The Secretary of Lands Sir I beg to acknowledge receipt of your letter of the 9th July No 2788 (addressed to me at 33 Gore Street, Fitzroy) requesting me to state, with reference to my 32nd section holding in the Parish of Pakenham, "why" the improvements prescribed by the lease have not been made. This inquiry involves the assumption that no improvements have been effected; but to assume anything of the kind would be very wrong. In the first place, the land has been enclosed by a substantial fence — post + 2 rail — at a cost of over £30. Secondly, a commencement has been made in the way of clearing. Thirdly, I may mention that the only vermin seen upon the land was confined to a stray wallaby which, when seen, was shot. The land is free from "Bathurst burr, wild briar, + gorse." I would have done more but for circumstances beyond my control including moving house. The allotment which bounds the holding on the south is my own freehold; so that I have a substantial reason for continuing improvement. I beg to add that although the lease is dated the 1st January 1887 it was fully six months subsequently before it was executed and came into my possession. Land-Note | 2 Aug 1890 | PAK-139. 2 August 1890 Report of Contable R Roberts 3155 relative to the improvements on the land of Thos R Hadley & explaining the error in his report of the 19th June last. I beg to report for the information of the Secretary for lands, that in my report of the 19th June last attached, I reported that I could find no improvements on the land of Edwin Joynt now under the lease to Thos R hadley. I beg to state that that report is incorrect. I may state that I have only recently been stationed at Berwick and I am a stranger in this part, and I find it a very difficult matter to find out some of the blocks I am called upon for report, a lot of the land around where this block is situate is not fenced, and I mistook another block about a mile further north which is not fenced for Mr Hadleys block. Last Thursday the Shire valuator went with me and showed me Mr Hadley's block, and I found that the land is all enclosed. The improvements consist of about 50 chains of post and two rail fence valued at 16/- per chain total £40. There is also about two acres of scrub cut and cleared at a cost of about £3. Land-Note | 9 Apr 1906 | PAK-139. 49 Gore Street Fitzroy, 9th April 1906 The Secretary for Lands, Sir, I beg to acknowledge receipt of your circular letter of the 5th inst intimating that on some day in the future I shall be required to appear before a Local Land Board to show cause why land at Pakenham, which I hold under lease from the Crown should not be forfeited. Permit me, in reply, to explain how I became a lessee of Crown land. Years ago I acquired a freehold of twenty acres on Beaconsfield Heights [It is represented on the Government Map as allotment 140 Pakenham] I then contemplated building a summer residence upon it. When arrangements were entered into for fencing the land it was found that a similar area abutting on the north was unenclosed [Allotment 139 Pakenham]. I took pains to ascertain who my neighbour was, so that the cost of the dividing fence might be defrayed between us, but without success. Ultimately I drifted to the Crown Lands Office, and there I was informed that allotment 139 was a forfeited selection. I applied for a lease of that land and in due course it was granted. I then had the two allotments (the total area, 40 acres) inclosed in one ring fence. By that time I had abandoned the idea of a summer residence in favour of establishing a poultry farm with my son, an ex-student of Dookie College, as manager. However the scheme fell through because my son took it into his hands to go to South Africa where, after serving twelve months with the Army of the Empire, he died from enteritis. Since then I hace done nothing with respect to the land beyond paying regularly the rent and the shire rates. In fact my care about it has gone, and it is not likely that it will be revived seeing that I am seventy-seven years old. I have endeavoured to sell my freehold. Had I been successful I would have appealed to the Lands department for permission to transfer my lease to the purchaser. But land on Beaconsfield Heights does not sell readily. Most of it is of poor quality, and the contour of the district is a hindrance to cultivation. Any how there is no question that I have not complied with my lease's conditions as to improvements, and therefore the lease is liable to forfeiture. I throw myself upon the mercy of the court. If the Lands department thinks fit to forfeit the lease, I hope it will be at the expense of removing the fencing on the eastern and western sides of the land to the southern side, so that the inclosure of my freehold may be complete.
