  • 30 Nov 1917: Mrs E. Huggard, of Toolamba, has received official word from the Base Records Office that her son, Private R. G. Huggard has, for the second time, been mentioned in Sir Douglas Haig's military despatches for conspicuous bravery. Private Huggard is a nephew of Mr and Mrs M.   • 25 Sep 1922: A NEW BUSINESS VENTURE. The New Wattle Tea Rooms.
    A house of beauty and business has taken the place of the piece of land so long vacant in Fryers Street next to James Fairleys emporium. This is the Wattle Tea-Rooms of Mr. Matthew Paternoster (late of Tatura), whose experience in business concerns has been wide and successful. What he has established now in this town will supply a long felt necessity, and everybody who visits the establishment will readily notice how well he has done matters—everything in first-class, up-to-date style. For several weeks past this elegant building has been progressing towards completion, the builder being Mr. W. E. Richardson, of Welsford Street; and finality was reached on Saturday last sufficiently to enable its being thrown open to the public. And the public availed itself of the opportunity to an extent that must have been very gratifying to Mr. Paternoster, for during the afternoon the rooms
    were crowded. Many had to wait outside before they could secure entrance, while good business was also done during the evening. The fact that so many had to wait was only an initial disability that will soon be overcome, for the management intends to leave nothing undone that will lend to the convenience and comfort of its patrons.
    An outside view of the building is very striking because of its architectural features, with the windows, each 9 ft. in length; harmonising aesthetically with the surroundings. The top portion consists of lead lights; the fittings are of the latest improved style; and with cakes and confectionery, fancy chocolate boxes and other articles in artistic array in those windows, one almost feels an involuntary push from behind to go inside the tea rooms. Very well; that cannot be helped in such circumstances. And what do you behold? First of all, two shop counters with oilcloth tops, and two Dayton computing scales, while against the walls are shelves well laden with necessaries and luxuries.
    This department is under the assistant manageress, Miss A. Huggard. Then the visitor enters the main portion of the building—the tea rooms, so bright and airy, and so calculated to give zest to the appetite. There are 14 tables, each with a fancy cover and each having in
    the centre a small vase containing wattle sprays. New chairs are round those tables, on the walls are three large mirrors, six smaller ones and six hat racks with the light yellow tinting of the walls producing a happy effect. The waitresses are four in number, all in uniform costume, to represent the wattle and the lady in charge is Mrs Paternoster.
    In the further portion of the building it is quite a pleasure to witness what has been achieved. To commence with the kitchen with hot and cold water services laid on with its array of brand new cups, saucers and plates (white and gold) and all necessary appurtenances. A few steps further back and you come to the combined cake and sponge making machine driven by motor and the electric ice cream freezer on a concrete floor. Another step and you enter the bakehouse, for everything is baked on the premises under strictly hygienic principles. And from the bakehouse and the kitchen there is a private
    side passage leading to the tea rooms to enable pies and other good things to be served hot and appetisingly. Mr Paternoster intends to make still further improve ments and before very long he will be installing a soda fountain. Mary Jane Paternoster, Alice Sophie Alma Huggard12
  • 21 Feb 1924: Shepparton General Sessions. RECEIVING STOLEN PROPERTY. MAN SENTENCED TO NINE MONTHS' IMPRISONMENT.
    SHEPPARTON. — At Shepparton General Sessions, before Judge Woinarski, Matthew Paternoster was charged with stealing sugar and petrol from Fairley Bros., merchants, and alternatively with receiving these goods knowing them to have been stolen. Mr. Leon prosecuted and Mr. Brennan defended.
    Evidence of two young men, former employes of Fairley's, was to the effect that Paternoster, who was a pastry cook and a tenant of Fairley's, had instigated them to steal the goods in question and hand them over to him, for which they had been convicted at Shepparton police court on 15th January and treated as first offenders.
    A. W. Fairley, a member of the firm, deposed that accused had admitted getting the goods. He promised to make complete restitution, provided the firm would not prosecute. Fairley's evidence was corroborated by Sergeant Hedger and Constable Perry, to each of whom accused had made similar admissions.
    Accused went into the witness box and denied the allegations, deposing that during his interview with Fairley he had described the two young men as liars. FairIey, recalled, denied that accused had so expressed himself.
    The case lasted all day Tuesday, the judge deferring his summing up till Wednesday morning. His review of the evidence was decidedly against accused, he acceded to Mr. Brennan's representation that two out of the eight charges against accused should be withdrawn. At Mr. Brennan's request, the judge also recalled the jury, and instructed them that in the count where the evidence of the two accomplices was given in support of one or the other only one testimony need be taken into account, leaving it to the jury to say which they should adopt.
    The jury returned a verdict of not guilty on seven of the counts and of guilty on the eighth count, that of receiving a tin of petrol knowing it to have been stolen.
    Accused was sentenced to nine months imprisonment, the judge remarking that receiving stolen property was a most dangerous crime, and must he put down. The accused is well known throughout the district, and his case created great interest.13

    William Brisbane v. John Robert Wilson; debt, £32 9s. 9d., for commission on the sale of 88½ acres of land at Beaconsfield, belonging to defendant.—Mr. Johnston appeared for the plaintiff, and Mr. Leon instructed by Mr. Cleverdon, appeared for the defendant.—In this case the plaintiff (Brisbane) sought to recover the sum of £32 9s. 9d. as comission on 88½ acres of land, which he alleges he was authorised to sell for the defendant, J. R. Wilson.—The plaintiff said he was authorised by a conversation ot the 7th April, in this year, by defendant, at the Beaconsfield railway station, to sell the land in question at £15 per acre. The terms were to be half cash, and the balance in two years bearing 6% interest. Under this authority Brisbane sold the land to Dr. L L. Smith. The defendant denied having given plaintiff any authority to sell the land, and tried to prove that Brisbane was acting in the best interests of Dr. L. L. Smith, who was employing him at a salary of £400 a year and dinner given in.—Mr John Ryan, who was then a stationmaster at Beaconsfield, but now removed to Pakenham, was called to corroberate plaintiff as to part of the conversation as to the terms. Mr. Glascock, Brighton, gave evidence as to subsequent conversation in reference to defendant asking plaintiff when he would require possession of the property.—For the defence it was urged that Wilson had given Brisbane no authority to sell, but that he had taken upon himself to do so on the strength of a casual conversation, between Wilson and himself.—The jury, after half an hour's deliberation, returned a verdict for the plaintiff with £12 6s. 6d. costs.     Mr Sutton Hawes, an English visitor, who had been staying for some time with Mr. Fuller, J.P. at Cardinia House, was assisting the hands to obtain control of a fire which was threatening the property on Saturday afternoon, when he was overcome by heat apoplexy. Though Dr. Bennie arrived within a very short time, all his efforts were fruitless, and Mr Hawes died within an hour. Deceased was generally liked, and much sympathy is felt for his daughter, who has now no relatives in Australia.19

Note*1937 CORONER’S INQUEST (typed) into the death of Donald Neil McDonald. ____________ VICTORIA, TO WIT This Deponent Percival Wallis Fuller On his oath saith, I am a Motorman in the employ of the State Electricity Commission of Victoria Residing at 27 Swanson Street, Geelong. On the 9th September, 1937, I was Motorman on tramcar No. 2 when it left the terminus at East Geelong at 6.19p.m. on the trip to the city and was traveling in Queenscliff Road in a westerly direction. When about a quarter of a mile from the terminus, I was casting down hill at a speed of about 15 m.p.h. when I noticed, about half a mile ahead, a motor vehicle approaching with two bright headlights showing. The motorist passed a horsedrawn jinker when it was some hundreds of yards away from the tram, and in doing so swung on to the centre of the track. I sounded the gong violently and applied the air brake, slowing the tram down to about 10 m.p.h. The motorist, driving erratically, appeared to make an attempt to clear the tram track, but again swung back on to the centre of the track when about 100 feet away from the tram. I immediately applied full emergency brake and had slowed down to about 3 m.p.h. I noticed the motorist was traveling at a fast speed, estimated to be from 40-50 m.p.h., and he did not slacken speed at all and came on to strike the front of the tram head on. The time was then about 6.22 p.m. The visibility was fair, with light rain falling. The tram traveled only about 4-5 feet after the collision, and the front wheels of the tram were derailed after impact. The whole of the bonnet up to the dash board, except near side front wheel, of the motor car was crushed under the front bumper of the tram. I went to the driver’s assistance, but found him unconscious, leaning against the door on the driving side. I asked Conductor Atkins to call an ambulance, which arrived shortly after, and the police were also notified, and took the motorist to hospital.
VICTORIA, TO WIT This Deponent Percival Wallis Fuller On his oath saith, I am a Motorman residing at 27 Swanson Street, Geelong away from the tram when the accident occurred. I saw the car pass the cart. It passed about 60 yards from the tram. I made no measurements of distances. The motorist was traveling very fast. The usual speed of a tram is 15-18 miles per hour. I was traveling at 15 mph. traveling at 15 mph under these conditions I could pull the tram up in 20 feet. I did not notice a light on Dellers [sic – the horse & cart] vehicle Mr Dooley / I have never measured the distance it takes to pull up a tram which is traveling at 12 to 15 mph I have never made a test. Having inquired upon the part of our Lord the King when, where and How the said Donald Neil McDonald came by his death, I say that on the Ninth day of September 1937 at Geelong in the said State, the said Donald Neil McDonald died from Injuries accidentally received in a head-on collision with an Electric Tram whilst driving a Motor Car in Ormond Road Geelong on ninth day of September 1937.
