Divorce*1879William Henry Ellerker and Jemima McKee were divorced in 1879 William divorced Jemima in 1879 after she had an adulterous affair whilst on the boat travelling to England with her daughter.
Ellerker v Ellerker and Wiltshire
This was a petition by Mr W.H. Ellerker, an architect, praying for a divorce from his wife on the ground of her adultery with Fredk. A. Wiltshire, formerly and officer on board the steamer Somersetshire.
Mr Lawes for the petitioner: no appearance for respondent or co-respondent.
The petitioner said he was married to his wife at St Peter’s Church, Melbourne in September 1862 by the Rev S.L. Chase. She was then about 16 years of age and he was 26. They went to Queensland in 1863 and remained there for three years, when they cane back to Victoria. In February 1875 he sent his wife to England by the Somersetshire. With her was their eldest child and on board were some friends of theirs. Up till that time petitioner and respondent had lived affectionately together. Afterwards they used to correspond by every steamer. In May 1876 he received a letter that she was coming back by the Whampoa. When the Whompoa arrived he went on board and then found that she had sent back the child in care of a lady on board and had sent with her a letter stating – “I do not blame you but I cannot be happy with you. I have known little happiness in my life. Everything has been done for duty’s sake, striving to please you and the children. I have worked as few women work and for nothing. No one here knows I am not going back to Melbourne. All friends think I have gone:” and she added that he would therefore not be compromised. Afterwards he received information that she was dead but on sending for a certificate of death her name could not be found in the registries. He afterwards learnt that she was living with Wiltshire and he instituted these proceedings. There was no cause for her leaving her husband.
The Court granted the decree as prayed.
It would appear that the surviving members of the family never saw their mother again and were perhaps informed that she had died.6,7

    From the UK census, it seems they had two daughters prior to their marriage and one after.

    Jemima married Frederick William Wiltshire (b. Middlesex, England, abt. 1851) in London, January 1880. I have attached a copy of their marriage certificate, which I accessed through Ancestry (London marriages and banns). You might need to print it out to read it, unfortunately that’s the way the image was saved.

    From the UK census, it seems they had two daughters prior to their marriage and one after.

  • 21 Jun 1900: THE GLENELG INQUIRY. MR. ELLERKER IN THE BOX.
    On Monday last the Court of Marine Inquiry resumed the taking of evidence relative to the loss of the Glenelg and the vessel's condition prior to her leaving Bairnsdale on her last voyage.
    Robert M. Findley, consulting engineer, said he had known of an instance of a vessel throwing a propeller blade, but he did not think it possible for a blade to have been thrown by the Glenelg in the manner suggested.
    Arthur [sic] John Ellerker, one of the owners of the vessel, said £2500 had been paid for her in 1898. They were so well satisfied with the vessel that they would have willingly given another £1000. He had sailed in the Glenelg himself, and had every confidence in her. He had never heard any of the employes allege that the ship was in the slightest degree unseaworthy. The fireman Russell, who had given evidence, was discharged for drunkenness. Courtney, another witness, had been sacked by Mr Fyffe, the engineer, for impudence. The stewardess who had come forward in the case had also been discharged. An offer of £5000 had been made for
    the Glenelg a few weeks before she was lost, but the owners refused it. They lost fully £5000 by the disaster over and above the amount of the insurance. It was Mr McLean who had first informed them that the Glenelg was not up to Victorian requirements in several respects, but at the next overhaul over £300 was spent in alterations and repairs. Witness had
    never said to Fyffe that lie " wished the blessed boat was at the bottom," and he did not believe Fyffe ever said such a thing. No new plates had been put in the vessel, but patches had. One bill came to over £300. That was for shafting and other things. A few weeks before the vessel went down witness spent £25 on life belts for her. He would have been very much surprised to learn that Fyffe had ever said the worry of the ship was driving him mad. The evidence given by Veasnafsca, the carpenter, was incorrect. He had sent a telegram to this man, not because he believed him to be an important witness, but because there were no other witnesses at all. They had all been drowned.
    Witness could not think of any feasible explanation of the cause of the disaster except the propeller blade theory. When the news of the wreck arrived be got it by the telephone. He could not remember what he said on learning of it, neither did he want to recollect it.8

  • 29 Jan 1896: The Beaconsfield Robberies.
    The Beaconsfield robberies, as we anticipated last week, have developed into no less than ten separate charges against Eli Harris, whilst an additional three are preferred against his wife. The police paid a visit to Harris' house on Thursday last, when a lot of valuable evidence was collected. The sheeting identified by Mrs. Smith as her property, and which was recovered from accused's house, had previously been marked. When the police got possession a neat parcel was found in the house containing the clippings from the sheets, on which was the Smith monogram. In fact, the mass of evidence that has accumulated is almost beyond credence. Constable Roberts has been besieged with visitors during the week, and anyone in the district who has lost any thing in the shape of household goods, lately, will have a very good chance of recovering it from amongst the olla pod rida stored at the Berwick courthouse.
    We append a LIST OF ROBBERIES.
    Francis Ryan's house was looted 18 months ago, there being removed a duchesse table, movable top washstand, pigskin riding saddle, floor cramp, axe, augur, &c. valued at £15.
    In March 1895, Mrs. Mary Crouch, of "Fassifern" Upper Beaconsfield, suffered the loss of cutlery, blankets, sheets, counterpanes, bedding, scales, washing machine, saucepans, &c., valued at £30. A fortnight later, a second visit was paid by thieves, who further removed a dress suit; the property of Herbert Crouch, valued at £12, a Gladstone bag, gold pins, studs, dress shirts, pyjamas, sheets and blankets, valued at £30.
    Mrs. Mary Smith, wife of Dr. L. L. Smith, received visits from robbers no less than four times, commencing in July 1895. The total value of goods stolen was £50, and comprised: —Furniture, pictures, blankets, bedding, dinner set, ornaments, pump, fender and fire irons, saucepans, carpet, flat irons, baths, tubs, and other articles.
    Mrs. Flanagan, of Richmond, who has a country residence at Upper Beaconsfield lost in November, 1895;-Door from wardrobe, 400 gal. tank, iron piping, aneroid, shovels, forks, &c. A sledge had evidently been used in the removal of the tank as tracks were discovered outside of Mrs. Flanagan's gate.
    F. Harris' store, Officer, was entered on the night of the 13th November, 1895, and the proprietor lost sugar, rice, tobacco, cigarettes, pills, combs &c. valued at £5.
    Wm. Grieve is a builder at Beaconsfield and his wife keeps a store. In November 1895, it is alleged that Harris called at the store, where he was served by a lad. A bunch of keys, one of which would open the builder's shop, were missed shortly after Harris left, and a similar one found in accused's possession. The builders' shop was robbed of paint, sheet iron, T-hinges, colonial oven (the property of the Rev. Webb, of Armadale, which has been twice stolen), rope, tin of ironmongery, and a crowbar. . ''
    In addition to the above, which have been identified, the police have also in their possession the following goods, for which owners are awaited:-Clothes wringer, stewpan, nickel-plated garden syringe and sprayer (new), workbox, lady's silver watch, gold seal, silver snake bangle, silver watch chain, lady's new night dress, richly embroidered, large box of carpenter's tools, box of jewellery, lady's Indian silk dress and jacket, cambric handkerchief with " Ever thine " in colored letters and flowers; linen handkerchief with a large "C" in corner, coffee mill, lady's chemise, marked "S.W." glass epergue, pink lustres, gold pendant earring and brooch with doves, the dove on the brooch holding in its beak a tablet on which are the words "Forget-me-not," mail bag, coils of flexible wire used in connection with telegraph instruments, small compass, double magnifying glass, and a host of other articles.
    Harris and his wife were brought up at the Berwick police court to-day. Inspector Smyth prosecuted on behalf of the Crown, but the prisoners were undefended. The cases had not been completed when the court adjourned for the day. Harris, who pleaded not guilty, said his wife had no connection with the robberies, and she was discharged.
