  • 18 Apr 1918: (Before Mr. Justice Hodges and a special jury.) TRASK V. TRASK.
Bertie Leonard Trask, 36, of Freeman-street, North Fitzroy, tramway employe, sued Fanny Elizabeth Trask, 30, to whom he was married on 22nd August, 1905, for divorce, on the ground of her misconduct with George M'Pherson, of Freeman-street, North Fitzroy, secretary of the Federated Fodder and Fuel Union. Petitioner asked for £300 damages from M'Pherson, who was joined as co-respondent. There were five children of the marriage. Mr. Manchester was for petitionewr. Respondent did not appear. Mr Morley was for co-respondent, who denied the misconduct imputed to him. Evidence was given in support of the petition that respondent and co-respondent were seen out at nights together, and that respondent had admitted to petitioner that she had misbehaved with M'Pherson.
Co-respondent, on oath, denied allegations by witnesses that he been in Richmond Park with Mrs. Trask at night. He had one evening been on the sands with her at St. Kilda, but no impropriety occurred. Afterwards, on hearing that he was accused of misconduct with respondent, he, in company with Mr. Williams, organiser for his union, called at her house to question her on the subject. She stated to him that the had denied misconduct when accused of it by her husband, but that her husband had called in two other men, who, she believed, were a lawyer and a detective. She stated that she again denied the charge. Afterwards she said, "I had to admit it. No one came along to give me any advice. What was I to do? Co-respondent ejaculated, 'You said that?" She replied, "I did; I know I am a guilty woman."
Frederick Williams, on oath, said he heard respondent tell M'Pherson "I am a guilty woman," and she practically said she had been frightened into making an admission. She did not say the admission she made was not true.
The jury found that both respondent and co-respondent had been guilty of misconduct, and assessed damages at £200.
His Honor granted a decree: nisi, and entered judgment far £200 against co-respondent, with costs.6
