    The Story of the Lists
    FAMILY WITH A TRAGIC HISTORY
    To the student of human nature it must be apparent that the subject of engrossing interest in the terrible tragedy of the Melbourne Botanic Gardens is not the strategy by which Norman List stalked and shot his victims, but the mental history of the man and of his family.
    It has been stated that List was involved a few years, ago in a shooting episode at Cockatoo, a township in the Dandenong Ranges, which, viewed in the light of this Gardens tragedy, takes a sinister aspect.
    The story was that List, while out rabbit shooting with a companion named Hugh Bell, accidentally shot him while going through a fence.
    The facts of the case as ascertained locally are of greater significance. It was not Norman List who figured in this incident, but his younger brother, Wilfred.
    WILFRED, at the time of this occurrence, in Sept., 1915, was 18 years old. He was like his brother, Norman, then 22, of a wild and romantic disposition. His favourite game was playing at Indians among the tree ferns, and he habitually carried a dagger, with the apparent desire of impressing his comrades with his prowess. The family were divided by a quarrel which had occurred in 1912 between the father and mother. The father, it is said, had bought a block of 80 acres at Cockatoo in order to remove bis growing sons from the temptations of the city, and when the series of family quarrels culminated in a breach the mother removed to Cockatoo and lived with her children, while List remained in town paying them occasional week-end visits.
    Remarkable Happening
    The mother, who is now dead, was reputed to be eccentric. The altercations of her two sons may be traceable to her.
    The episode of the death of Bell was remarkable. Bell, who was 29 years old, was living with the Lists about two miles from his own home. His people were sawmillers. The Lists' were growing potatoes and cherry fruits and conducting a boarding house. Apparently they were people who did a little of everything, but never made a success of anything.
    Bell was engaged to Bertha List, the eldest daughter, and was working the place on shares with Wilfred. Wilfred, it is said, disliked the idea of Bell marrying his sister.
    The tragedy happened in that afternoon of Sept. 22. List and Bell had been weeding strawberries at the corner paddock, about a mile from the house, and late in the afternoon they set out to return home through the timbered gully, known as Pennyroyal Avenue. Bell had a gun, which he habitually carried for shooting rabbits.
    The news was broken to the List family by Wilfred, who returned home with the information that Hugh Bell had been shot. Members of the family went to the spot and carried the body home, where they washed and laid it out and then informed the police. Constable Brooker, of Emerald, four miles away, went over and questioned Wilfred List, who, at first said that Bell was chasing a rabbit down the hill when he tripped and the gun went off. The constable pointed out that Bell had been shot in the back of the head, and that this could not happen in the way he had stated, whereupon List altered his story and said that he (List) was carrying the gun and had tripped, owing to one of his boot soles becoming loose, causing the gun to be discharged as he stumbled forward. He said that he saw Bell fall and thought that he was pretending to be shot, and when he did not get up he went to him and found that he was dead.
    Interesting Parallel
    The circumstances were reported to a local Justice, who held an inquiry and found that death was accidental.
    The lad at the inquiry gave the second explanation, which was accepted, as it was the only evidence that could be submitted.
    On the point, the case of the Ringwood murder, committed by Edward Landells many years ago, is an interesting parallel. Landells had taken a companion into tho scrub, shot him, and left the body lying near a log. The body was identified through the accidental discovery of a letter in the lining of the coat, and Landells was interviewed by detectives. They really knew nothing of his movements; but, leading him to assume that he and his victim had been traced to Ringwood on the day of the tragedy, they put a hypothetical case to him that the man had been shot accidentally by Landells, who had then been seized with panic at the thought of possibly being charged with murder. Landells, who was unaware that the detectives had no evidence against him, accepted this theory, and described the occurrence from that standpoint.
    Left the District When he had done so he was confronted with the fact that his victim was shot from behind and above in such a position as could not possibly fit his explanation. The discrepancy sent him to the gallows.
    List exhibited remarkable unconcern at the death of Bell. He left the district about three months afterwards and it was rumoured that he went to South America. His elder brother, who had travelled widely in India and elsewhere, was in Mexico at the time.
    In view of this episode the List case becomes still more a problem for the criminal alienist. The List family after the tragedy behaved most strangely to the Bells, refusing to recognise them, and the outcome of the new feud that arose was a lawsuit. In which the Bell family obtained a verdict against the Lists for the recovery of the dead man's property. Hugh Howard Bell10

    I, ALMA LYDIA BARNES of 51 Alfred Street Prahran in the State of Victoria Married Woman make oath and say :-
    1. THAT I am the abovenamed Petitioner.
    2. THAT on the 13th day of May 1927 I was lawfully married to William Ernest Barnes the abovenamed Respondent at the St.Kilda Methodist Parsonage by the Reverend A .Hambly according to the rites of the Methodist Church.
    3. That the said Respondent has since the celebration of the said marriage been guilty of a repeated act of adultery.
    4. THAT I am of the age of twenty six years and was born at Richmond in the State of Victoria. The Respondent is of the age of thirty one years or thereabouts, and was born at West Melbourne in the State of Victoria. Both the Respondent and I are domiciled in the State of Victoria.
    5. THAT before the said marriage I was a spinster and earned my livelihood as a tailoress. Since the Respondent and I finally separated as hereinafter stated I have lived with my sister and been supported by the rent accruing from a property at Edwards Street Elsternwick. Prior to the said marriage the Respondent was a bachelor, and earned his livelihood as a gardener, and since the said marriage he has carried on the same occupation, so far as I am aware.
    6. THAT there was one child of the said marriage, Kenneth William Barnes, a male, who was born on the 29th day of September 1930 at Richmond in a private hospital, and who is living with me.
    7. THAT after our said marriage the Respondent and I continued to live at our respective homes, and kept our marriage a secret.
    I went on working as a tailoreas and Respondent continued in his employment as a gardener. My family were opposed to the marriage, as they considered that the Respondent used to drink too much, and that he had not a sufficiently good position on which to marry.
    Ultimately my family discovered that I was married, because my married name appeared on the Electoral Rolls. In October 1928 I purchased a house at Edwards Street Elsternwick, where the Respondent and I commenced to reside. At this time I had saved about £200. My father contributed £200, and a mortgage over the house was given to the State Savings Bank. The Respondent contributed nothing towards the purchase of the house. All our furniture was hired under Hire Purchase Agreement. We had not been living together long before I discovered that my husband drank to excess, and he would often come home in a drunken condition. The Respondent was at this time earning 14/- per day or thereabouts in his employment as a gardener, but he used most of the money to buy drink and gamble at the races, and we got into debt. So bad was the position that my father had to give me money to buy clothes. On some weeks the Respondent used to give me nothing at all for the housekeeping, and on other weeks only a few shillings, and some times a £l or £2. He refused to give me any money to pay the Bank, and we got far into arrears.
    I used to try to persuade the Respondent to stop drinking and to save his money but although he promised me that he would, he failed to do so. He then said that if he had a son he would be better, but after our child was born he did not reform in any way. At the time of my confinement the Respondent had no money to meet the expenses and I had arranged for the money to be advanced by my father, although I did not tell the Respondent. Just before the birth of the child however, Respondent won £50 in Tattersalls, and out of it he was able to pay the expenses.
    8. The Respondent continued drinking to excess, and eventually about July 1931 I told him that we could not carry on any further as we owed money all round, and continued to get more and more into debt, and suggested to him that we should let the house.
    I also told him that we could not keep the house going any longer, as our payments were far in arrears to the Bank, and that the Bank would take the house unless they received some money. Respondent then suggested that we should go into a room, which he suggested we could get at 12/6 per week. I told him that the payments on the house were only 13/6 per week, and that as he could not keep these payments up, I did not see how he could pay 12/6 per week for a room. I also told Respondent that I thought it would be better if we lived with our families until he could pull himself together, and was in a position to keep us. I then went to live with my sister Mrs. Derrick at Alfred Street Prahran, where I am now residing. At this time my father paid off the Mortgage on the house at Edward Street Elsternwick, so that I could obtain an income from it. I have since that date been receiving £1 per week rent, but out of this I have to pay the rates and taxes.
    I am also earning a few shillings a week from sewing. From July 1931 up to Christmas 1931 Respondent used to ring me up about once a fortnight, and ask me to meet him as he wanted to see the child. He also promised that if I would meet him, he would contribute something towards the support of the child, and on occasions he used to give me a few shillings to buy patent foods which were very expensive, and which I could not otherwise afford.
    On many of the occasions that I met the Respondent he was the worse for liquor. He occasionally repeated his suggestions that we should take a room together, but when I questioned him he had to admit that he was still drinking and could not afford to keep a room going. On several occasionshe suggested that we should meet at night and have sexual relations, but in the circumstances I refused to do that.
    9. From Christmas 1931 I never saw Respondent until May 1932 when I was at a dance. He also attended it in company with a girl. When he saw me he came up to me and said, "That's my girl over there, what are you going to do, make trouble?"
    I said "No." I saw Respondent at dances on several occasions after this, in company with the same girl. Later at a dance Respondent came up to me and said "Would you like to meet my girl? I had no alternative but to agree, and he brought the
    same girl over and introduced me to her as "Alma, an old friend of mine." He introduced the girl to me as "Lil". I asked Respondent different questions about her, and he told me that her name was Alexander. After this I attended at one or two dances where the Respondent and the girl Alexander were present. At about this time in June or July 1932 I met the Respondent at a dance, and he asked me to bring our child to St.Kilda, as he would like to see him on the following Saturday, if it were a nice day. I agreed and met Respondent but he was very drunk. He was argumentative and noisy, and I had to leave him, and told him that I would not see him again. At about the end of November 1932 I was informed that the Respondent and the said girl were living together somewhere in St.Kilda. I thereupon made enquiries and have ascertained that the Respondent has been living in adultery with the said girl at an apartment house in Barkly Street St. Kilda, where they have been living as man and wife from about the month of August 1932. I am informed and verily believe that they are still living as man and wife at the said address.
    10. The first time that I suspected the Respondent of any improper or adulterous intercourse was at or about the end of November 1932.
    11. I do not know the origin of the Respondent's acquaintance with the said Lily Alexander, save that I believe that he "picked her up" at a dance.
    12. Save as aforesaid there has been no separation between the Respondent and me, and no Deed of Separation has been executed by us.
    13. Sexual cohabitation between the Respondent and me finally ceased in or about July 1931 at the time when we left the said property at Edwards Street Elsternwick.
    14. I distinctly and unequivocally deny all collusion or connivance past or present direct or indirect with the Respondent or any person liable to be made Respondent.
