  • 1 Aug 1935: SALE OF PROPERTY.
    Messrs. Gamble, Anderson, Lamb Pty. Ltd., agents, at Berwick, proceeded against Charles Harrison, for the sum of £26/10/, being commission claimed in respect of sale of property at Berwick, during the month of June. This was a case in which a dispute occurred over defendant desiring to reduce the agent’s commission on the reduction of the price of the property.
    Harold Kent Lamb, a member of the firm in question, stated that defendant had placed the sale in the firm’s hands for disposal, at a price of £550, and desired such sale to be expedited. Following this, a client in the person of Mr. Bert Mafferzoni, called, and made an inspection of the property in his presence. Mafferzoni had stated his satisfaction, and on his second visit a sale was effected, but only in the presence of defendant and the firm’s salesman. Defendant, at this interview, had decided to reduce the amount to £530 cash, with the fowls “thrown in.” Making known his transaction with Mafferzoni of the sale, to the salesman, who resented the reduction, a visit was made to the agents’ office, when he (Lamb) objected to the procedure adopted, and eventually defendant said he was not prepared to sell unless the commission was reduced.
    Under cross-examination, witness stated that Mafferzoni had agreed for them to meet at his home on the Monday, to finalise the deal, and that was the reason why no contract had been drawn up then, otherwise he would have done so. This arrangement, however, fell through, as defendant failed to appear.
    Bert Mafferzoni said he had inspected the property, along with Lamb, in the first instance, and on the second inspection, some days after, defendant had asked him to make up his mind, as it might go off in the meantime. He also stated that he would reduce the price to £530, in the event of him purchasing, and that the agent would also have to reduce his commission by a fiver.
    On departure, he further said, if you don’t hear from me you will know the sale is off.
    Charles Harrison (defendant) verified much of the evidence given, but in addition said that Mafferzoni told him that he did not desire to prevent him in any way from disposing of the property, if he could get cash, as he had to dispose of his Kew property before he could do anything. He had offered him a reduction in event of purchase. Had told the agents that owing to the sacrifice made in purchasing price, the commission would also have to be reduced. This they had refused to do, and the sale lapsed.
    After a brief duration, the P.M., who presided alone on this case, felt satisfied that complainant had proved his case, and he made an order for £26/10/, with £9/9/6 costs.
