  • 28 Nov 1930: ACTION FOR TRESPASS. Claim for £2000 Damages. Plaintiff Awarded £500.
    An action, brought by Mrs. Rose Clara Cleland, of Edenhope, near Beaconsfield, dairy farmer, against John McQuay, of Grafton-street, Elsternwick, and F. G. Cooper, of New-street, Elsternwick, claiming £2000 as damages from defendants jointly for alleged trespass, was concluded before Mr. Justice Mann and a jury of six in the First Civil Court yesterday. Mr. Dixon Hearder (instructed by Messrs. Morgan and Fyffe) appeared for plaintiff and Mr. Walker (by Messrs, Cook and McCallum) for defendant McQuay. Cooper was not represented by counsel. Plaintiff, in her claim, said that by a contract made on 10th February last she agreed to purchase from McQuay a farm belonging to him at Beaconsfield. In March plaintiff took possession of the farm. On 2nd June plaintiff alleged de fendant McQuay, by his servants and agents, and by the defendant Cooper, broke and entered the premises and took possession of the stock, and did likewise on 3rd June. By the nets complained of plaintiff was prevented from continuing her business and was deprived of "the peaceful and quiet enjoyment of the lands, building and chattels." The cows had not been milked and their milking capacity had diminished. Portions of the plant had been improperly used. Defendant McQuay denied he entered into possession of the farm or that he had given authority to any of the other per sons to do any of the acts complained of. Plaintiff, in evidence, said that up till 2nd June everything that was due for payment on the property had been paid. About 7 o'clock that evening Cooper and another man came to the house and said they were to take possession. Plaintiff was told to pack up immediately. She gave them permission to bring a woman into the house. The party operated the player piano in the parlor until midnight. She refused to go to bed and sat up all night. In the morning a constable arrived and Cooper and the others were ordered to leave, which they did. McQuay said he ordered Cooper to serve a notice, of recission of contract on plaintiff, and nothing else. He had taken this action because he discovered that plain tiff had assigned her estate before hand ing over a property in part payment for the farm. The jury found for the plaintiff and awarded her £250 damages against each defendant. Judgments were entered for the amounts with costs. John James McQuay10
