After John Punchard's death the annuity of Mr McGeorge was valuated, and noted that as he is a 70 year old man it should be £1968. McGeorge noted that there were also arrears of £1100, so the full annuity should be £3068. A concession was finally made by McGregor and he accepted £1579 to settle the annuity, so that the other beneficiaries would receive something out of the estate, namely £399.5.4 each for Mary Ann Punchard, John Alfred Punchard and Bessie Wood.
Bessie Wood bought the land at Upper Beaconsfield and Officer (PAK-147.148.223A.226) for £37.2.6 on 9 Jun 1908.
According to an affidavit of Joseph Hollow there was a deficiency of £67.12.1 in the estate, and he also noted that Mary Ann Punchard and John Alfred Punchard were widow and son of the deceased respectively, and that Bessie Wood, James McLean and Joseph Hollow were not related.1

Note*b 1881 John Punchard appears to have been involved with the spiritist 'religion' and had connections to Mr Ebenezer Farie McGeorge. See Lamont will case in 1881. He also left a legacy to McGeorge (will written in 1899), which would have been depleted his estate, bar for an arrangement so that the other beneficiaries would receive something.

Will*4 Mar 1899 This is the will and testament of me John Punchard of Stawell in the Colony of Victoria Ironmonger.
I appoint my friend Joseph Hollow of Elizabeth Street Melbourne Contractor and William James Blanchard of Main Street Stawell Salesman Executors and trustees of this my will placing as I do great confidence in and reliance on the judgment and experience of the said Joseph Hollow in such matters.
I devise and bequeath to my wife Mary Ann Punchard absolutely the land with the premises erected thereon and at present occupied by her together with all the furniture and effects of any kind contained therein
and I bequeath to the said Joseph Hollow all my pictured books papers and photographs contained in my sitting room and bedroom adjoining and at the back of my shop in Main Street Stawell aforesaid and I bequeath to my executors Joseph Hollow and William James Blanchard the sum of twenty five pounds each for and in lieu of their commission for acting as my executors provided they do so act and take out probate of this my will and I devise all the residue of my real estate and bequeath all the residue of my personal estate to my said executors and trustees upon trust to convert the same into money and to divide the proceeds equally between the said Mary Ann Punchard and John Alfred Punchard of Campbell's Bridge in the Colony of Victoria Farmer and Bessie Wood now residing at Currtain Street North Carlton in the Colony of Victoria after payment of my funeral and testamentary expenses and my debts including the annuity of two hundred and fifty pounds per annum in favour of Ebenezer Farie Macgeorge now residing at Monaco in France for his life such annuity of two hundred and fifty pounds being now a charge on the shop and premises at Stawell aforesaid the share of the said Mary Ann Punchard to be for her life only during which the trustees shall invest the amount and pay her the net income and should the same not amount to fifty pounds per annum they shall make it up to that amount out of the corpus of her share the amount of her share remaining at her death to be divided equally between the said John Alfred Punchard and Bessie Wood
And I declare that my trustees may and unless it can be sold to good advantage should postpone the sale or conversion of my real and personal estate or any part thereof and they may carry on my business at the risk of my estate in such manner in all respects and for so long as they think fit and that the rents profits and income to accrue from and after my decease of and from such part of my said estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings and sufficient to make up the annuity of two hundred and fifty pounds aforementioned be divided in the same manner as the residue of my estate would be if converted and I declare that there shall be at no time be fewer than two trustees acting in the trusts of my will.
In witness whereof I have hereunto set my hand to this my will this fourth day of March One thousand eight hundred and ninety nine.

Codicil*12 Jan 1901 This is a first codicil to the last will dated the fourth day of March One thousand eight hundred and ninety nine of me John Punchard of Stawell in the Colony of Victoria ironmonger having removed my residence with my pictures books papers and photographs from my shop in Main Street Stawell to two rooms erected by me on land in Haiston Street held by my sister Ann Elizabeth Buckland under Miners right title. I hereby confirm the bequest contained in my said will of such pictures books papers and photographs to Joseph Hollow in the said will mentioned and I desire my sister to have the use of for life of the two rooms in which I reside and after her death that they shall go to William James Blanchard with the land on which they are erected and to my old friend James McLean of Number 1228 Market Street San Francisco in the United States of America. I bequeath my gold watch and chain as a memento of our long friendship and in all other respects I confirm my said will.

    AFFILIATION CASE.—Mr. Sirr for the complainant, Mr. Lamont for the defendant.
    Mr. Sirr applied for a postponement, in consequence of the unavoidable absence of a material witness.
    Mr. Lamont urged that the paternity of the child was not denied, but an agreement had been entered into between defendant and complainant, discharging defendant from all further demands.
    Mr. Sirr replied that the witnesss was Dr. Wills, the father of the late explorer, from whom a letter had been received, which Mr. Sirr read, and was to the effect that his evidence would have been damaging to the defendant had he been able to attend.
    Mr. Lamont produced an agreement signed by defendant and complainant, with Dr. Wills' signature, which was to the effect that the payment of £40 should be in lieu of all further demands, and argued that if the agreement was, as Mr. Sirr alleged, null and void, the case was not then for their Worship to decide, but must be adjudicated in another court.
    Mr. Sirr, again addressing the Bench, contended that the agreement was a fraudulent one and therefore prayed for a remand.
    Mr Lament said that if their Worships decided in favor of postponement costs, should be allowed, for the case had already been heard at the Ballarat Court.
    Mr. Sirr replied that to allow costs for seducing a woman was absurd.
    The Bench adjourned the case to the 13th January.

  • 5 Nov 1907: Obituary. Mr. John Punchard, ironmonger and timber merchant, Stawell, who had been in business there since 1860 died on Saturday last, 77 years old. He built up a very profitable business and was a consistent supporter of the mining interests of the district. His wife and one son survive.15

  • 5 Apr 1907: MR. D. CUTTING.
    The reaper death, has been unusually busy this Eastertide. On Friday last Mr. David Cutting died at the residence of his son-in-law; Mr. R. Hargreaves, of 'Woodvale,' Mondongo, at the ripe old age of 81 years. The cause of death was aneurism of the heart. Previous to his departure he was an indoor patient at the Tumut Cottage Hospital, where he remained for two weeks, being assiduously attended to by Dr. Mason, the matron and nurse, of whom he spoke in the kindest terms ; but a feeling of homesickness came upon him, and on the 17th inst. Mr. Percy Hargreaves took him home. He gradually grew weaker and died very easily on the 29th inst. Born at Baxton, Sussex, in 1826, he came to New Zealand in the year 1850. He was a miller by profession from his youth and had to pay down a premium of £50 before entering on his apprenticeship, and served 5 years without pay. He followed milling in New Zealand for three years, from thence he went to Victoria and was gold mining for awhile with indifferent success. From mining he took to another sphere and travelled for a wine and spirit merchant for about three years. Resigning from that he went storekeepiug on his own account, and in those good old days he had to pay as high as £100 a ton carriage, and bought gold largely. In 1860 he left Victoria, and, coming to Deniliquin, followed milling again for some time. From thence he went to Yass in pursuit of his calling, and after following it there for awhile he came to Tumut and became assistant C.P.S. to Mr. J. F. Blake. Relinquishing that after a time, he entered Coy., millers, at the steam mill on the flat, and subsequently milled for the late Levi Mandelson & Co., and was always considered an honest and trustworthy man. Later he was associated with Mr. D. McGillivray at the Gilmore flour mill. In his latter days he indulged in industrial pursuits, and worked remarkably hard for one of his years, and would not, on account of his independent spirit, accept a comfortable home offered him by his daughter. But years told their tale, and subsequently he was forced to avail himself of her hospitable board.
    Deceased was a staunch, deserving old friend, and the worst you could say of him was, he was always "a man." His father was a hop and malt merchant in Baxter, Sussex, England, and it cost him yearly £1000 in duties. Deceased was married at Castlemaine, Victoria, in 1857, to Miss Anna Bella Petherbridge, of Devon, England, and their offspring was one son who died at two years of age, and one daughter, Mrs. R. Hargreaves, who mourns the loss of a kind and affectionate father. The funeral took place on Saturday last, his remains being interred in the Church of England portion of the new cemetery. Mr. W. H. Hoad was the undertaker and Rev. W. D. Kennedy, performed the last sacred rites.14
