HAMILTON and CO. have received instructions from Henry Lyle, Esq., to Sell by Public Auction, on the above date, on the ground, 37 ACRES OF LAND, Subdivided into Allotments of from One to Five Acres, commanding Magnificient Views of Hobson's Bay, Westernport Bay and the Harkaway Ranges, and within five minutes of the BEACONSFIELD RAILWAY STATION.

  • 18 Dec 1899: SLY-GROG SELLING. Henerge Lyle, a shopkeeper, was charged with having committed a breach of the Wine, Beer, and Spirits Act by having sold beer while not holding a licence for that purpose.
    Sub-inspector Sellenger prosecuted, and the defendant pleaded not guilty. The Bench decided to fine the defendant £30, and in addition they sentenced him to one month's imprisonment with hard labor in the Fremantle Gaol, Mr Macnamara remarking that 'sly-grog' selling would have to be put down with a firm hand.19

James Robert Smith, a private inquiry agent, residing at Coolgardie, stated that he was at defendant's premises on the night of the 9th instant. He was accompanied by Constables Devine and Murdoch, and the former went with him into defendant's shop, Murdoch remaining outside. Witness purchased some vegetables from defendant and paid 2s for them, after which be asked defendant if he had any beer. Defendant said 'yes,' and then produced a bottle from under the counter. He opened it and poured out two glasses of liquor, of which witness drank one and the defendant the other.
    No one, however, paid for the beer just then. Witness next asked for a bottle of beer to take away with him, and defendant brought out a full, unopened bottle. Witness paid 2s for the bottle of beer and the two glasses of liquor, and on going outside he handed the bottle over to Constable Murdoch. Constable Devine was in a position to witness the whole transaction.
    Constables Devine and Murdoch gave corroborative evidence.
    Henerge Lyle, the defendant, denied that the two witnesses for the prosecution had been, to his knowledge, in his shop on the night mentioned. He had, however, been unwell on the night of the 9th inst, and in consequence of his having taken some strong drink in order to relieve his illness he did not know what he had done on that night.
    He denied that he had sold beer to any person. He urged upon the Bench that he had had an injury to his head some time ago, and that at times he did not know what he did.
    This drew from Mr Macnamara the remark that if he were in such a state as that he should be placed in safe quarters.
    The Bench decided to fine the defendant £30, and in addition they sentenced him to one month's imprisonment with hard labor in the Fremantle Gaol, Mr Macnamara remarking that 'sly-grog' selling would have to be put down with a firm hand.20
