  • 16 Aug 1906: ACTION FOR DIVORCE. A HUSBAND'S PAINFUL STORY.
    Action for divorce was taken yesterday in the First Civil Court, before Acting Justice Chomley, by William Iden Henham, residing at the Victoria Coffee Palace, against his wife, Annie Henham, on the ground of misconduct with William Brisbane, of Hawthorn-grove, Hawthorn, who was named as co-respondent. A claim for £3,000 damages was also put in, thus making it a jury case, but the petitioner's counsel abandoned the claim, and the jurors were discharged. Mr L. S. Woolf (instructed by Messrs Farmer, Turner and Thompson) appeared for the petitioner. Mr. Maxwell for the respondent, and Mr. Wanliss (instructed by W. H. Flood) for the co-responent.
    The petitioner stated that he was married to the respondent on 4th June, 1883, at Berwick, Victoria, and there were five children of the marriage. They lived together first at Gembrook, and afterwards at Berwick, Lang Lang, and Warburton. In 1895 the respondent first met the co-respondent at Berwick, while the former was visiting that town in order to be near a doctor for one of her children. Three years later the co-respondent obtained for the petitioner an offer of purchase for the property, on which the petitioner and respondent were living at Lang Lang, one ot the terms of the offer being that immediate possession should be given. The co-respondent urged petitioner to accept the offer, and he agreed to do so. His wife then informed him that the co-respondent had suggested that in the mean time she and the children should go to Melbourne, and that she should act as house-keeper for him. The petitioner offered no objection, and his wife thereupon went to Melbourne with her three children and kept house for co-respondent at Simpson-street, East Melbourne. Petitioner joined her there later, and subsequently they returned to Lang Lang. The co-respondent came to Lang Lang to stay with them, and proved to be very friendly with the respondent. He would come to Lang Lang on Saturdays and return to Melbourne on Mondays. Later he came more frequently, bringing buyers to inspcet properties in the district. He told petitioner he regarded the respondent as a great assistance to him in selling properties, and said she was the best clerk he had. During the year 1900 the respondent, with his permission took the children to Melbourne, and stayed for some weeks in St Kilda, where the co-respondent lived with her as a boarder. Until the beginning of 1901 he had never suspected that there was any intimacy between the two. At the time of the Prince of Wales's visit respondent wanted to come to St Kilda and live as before, with co-respondent as a boarder. Petitioner objected to her doing so but she came to Melbourne against his wish. After she returned to the country the co-respondent continued his weekend visits, and often stayed up late at night talking to the respondent in the front room. This went on till 1902, when petitioner learnt that the people in the district were beginning to talk about them. He remonstrated with respondent about her extreme friendliness with the co-respondent, and, after some hot words between them, he caught her by the shoulder and said, "I could strangle you for the way you go on with that man." After this petitioner left him but subsequently came back to him. In 1904 petitioner observed from his Wife's manner that she did not wish to cohabit with him, and their connubial relations were never afterwards renewed. Towards the end of 1905 she made no secret of her affection for the co-respondent. At the present time he charged the respondent and co-respondent with living together.
    Owing to the withdrawal of the claim for damages the defence was not proceeded with, and a decree nisi was therefore granted with costs. William Iden Henham20

    In the First Civil Court to-day, before Acting Justice Chomley, William Iden Henham, 52 years of age, a farmer, sued for a divorce from Annie Henham (42), on the ground of her misconduct with William Brisbane, of Hawthorn Grove, Hawthorn, who was joined as co-respondent. Originally a claim for £3,000 damages was made against the co-respondent, but counsel for the petitioner abandoned that, leaving the case to his honor.
    The petitioner, who was a native of Kent, England, was married to the respondent, who was born at Aldinga, South Australia, on June 4, 1883 at the Church of England, Berwick, by the Rev. J. M. Easterling. There were five children as a result of the marriage, whose ages ranged from 2 to 21 years.
    A number of witnesses having described the conduct of the respondent and co-respondent on various occasions, his Honor said he found, sitting as a jury, that there was evidence of misconduct between them, and granted a decree nisi, with costs. William Iden Henham, William Brisbane22

    At the Warburton court on Saturday William J Henham, of West Warburton, was summoned to show cause why he should not be ordered to contribute towards the cost of pensions granted to his father and mother. From the defendant's own evidence it appeared that he had within the past six months paid £3000 in cash for 170 acres of land, cattle and farming plant. In spite of this admission he contended that he could not contribute towards the keep of his aged parents. Henham was ordered to pay 16s per week—8s for each parent.

    At St John's Cathedral last evening the marriage was solemnised of Mr. Frederick Ernest Brisbane (second son of the late Mr. William Brisbane, Scotland, and Mrs. G. Forrest, Victoria) and Miss Kitty Young Shepherd Bullen (second daughter of the late Mr and Mrs. John Shepherd Bullen). Dean Barrett officiated, and Mr. George Sampson presided at the organ. The bride, who was given away by her brother (Mr. Frank Bullen), wore a frock of ivory taffeta, fashioned on mid-Victorian lines, with graduated frills reaching to the feet. Her embroidered tulle veil was in cap effect, and held with a circlet of orange blossoms, and she carried a Victorian posy of pink and white roses. The Misses Eileen Bullen (sister of the bride) and Ethel Robertson were bridesmaids, and they were dressed in shell pink and apple green mariette respectively, fashioned on Victorian lines, and finished with bustle bows. They wore crinoline hats in the same shade as their frocks, and carried posies. Mr. W. Leslie Blackford was best man, and Mr. R. D. McLuckie was groomsman. A reception was held at the brde's home, where Miss Rosa Bullen received the guests wearng a frock of wine tone Marocain, with a hat to harmonisc. Mr. and Mrs F. E. Brisbane will leave to-day by the Katoomba for Melbourne and Mt. Buffalo. For travelling the bride chose a saxe blue face cloth costume, with a felt hat to tone. Mr. and Mr. Brisbane will reside in Melbourne. The bouquets were the work of Petersen's, Queen Street. Kitty Young Shepherd Bullen7

    The death has occurred in the Melbourne Hospital of Mr. Michalow Salmon, 75, retired commercial traveller, who lived at Glen Eira-road, East St. Kilda. He was admitted on October 15 suffering from a fractured thigh and shock. He informed the police that while he was walking down the steps at Flinders-street station some one brushed against him, causing him to fall and roll down the steps. His leg snapped as he fell.9

Memo for the Surveyor General,
The question for decision herein is not, I think only the bare legal aspect of the case but the policy involved in the issue of licenses under Sec 49 L.A.1869 to married women.
In the case of Mrs Walker the late Minister (Mr Gillies) directed the refusal of the Application on the opinion of the late Attorney general (Mr Kerferd) that Sec 21 part II L.A.1869 prohibited the issue of such license. I do not think Mr Copingers opinion can be held against that of the Chief Law Officer of the Crown and therefore the law as at present interpreted is against the issue of the license.
With regard to the policy of such issue I would submit that in nive cases out of ten the husband would certainly derive benefit directly from the wife's selection and the license would virtually be his. Ashe could also hold a license in his own name it would certainly lead to a grave evasion of the provision of the 49th Sec L.A.1869. In the cases of margaret Anderson and of Ellen Kitz, I am informed these ladies were married at the time they made application in their maiden names. Their applications therefore were to say the least of it most disingenious and misleading. If the issue of these licenses is to be upheld then there can be no reason why Mrs L.L. Smith shoudl be treated differently.
I beg to be instructed definitely respecting the issue of licenses under Sec 49 L.A.1869 to married women.

Prior to obtaining the valuation of improvements in this case as directed by the Hon. the Minister, I would desire to be instructed upon the question of selection under Sec. 49 by married women.
The practice of the Department hitherto, has been to refuse all such applications unless the applicants possessed a protestion order or were judicially separated from their husbands.
Lately however several applications made by married women for land at Pakenham have been granted notably Mrs Salmon and Miss Kitz - in this latter case, the applicant although married signed the application in her maiden name and thus it was passed. In Mrs Salmon's case, she also, signed her maiden name Anderson, but as I was aware that she was married, made some enquiries upon the subject and was informed by Mr Murrah and mr Walstab, that the application could go on in her married name as a legal opinion in favour of such a course had been obtained some time before in a similar case; and subsequently the Hon. the Minister gave a similar direction.
The land applied for by Mrs Smith has been thrown open for selection in the usual way but has not been applied for again, and might therefore I think, if the above views be upheld, be now granted to her, as her application was refused in the first instance under a misapprehension as to its legality.
I presume that the direction in this matter will similarly affect applications for transfers to married women.
With regard to Mrs Salmon, I may mention that I believe that certain property which was left to her by her first husband, was prior to her 2nd marriage, absolutely settled on her and on mrs Kitz's application the District Surveyor has made a memo that she "holds property in her own right under protection order and that her husband is alive" (name J C F Brache).
Both Mrs Salmon's and Mrs Brache's husbands hold licenses under Sec. 49 for land adjoining their wives' allotments.

  • 11 Oct 1939: Fatal Cart Accident. Evidence At Inquest. CANNING DOWNS ROAD TRAGEDY
    The death of John Henry Brisbane (71), who resided with his wife and family on the old Stanthorpe-road and who was admitted to the Warwick District Hospital on September 16 following injuries received when the cart he was driving overturned on the Canning Downs-road, about 2½ miles from Warwick, was the subject of an inquiry by the Coroner (Mr. W. P. Wilson, P.M.) Witnesses were examined by First-Class Sergeant Mairs.
    Constable A. A. Zeller said Brisbane was driving a horse and cart and was returning about 5 p.m. on September 16 with a load of sacchaline from a Mr. Martin's property. He had just crossed a culvert when the cart overturned and he received a broken right arm and left leg, which subsequently caused his death. Inquiries witness had made indicated there were no suspicious circumstances.
    An eye-witness, Mrs. E. H. Free, of Canning Downs-road, said the horse was travelling at a walking pace when it started to plunge and rear and the cart turned over on its side down the embankment. Just previous to the accident a utility had passed the cart, but she did not see the horse shy or take fright.
    Cecil Claude Newman, master baker of Tannymorel, said he was driving a utility and passed the cart, after slowing down and giving it a wide clearance. Some distance farther on his child, who was in the utility with him, said : "Daddy, that cart's tipped over." Witness went back and found that the cart was overturned. Except for his head and shoulders, Brisbane was underneath the cart. Witness dragged him free and Brisbane said, "My horse put me over the bank and has broken my arm." Witness was satisfied that his utility had not frightened the horse.
    Evidence was also given by Mrs. Ethel Brisbane, deceased's widow.
    The inquest was closed.6
