    Edward Thual was charged with being on the premises of Messrs J. Miller Anderson and Co., of Hindley-street, on September 29, for an unlawful purpose. James Fisher, an employé of the firm, stated that on going to the premises about 8 o'clock on the day in question he discovered the defendant in a dust box at the back of the shop. The man was covered with dust, and had a black eye.
    Some piping under a window 13 ft. from the ground had been broken down, and a pair of steps were lying near the wall. The yard was enclosed by an 8-ft. rate from Gresham-street, but one witness thought that the de fendant had climbed over an outhouse near the gate, and thus got into the yard. The man was taken to the Hospital, and on being searched a brass knuckle-duster was found upon him. The defendant, who is a French Canadian, said that he had only been in town for about three weeks. He had been employed at several places as cook, but he had been drinking on Monday. Inspector Sullivan said that the man had excellent testimonials. Remanded until October 5, whan he was discharged with a caution.2

  • 7 Sep 1910: Glebe.—A warrant has been issued by the Children's Court Bench, Paddington, for the arrest of Edward Thual, charged with disobeying a magisterial order for the support of his child (£2 12s. 6d and 6s. costs due). He is 49 years of age, 5 feet 6 or 7 inches high, stout build, fair complexion, fair hair, turning grey, clean shaved, blue eyes, some artificial teeth in upper jaw ; dressed in a brown tweed sac suit, and black hard hat ; a cook.4
  • 23 May 1911: Divorce Court. FRIDAY, MAY 19. THE COOK'S JEWELLRY.
    Mary Alicia Thual, aged 37 years, of Acland-street, St. Kilda, launderess, petitioned for a dissolution of her marriage with Edward Thual, aged 48 years, a cook by occupation. Mr. Woolf (instructed by Mr. J. B. McConkey) appeared for the wife. The ground of the petition was desertion. There are two children of the marriage, which took place on December 26, 1898. The husband, at the time of the marriage, was a cook at a college in Melbourne. Soon after the wedding they left for Sydney, and went thence to Charters Towers (where the wife for two years worked as a laundress). From 1903 to 1906 they lived in Brisbane. Then her husband unexpectedly announced his intention of going to Sydney. The wife, in packing his boxes, found a quantity of jewellery. She asked him where he had got it, and he had said that he had bought it. She did not believe him, but she packed the jewellery. When he got to Sydney he wrote to say that he had stolen the jewellery, and did not intend to return. Soon after she got a letter from her husband, inviting her to Melbourne. In March, 1906, she arrived here, and the next day her husband was arrested, hence sent back to Brisbane, where he was sentenced to six months' imprisonment. In March, 1907, he wrote a letter, giving some account of his life in gaol, and in the next letter he said that he was going for a trip, and that he hoped the Queensland Government would not bring him back again. She heard from him only once after that, and that was indirectly. Letters which she had written to him had been returned through the Dead Letter office. A decree nisi, with costs, was granted.   • 22 Sep 1900: The Confetti nuisance. A Canterbury hawker fined at Ramsgate. The Ramsgate authorities have determined to put down the use of confett, feathers and toy brushes at the annual regattas. This year notices were issued warning persons against the hawking of these articles in certain streets of the town. Mark Berry, a Canterbury hawker, however, disregarded the warning, and did a brisk trade until he was taken into custody by a police constable. At the petty Sessions on Wednesday he was fined 15s. 6d, including costs.10
  • 22 Jan 1901: DRUNKENNESS. For being drunk on licensed premises, namely Williams' Dining Rooms, St Peter's Street, Mark Berry was fined 15s. inclusive at the Canterbury Police Court on Thursday. The case was proved by P.S. Ives and P.C. Deal.11
  • 31 Aug 1901: CANTERBURY POLICE COURT.
    Obstructing the thoroughfare.
    Mark Berry pleaded guilty to causing an obstruction in Watling Street, on the 8th August. Superintendent Farmery said that defendant was near the Dine John with a barrow, from which he sold confetti and switches. He caused an obstruction, and was told to move on, but he remained from 9.30 to 10.15. In fairness to defendant he might say that he had never refused to move away before. The bench fined defendant 10s. and 10s. 6d. costs, or seven days'.12
  • 27 Jun 1903: CANTERBURY POLICE COURT. FRIDAY.
    Before Mr. G. J. Drury (in the chair), Mr D. Amos, Mr W. H. Nethercliff, and Captain Stead.
    DISMISSED.
    Mark Berry, a pedlar, was summoned at the instance of the National Society for the Prevention of Cruelty to Children, for cruelty to his four children.
    Inspector Hillyard applied for an adjournment for a week, as the solicitor engaged for the prosecution was unable to attend that day.—The Magistrates, however, refused to grant the adjournment on that ground.
    Inspector Hillyard stated that on 13th December last he received a complaint concerning defendant, and he visited his house, 23 St Peter's Lane, in the evening. He saw defendant's wife and four children, Mark Berry, aged 10, John, aged 9, Robert, aged 6, and James, aged 4. The house and bedding were fairly clean. The children were in a room by themselves, and were fairly clean and clothed, and fairly well nourished. There was no firing and no food in the house. On the 5th of the present month the wife came to witness's office, and made a complaint, in consequence of which he visited the house the next day, and saw Mark, Robert and James. James was ill in bed with measles, and Robert appeared unwell. The children appeared thinner. There was no food in the house, and witness supplied them with some.
    In reply to the Magistrates' Clerk, witness said the ground of the complaint was that defendant neglected to provide maintenance for the children.
    Henry Christian Sutton, relieving officer, having given evidence, the Chairman said the Magistrates had decided to dismiss the case, but told defendant he must remember he was responsible for providing food for his children. , Mary Ann Berry, Frederick Mark Berry, James John Berry, Robert Raymond Berry, James Berry13

    Before Mr. G. J. Drury (in the chair), Mr D. Amos, Mr W. H. Nethercliff, and Captain Stead.
    DISMISSED.
    Mark Berry, a pedlar, was summoned at the instance of the National Society for the Prevention of Cruelty to Children, for cruelty to his four children.
    Inspector Hillyard applied for an adjournment for a week, as the solicitor engaged for the prosecution was unable to attend that day.—The Magistrates, however, refused to grant the adjournment on that ground.
    Inspector Hillyard stated that on 13th December last he received a complaint concerning defendant, and he visited his house, 23 St Peter's Lane, in the evening. He saw defendant's wife and four children, Mark Berry, aged 10, John, aged 9, Robert, aged 6, and James, aged 4. The house and bedding were fairly clean. The children were in a room by themselves, and were fairly clean and clothed, and fairly well nourished. There was no firing and no food in the house. On the 5th of the present month the wife came to witness's office, and made a complaint, in consequence of which he visited the house the next day, and saw Mark, Robert and James. James was ill in bed with measles, and Robert appeared unwell. The children appeared thinner. There was no food in the house, and witness supplied them with some.
    In reply to the Magistrates' Clerk, witness said the ground of the complaint was that defendant neglected to provide maintenance for the children.
    Henry Christian Sutton, relieving officer, having given evidence, the Chairman said the Magistrates had decided to dismiss the case, but told defendant he must remember he was responsible for providing food for his children.
