjoining the school. The teacher sent over and asked me to go and look at a man whom she thought was drunk, who was lying in some scrub at the side of the road. I went and saw the body of a man which has been identified as that of Alexander McMillan. I examined the body and found life extinct. I sent a message to the nearest telephone and asked them to inform the police at Berwick. He was a stranger to me and I had never seen him before.
    J. C. Jensen deposed - I am the licensee of Pine Grove Hotel, Beaconsfield Upper. The deceased came to the hotel a few minutes after 9 on Tuesday morning, August 21st. He was then sober but appeared like a man who was getting over a drinking bout. He was wet and cold. He had two whiskies and a port wine which he drank on the premises. He also bought and took away one bottle of whisky and two bottles of port wine. In answer to my enquiry he said he worked at the waterworks and camped there. He stopped about half-an-hour and then left, carrying the liquor in a sugar bag, and went in the direction in which he was afterwards found dead. The bottles produced were similar to those supplied by me, and also the bag into which he put the bottles. - I am quite positive about the date. He only came once to the hotel. I never saw him alive after that date. He was by himself. From the hotel to where he was found is about half a mile on the road to the waterworks.
    Constable Lombard deposed—I am a police constable stationed at Berwick. In consequncue of a telephone message on Tuesday, 4th September, I came to Beaconsfield Upper. I saw the deceased in a patch of scrub on the side of the road about half a mile south of Pine Grove Hotel. The witness, after describing the position of the body, said he noticed several abrasions on right side of face, which appeared to have been caused by some sharp instrument. There was a small pool of blood under the head. I sent for Dr Langmore, who examined the body. I then had the body removed to the hotel, where I searched deceased's clothing and in the pockets found some money, a watch and a bundle of tradesmen's accounts. -
    Dr Griffiths deposed—I made a post mortem examination of the body. I found it to be that of a man between fifty and sixty years of age. It was fairly well nourished and all the internal organs (with the exception of the heart, which was slightly enlarged and flabby) were in a healthy condition. The deceased was not an habitual drinker. He was evidently one of those men who have a good spree and then leave it off for some months. Death had taken place about ten or twelve days ago. The abrasions on the face were probably caused when the deceased fell in the scrub. In my opinion death had been caused by alcoholism and exposure. "The finding of the enquiry was in accordance with the medical testimony.8

  • 27 May 1942: Soldier Killed In Motor Bike Crash
    When two motor bikes collided on Wellington road, Rowville, at about 5.40 p.m. yesterday, a soldier, Pte. Daniel Pittard, was killed instantly, and two others were injured.
    The machine which the dead man was riding had been reported as stolen. It hit a military bike ridden by Sapper Denis Kimbler and skidded for 25 yards before coming to rest.
    Pte. Barber was riding pillion with Pittard when the accident occurred.7
  • 10 Jun 1942: Fatal Motor Cycling ‘Crack-up’ Has Court Sequel. Pillion Rider Not Guilty Of Unlawful Possession
    WHETHER a pillion rider on a stolen motor cycle could be deemed to be in unlawful possession of it, was one of the points at issue in a case at the Dandenong Court last Monday. The driver of the motor cycle was dead, having been killed in an accident in which it was involved, and the pillion rider, who was charged with unlawful possession of the machine, told the court that he had no idea it was “crook.” His explanation was accepted by the court and he was discharged.
    The case was one in which First Constable G. Trainor proceeded against Alan Leslie Barker, a soldier, for having, at Rowville, on May 26th, unlawfully used a motor cycle belonging to William Peter Castagna.
    Accused pleaded not guilty and was represented by Mr. J. S. Rowan (instructed by Mr. Ray Dunn). Sgt. Hawkins prosecuted.
    SAW HIS BIKE BEING RIDDEN OFF
    William Peter Castagna, of Armadale, the owner of the motor cycle, gave evidence that on May 22nd, he went down to book seats at the pictures, leaving his bike at the kerb for about 5 minutes. When he came back it was to see the twinkling tail light disappearing down the street. It was wobbling, as if the bike was being pushed. He ran after it, but apparently the thief got it started and he could not catch him. He gave up the chase and reported his loss to the Toorak police. He did not give the accused or anybody else, authority to take the machine.
    MACHINE IN FATAL SMASH
    First Constable Trainor told the court that at about 5 p.m. on May 26th he went to Wellington road, Rowville, where he saw a Velocette motor cycle on the side of the road in a damaged condition. About 3 hours later he saw the accused at a military camp. He admitted that he had been riding pillion on the machine behind an other soldier named Pittard, at the time of the smash. As Barker was still very shaky he did not question him further then.
    Next day he again interviewed accused and told him the motor cycle he was on was a stolen machine. “I didn’t know it was ‘crook,’” Barker replied. “Dan Pittard asked me to go up to the Wheeler’s Hill Hotel with him for a drink. We went up and had about 9 beers. Dan then mounted the bike, I got on behind and we were returning when the accident occurred.”
    In answer to further questions he said he had known Pittard for about a month but never knew he had a motor cycle, or even that he could ride one. He admitted that he (accused) could ride one. “Didn’t it seem strange that Pittard should suddenly have a bike?” witness asked him. “I didn't ask him any questions about it at all,” Barker replied.
    “I then told him that Pittard wasn’t on leave when the machine was stolen,” witness proceeded. “Accused admitted that he had been on leave.”
    Asked what explanation he had for disappearing after the accident, accused replied, “It might have been that I was A.W.L.” Witness countered by saying, “The military authorities saw you there after the accident, so that couldn’t have been the reason.
    Asked where he was on the Saturday the bike was stolen, accused had replied that he was at a party in Prahran.
    This concluded the case for the prosecution. “The other rider of the machine cannot be here. Unfortunately he was killed in the accident,” Sgt Hawkins explained.
    The accused, Alan Leslie Barker, went into the witness box and said that on the afternoon of the accident he had left the camp with Pittard. They had walked down the road towards Wellington road.
    Pittard asked him if he would like to have a drink, but when he told him they would have to go to the Wheeler’s Hill hotel, to get it he replied that it was a bit too far to walk. Pittard then told him he had a motor bike at the side of the road. They got on it and went to the Wheeler’s Hill hotel where they consumed several drinks.
    He (witness) never even knew the bike was stolen until the police came to him on the following Wednesday and told him.
    Mr. Marwick: Did you ever know Pittard to have a bike before? What did you think when he produced this bike?
    Accused: I never worried. I assumed it was his and that he had a right to use it.
    In dismissing the case, the P.M. said there was very little evidence, if any, against accused.8
