  • 15 Feb 1893: THE CLAIM AGAINST THE CITY OF MELBOURNE BANK. THE PLAINTIFF RECOVERS £300 DAMAGES.
    The hearing of the action by Miss Elizabeth Jane Spence against the City of Melbourne Bank and its manager, Colin M. Longmuir, was resumed in the Second Civil Court yesterday, before Mr. Justice A'Beckett and a jury of six.
    The plaintiff owned some mining property at Grenfell, New South Wales, and alleges that the bank, through its manager, agreed to make her an advance of £3000 to carry on operation at the mines. Not more than £50 was received by her, and in consequence of the alleged breach of agreement on the part of the bank plaintiff's interest in the mines became forfeited. She claims £100,000 damages. The case for the defence is that no agreement was made with the bank, but that Mr. G. N. Turner made a contract with the plaintiff to give her a temporary advance of £150 if her securities warranted the loan.
    Mr. M'Dermott and Mr. Amess appeared for the plaintiff (solicitor, Mr. Sincook) ; Mr. Box and Mr. Williamson for the bank ; and Mr. Cussen for Mr. Longmuir (solicitors, Messrs. Malleson, England and Stewart).
    George Edward Clayton, whose evidence was taken at his residence on the previous day because he was too ill to attend the court, stated that he was security clerk to the bank. On the 10th August, 1891, the manager (Mr. Longmuir) rang for him, and witness went into the manager's room. Turner and plaintiff were there.
    Longmuir handed witness a parcel of deeds, and asked him to take them down to his room and prepare a security for £150. He said, "Miss Spence will go with you to explain the deeds in case you don't understand them." Witness went into the security room with plaintiff and examined the deeds. He wrote out a form of security for an advance of £150 to plaintiff, and returned with plaintiff to the manager's room.
    When witness showed Longmuir the document he got angry and swore at him. Longmuir said, "I didn't tell you to make this out in the bank's name." He drew his pen through the words "Manager City of Melbourne Bank," and wrote "G. N. Turner" in place of it. Longmuir initialled the alteration, and handed the document across the table to where Turner and plaintiff were sitting.
    Plaintiff signed the document without any remark. Witness had charge of all the securities, and did not enter plaintiff's deeds in any book in the bank. He left the deeds on the manager's table, and had not seen them since.
    Cross-examined by Mr. Amoss : Longmuir did not say to him "Go and prepare an undertaking to mortgage £150 and further sums." Plaintiff did not sign the document in the security room. She said nothing to witness about an advance of £3000. The document in evidence was the only form he drew up. It was all in his own handwriting except "G. N. Turner," and the signatures of the plaintiff and of the manager as witness.
    His Honor remarked that the jury would clear the case by striking out Longmuir's name. According to plaintiff's own statement, Longmuir neither ontered into the contract personally, nor did she understand him to take any interest in it. Consequently the jury would find a verdict in Longmuir's favor.
    The jury found accordingly, and judgment was entered for Longmuir with costs.
    His Honor said the jury were asked by plaintiff's counsel to say that her story was a consistent and intelligible one which they could believe, and that it had in it such inherent recommendations and was supported by such outside cirumstances that they would believe it.
    Counsel for the defence pointed out that if the jury believed the plaintiff they must come to the conclusion that the three witnesses to the defence (Longmuir, Turner and Clayton) had all committed deliberate perjury, and not only that, but that they had forged the document in evidence. Counsel for the defendants also argued that it was more probable that the lady's mind was so absorbed in her speculations that she might have been the subject of a delusion as to what really occurred. Of course, it was not the judge's province to determine between the contradictory evidence of the witnesses; that was a task for the jury. It was not even for the judge to indicate in what direction the evidence tended. The plaintiff began by suing three people, and the issue had now narrowed itself down to the bank as defendant.
    After closely reviewing the evidence, his Honor said the versions of the two sides were absolutely inconsistent. To believe Longmuir, Turner and their witnesses involved the absolute falsehood of the plaintiff. It was for the jury to say to whom they would give credit, whether the plaintiff's statement, with the corroboration, such an it was, of her brother, outweighed the evidence of the witnesses she had contradicted. If they were satisfied that plaintiff was under a delusion they must find for the defendant. If they believed she had told the truth, they should find in her favor for such a sum as might strike them as a proper recompense, not for her loss of the mines—because they did not know their value nor that plaintiff had lost her interest in them — but such damages as would compensate her for the inconvenience of not getting money from an institution which had promised to lend it.
    The jury, after deliberating for nearly an hour, returned into court with a verdict for the plaintiff for £300.
    Judgment was entered for the plaintiff for £300 and costs.34
  • 2 Sep 1916: Mr. George Edward Clayton, secretary to the Melbourne City Properties Trust Ltd., and accountant of the Melbourne Trust Ltd., died yesterday, after an illness extending over three months, at the age of 66 years. For many years he was an officer of the old City of Melbourne Bank. The funeral will leave his late residence, No. 2 Acland street, St. Kilda, for the St. Kilda Cemetery to-morrow.35

    The wedding of Mr. George Alexander Davidson, second son of Major-General A. G. Davidson, Tara Chur, Glen Tunnel, Christchurch, New Zealand, and Miss Frances Edith Ashe, third daughter of the late Rev. M. A. Ashe, formerly of Blackwood, Bairnsdale, took place at St. Andrew's Church, Brighton, on Tuesday, January 4, the Verv Rev. the Dean of Melbourne, assisted by the Rev. Reginald Stephen, performing the ceremony. The bride, who was given away by her brother-in-law, Captain Murray, wore a soft white silk gown, with a long sash and ends; large white hat, with strings and trimmings of chiffon and real orange-blossom. The bridegroom's gifts were a pearl brooch and shower-bouquet. The bridesmaids were Miss Florence Ashe and the Misses Eva and Louise Murray. Miss Ashe wore a white and green muslin frock; and hat to match.
    The bridegroom's gift to her was a diamond bangle. The Misses Murray's frocks were of cream muslin and cream hats; and their gifts were pearl brooches. After the ceremony a reception was held at Corea, Middle Brighton, the residence of Miss Glasscott (aunt of the bride), only relatives being present. The Dean proposed the health of the bride. During the afternoon Mr. and Mrs. Davidson left for New Zealand, where the honeymoon will be spent, before proceeding to West Australia. The travelling dress was of blue cloth, with soft silk vest; small white hat, with blue and white trimming. George Alexander Davidson10

  • 22 Sep 1939: WIFE TELLS OF BRIDGE QUARREL
    A story of an alleged violent quarrel which developed over a game of bridge was told by Mrs. Christine Patricia Meyer in the Divorce Court yesterday. She said that her husband's brother hit her and kept hitting her. Both her eyes were blackened. When she wanted to get a doctor her husband prevented her.
    Mrs. Meyer was granted a divorce from Karl Fitz Heinrich Meyer on the grounds of desertion. The case was defended. Fair-haired, attractive, Mrs. Meyer said that she married Meyer on January 16, 1934, and went to live with him in Bunbury. They were happy for about six months. Mrs. Meyer said that her husband had a very violent temper and there were quarrels over matters that were not very serious. During the quarrels, she said, it was usual for him to hit her. Some times the blows were hard enough to knock her down. After the quarrels, Mrs. Meyer continued, her husband always asked for forgiveness and was always very sorry for what he had done. Near the end of 1934 she said they were playing bridge at his brother's place when a quarrel developed. Meyer's brother jumped to his feet.
    "TAKE YOUR CARDS"
    "I threw the cards down," Mrs Meyer declared, and said, "Take your cards; I'm going home." She said that her husband's brother hit her and kept hitting her. Both her eyes were blackened. She kept calling to her husband to stop him. When she wanted to get a doctor her husband prevented her. She said that subsequently she went to Melbourne with her husband. She obtained a temporary position while her husband endeavoured to establish a music studio.
    Later her husband returned to Western Australia. He sent her some money for her fare to Western Australia, but she was obliged to use it to meet expenses she had incurred. She told of letters from her hus band asking her to return, but after December, 1935, he never sent any money.
    STARTED DIVORCE PROCEEDINGS
    In June this year, Mrs. Meyer continued, she met her husband on a boat at Melbourne. He said that he had come to take her home. She told him that she had started divorce proceedings, and was sur prised he had not received the papers. To Mr. Bath she said that she did not remember breaking a violin bow or breaking a picture. She did not remember throw ing some glasses of beer about. She remembered throwing the cards down. Mrs. Meyer said that she had a long conversation with her husband in Melbourne last June. He laughed when she told him that she was tak ing divorce proceedings. Karl Fitz Heinrich Meyer said that his wife was very temperamental and would get into terrible tempers. She was continually talking about her singing career.
    SOLD FURNITURE
    He sold his furniture and car by auction to obtain funds to go to Melbourne. He wanted to get the best teacher he could for her. He had never deserted his wife. There was a home waiting for her to come back to. To Mr. Hughes, Meyer said that he had struck his wife a couple of times in the face with the open hand. To "protect herself from herself" he had sometimes to hold her down, said Meyer. He said that Mrs. Meyer was not assaulted by his brother. He had never thrashed his wife in his life. Yesterday Mr. Justice Dwyer in the Supreme Court granted a petition by Christine Patricia Meyer for divorce from Karl Fitz Heinrich Meyer, on the ground of desertion. The suit was contested. Mr. T.
