  • 29 Feb 1928: PROMISSORY NOTE ACTION. Judgment for Plaintiff.
    An action on a promissory note was heard by Judge Foster in the County Court yesterday. Archibald Francis Witham, of Queen-street, Melbourne, auctioneer, claimed from Solomon Lyons, of Park-street, St. Kilda, commission agent, £150, being the balance due on a promissory note given by Lyons. Mr. Irvine (instructed by Messrs. Dillon, Nichols and Starke) appeared for plaintiff, and Mr. Morrisson (by Messrs. Westley and Dale) for defendant.
    Evidence was given that Lyons was assisting a man named McDonald to take over the Pine Grove Hotel, Bcaconsfield, and the sum of £300 was wanted as a deposit. Plaintiff agreed to lend the money on a promissory note, with a security of a third mortgage on the hotel property, for £350. Witham acquired the second mortgage of £500 on the hotel, and when McDonald became insolvent Witham realised on his mortgages, and now claimed £150, being the balance due on the loan.
    McDonald had paid on behalf of Lyons £200 off the amount of the loan.
    Judgment was given for the plaintiff for £150, with costs. William Macdonald5
