  • 22 Jul 1870: CHARGE OF FRAUD AGAINST A SHAREBROKER.
    At the City Court yesterday (before Mr. Sturt, P.M., and Messrs. Rawlings and Curtain, J. P.'s), Edward R. Daunt was charged, on summons, with having fraudulently converted 32 shares intrusted to him by O. R. Lecky to his own use. Mr. F. Stephen appeared for the proseoution, and Mr. M'Furland for the defence.
    Mr. Stephen, in opening the case, stated that defendant was a sharebroker, as was also the prosecutor. Lecky wished to get a little accommodation, and defendant told him he could get certain bills held by Lecky discounted for him, whereupon Lecky authorised defendant to discount the bills, which were for £80 and £30 respectively, agreeing to give him a commission for obtaining the accommodation. One of these bills, that for £80, was discounted by a Mr. Evans, who was to receive as collateral security 12 shares in the North Gipps Land Company, and these shares were handed over by Lecky to defendant to deliver to the discounter. There were 20 other shares to be given to the discounter of the other bill, also as collateral ¡security, and these were in like manner intrusted to defendant to give to the discounter. The defendant, however, before the bills became due, took them up without authority from Lecky, and obtained from the discounters the shares, which had in the meantime risen to almost double their former value. Defendant took the bills up before they arrived at maturity, in order to obtain the shares and sell them advantageously at their then high price. He did so sell them, and on being asked for them by Lecky, promised to pay for them, and made several offers, which were declined. On the 28th April, Lecky and defendant signed the following agreement, which had not been carried out:-"28th April, 1870. E. R. Daunt agrees to pay to O. R. Lecky the sum of £8, on the 30th April, 1870 ; also, £8 an the 3rd May, 1870, and to deliver to O. R. Lecky not later than Wednesday, the 4th May, 10 shares North Gipps Land Company, and 10 shares Alison Company, and O. R. Lecky's acceptance for £80, on receipt of payment of said acceptance of £80. E. R. Daunt also agrees to deliver to O. R. Lecky, not later than Saturday, May 7th, 12 shares North Gipps Land Company, and O. R. Lecky's acceptance for £90, on receipt of payment of said acceptance of £90. Above settlements to close all accounts to the date thereof between O. R. Lecky and E. R. Daunt." This was signed by both defendant and prosecutor. He then called Oliver Robt. Lecky, who, being sworn, stated he was a sharebroker, and in July, 1869, gave an acceptance to tho amount of £80 to Mr. Evans, to be discounted, aud sent to the defendant 12 shares in the North Gipps Land Company to give to Mr. Evans, as collateral security for the meeting of the acceptance. The defendant afterwards admitted to witness that he had sold these shares. Previous to the bill becoming due, defendant asked witness to lend him the scrip, and let him take up the bill, but witness refused. Defendant admitted having the shares in his possession, and he now retained the proceeds of the sale of them, though witness had never authorised the defendant to sell. He asked for a little time in handing over the scrip, and in consequence of that witness sent him a document produced to sign. The value of 22 of the 32 shares was £13 each. Defendant had made several offers as to reimbursing witness, who had declined unless ho received the shares or their value. There was an open account on a previous transaction, and when witness asked him for the shares defendant said that that account must be settled first, and then he asked for a little time in returning the scrip. The document produced was signed by witness.
    The document was that read by Mr. Stephen.
    Cross-examined.-Witness did not know whether defendant's name was on the bill, and witness never authorised him to take it up. The bill was never dishonoured. Witness had not funds in the bank to meet the bill when it should become due, but there was money to meet it. Witness paid defen- dant a commission for getting the bill discounted. At the time the agreement produced was signed, witness could not say whether he knew that the scrip was sold. Would not swear that he did not then know it. The shares were security, inasmuch as the discounter could have realised on them upon obtaining an execution on the bill. Defendant told witness at one time previous to the 4th May, that he had sold the scrip, but he had told witness so many untruths about it that witness did not know whether to believe him. Twelve other scrip in the same company might have satisfied witness, but now they had fallen very low, whereas they were at the time of the bill becoming due with £17 each. If the shares had fallen in value at the time of the bill becoming due witness would have had to sell other shares to meet it. Witness did not know that Daunt drew the bills, or that he was going to draw them. It was common for the agent to draw the bills. There were two bills discounted for witness, and they were taken up by defendant about a fortnight previous to their coming due. The agreement was merely put on paper, in order to fix the defendant, so that he should not shuflle out of it, but it was not a settlement between witness and defendant relative to the scrip. If defendant had kept that agree- ment these proceedings would not have been brought.
    Thomas Evans deposed that before the bill for £80 discounted by witness became due, it was turned over to Daunt, and he believed destroyed. The 12 shares in the North Gipps Land Company were also handed over to Daunt.
    This concluded the case for the prosecution.
    Mr. Sturt, P.M., said that the fact of the agreement stating that prosecutor should re- pay the defendant for delivering the shares, made it a civil contract, and therefore put the prosecutor out of court. The case must be dismissed, but he was not surprised that the prosecutor took the course he did, considering how closely the transaction verged upon the criminal.
    Mr. M'Farlaud was about to point out some fact to the Bench, when he was informed that the case had been dismissed.19

    It is of interest that the McDonald rent in 1874 was $300 per annum, but the moneys lent, rent and interest amounted to £4835. This appears to indicate that WJT Clarke had lent money to the McDonalds to develope the property. If we assume that the loan was used to build a cheese factory this project dates back before 1874, and probably to the 1860s."
