The question for decision herein is not, I think only the bare legal aspect of the case but the policy involved in the issue of licenses under Sec 49 L.A.1869 to married women.
In the case of Mrs Walker the late Minister (Mr Gillies) directed the refusal of the Application on the opinion of the late Attorney general (Mr Kerferd) that Sec 21 part II L.A.1869 prohibited the issue of such license. I do not think Mr Copingers opinion can be held against that of the Chief Law Officer of the Crown and therefore the law as at present interpreted is against the issue of the license.
With regard to the policy of such issue I would submit that in nive cases out of ten the husband would certainly derive benefit directly from the wife's selection and the license would virtually be his. Ashe could also hold a license in his own name it would certainly lead to a grave evasion of the provision of the 49th Sec L.A.1869. In the cases of margaret Anderson and of Ellen Kitz, I am informed these ladies were married at the time they made application in their maiden names. Their applications therefore were to say the least of it most disingenious and misleading. If the issue of these licenses is to be upheld then there can be no reason why Mrs L.L. Smith shoudl be treated differently.
I beg to be instructed definitely respecting the issue of licenses under Sec 49 L.A.1869 to married women.

Prior to obtaining the valuation of improvements in this case as directed by the Hon. the Minister, I would desire to be instructed upon the question of selection under Sec. 49 by married women.
The practice of the Department hitherto, has been to refuse all such applications unless the applicants possessed a protestion order or were judicially separated from their husbands.
Lately however several applications made by married women for land at Pakenham have been granted notably Mrs Salmon and Miss Kitz - in this latter case, the applicant although married signed the application in her maiden name and thus it was passed. In Mrs Salmon's case, she also, signed her maiden name Anderson, but as I was aware that she was married, made some enquiries upon the subject and was informed by Mr Murrah and mr Walstab, that the application could go on in her married name as a legal opinion in favour of such a course had been obtained some time before in a similar case; and subsequently the Hon. the Minister gave a similar direction.
The land applied for by Mrs Smith has been thrown open for selection in the usual way but has not been applied for again, and might therefore I think, if the above views be upheld, be now granted to her, as her application was refused in the first instance under a misapprehension as to its legality.
I presume that the direction in this matter will similarly affect applications for transfers to married women.
With regard to Mrs Salmon, I may mention that I believe that certain property which was left to her by her first husband, was prior to her 2nd marriage, absolutely settled on her and on mrs Kitz's application the District Surveyor has made a memo that she "holds property in her own right under protection order and that her husband is alive" (name J C F Brache).
Both Mrs Salmon's and Mrs Brache's husbands hold licenses under Sec. 49 for land adjoining their wives' allotments.

In answer to your communication of the 1st inst. respecting my 20 acres selection in the Parish of Pakenham and that as a married woman I can not hold land under license, I am very sorry having acted under a misunderstanding, which is, that any married woman could take up land under Sec. 49 - in her maiden name. As I have made considerable improvements already und the present contract is not quite finished yet, I might have experienced a considerable loss and I am tahnkful to the Department for allowing the valuation of improvements in my favor at the termination of the present license.

  • 15 Aug 1888: THE COBLENTZ VINEYARDS
    Another of the Murray vignerons who has sought to worthily maintain in the world's show the credit of his district is Mr C. Brache, of the Coblentz Vineyard, not far from Wahgunyah. The names of vineyard and vigneron alike identify Mr Brache as belonging to a people who have done a very great deal indeed for the wine growing in Victoria. The trophy is a model of good taste as well as enterprise. The centre is an old fashioned wine cask, with curved bunches of grapes, something richer than the cooper cares to spend his time over in these days of devotion to the practical. Upon the top are casks in miniature, with a fan design of small claret bottles. The cask is borne upon the backs of four black swans carved in wood. Otherwise the exhibit is a massive platform in imitation ebonite, brightened with a touch of gold. The four corners are as many square piers, topped with three side towers of labelled bottles in which the vineyard wine is tastefully put up, and as a crest to each tower a blue silken bannerette ; altogether, as may be gleaned from this brief description of it, but will be much better realised in an inspection of it, a trophy worthy the merit of Australian wine. Again, it is to be deplored that, while wide spaces are, in a spirit of all-round fairness it may be admitted, allotted to exhibits that may be seen to equal perfection every day in every important town in Australia, the vignerons who have played their part on the occasion with infinite credit should sacrifice something in effect by a too close grouping. Mr. C Brache, the owner of Coblentz made an attempt some years ago to establish in Wahgunyah a district cellars, but a project which a few years hence will be essential to a fast increasing production then languished for want of support. Wine maturing will be as much an institution in the future as wine producing, but can only become a success when production has increased far beyond its present limits. No doubt, with public companies formed to buy up large stocks of young wine, production would receive a stimulus, since a much less capital would be required to establish and equip a fairly large vineyard. In the present stage of development, however, it is perhaps as well
    that each vigneron should be responsible for the character of his wines, which are less likely to suffer with individual competition than where produced under a co-operative system. Having, however, tried the experiment before its time, Mr Brache turned his attention to growing, and the result is the Coblentz Vineyard, about the success of which there never may be any doubt. The area of 100 acres on the slopes of the Murray banks might almost be an extension of its near neighbour, All Saints, and what has been said of the advantages and defects of the one applies equally to the other. That the defects are by no means prominent is best shown perhaps in the fact that the last vintage, by no means the best experienced along the border, the Coblentz yield was 275 gallons per acre. Indeed, with free bearers, such as Shiraz, the crop of grapes is so heavy that stakes were found to give an insufficient support, and the vines are now trellised. The cellars of brick, partly under partly above ground, are close to the town, and cover a space of 150ft by 75ft, while giving room for crushing, fermenting, and storing 100 000 gallons of wine. The last Melbourne Exhibition did a great deal for wine growers for amongst other things it brought under their notice the merits of the French screw and rachet presses, which are now generally used in Australia. Mr Brache was one of the first to discern their excellence, and took an active part in introducing them to the colony. His ingenuity is also shown in some of the clever yet simple contrivances by which time and money are economised at Coblentz Vineyard in that busy time, the vintage.33
  • 24 Mar 1904: GRAPE JUICE. TO THE EDITOR OF THE ARGUS
    Sir - Since the publication of Mr L L Smiths letter on the above subject there has been much curiosity excited amongst the vignerons and public in general. Being well acquainted with the good old German custom at this time of the year, vintage time, it may be interesting to your readers to know some particulars.
    The Germans look forward to vintage time to drink what they call "Federweiss" (feather-white). Federweiss is the must of the light white grapes (such as our Chasselas or sweet-water) after it has fermented from five to seven days, that is when it is settling. The Germans derive great benefits in health by drinking this Federweiss. It is well-known among them as being a splendid blood tonic and purifier of the system.
    We are in a position to know and praise the health-giving qualities of Federweiss having been making and drinking it in Melbourne for a number of years among ourselves and friends.
    We have pressed the usual small quantity this year, which we intended for our own use but to give some of your readers an oppoitunity of tasting Federweiss, we have decided to send most of what we have to the Iron Cross wine depots, with whom we have made arrangements to retail on either Friday or Saturday next, when the Federweiss should be ready for drinking.
    We have not made inquiries, but we believe we could get supplies from the vignerons near Melbourne, to last a few weeks, should there be any demand for Federweiss.—

  • 25 Mar 1887: Mr. Louis Kitz, who is about to re-visit Germany, was entertained at dinner at the Maison Dorée last evening, by some 50 prominent citizens, Mr. Geo. Coppin, M.L.A., being in the chair. The toast of the Parliament of Victoria was proposed by Mr. H. Marks, and responded to by the chairman. Mr. Coppin then proposed in highly eulogistic terms the health of Mr. Kitz, who since 1852 had been engaged in mercantile pur- suits, especially in the development of the wine trade. In conclusion he presented to him a handsomely bound and illuminated address signed by a number of leading citizens. Mr. Kitz responded in a suitable manner.9
  • 16 Jul 1887: MR. LOUIS KITZ, a well-known wine merchant, who began his career of fortune at the outbreak of the Victorian diggings in 1852, has recently died in Scotland. Mr. Kitz was a native of Germany, and was born in 1820. He arrived in Melbourne in 1852, and, instead of going to the goldfields; worked up his business, first as watchmaker in Geelong. While there he imported the first quartz-crushing machinery into the colony. This he erected at Steiglitz about midway between Geelong and Ballarat. Other quartz-crushing machinery soon followed. He afterward went into the colonial wine business. He was also the pioneer of the Volunteer system in Victoria. He started, the movement in Geelong, and organised the first corps of volunteers ; he receiving his commission from Sir Charles Hotham. He subsequently removed to Melbourne, where he continued in the wine business. He tried the cider-making business, but found that the right sort of apples were not grown in Victoria. He then endeavored to encourage fruitgrowers to grow the proper kind of apples, by showing them that cider could be made in Victoria even with the apples they had. Some proper cider apples have since been grown ; and though cider-making is only in its infancy in Australia, yet it may develop into an important and prosperous industry. Mr. Kitz was one of the oldest Masons in Victoria ; and he took a great interest in Masonic matters.10

  • 20 Mar 1882: MR. A. WEBSTER'S VERSION. Mr. Andrew Webster, watchmaker, of Bourke-street, who was confined to his bed yesterday afternoon at his residence in Brighton, made the following statement: I was in a first-class carriage next to the engine in the express train. Was unconscious for perhaps a couple of minutes after the collision, but did not feel any pain until the evening. I have now a pain in the back, but do not believe I have any bones broken. Nor is my skin broken. I cannot lie on my back. Dr. O'Hara has examined me, and says he thinks my spine is injured. He did not give a decided opinion, however, and he and Mr. Fitzgerald hold a consultation about me to-morrow (Monday). The carriage I was in was quite full, and several of the passengers made comments about the terrific speed we were going at, considering how near we were to Windsor. I was sitting with my back to the engine, and must have been thrown on to the opposite seat ; and I am told by Mr. Shaw (ironmonger), that one of my hands struck him on the face, and cut it. The carriage had four compartments.12

Mr. Webster left Liverpool, England, for Australia by steamship Royal Charter, 23rd October, 1858 ; arrived in Melbourne 27th December, 1858. A resident of Brighton for 12 years.

  • 15 Apr 1905: Mr. Andrew Webster, J.P., a resident of Brighton for many years, died at his residence, "Nairn," Normanby-street, last Saturday. Deceased was in the Windsor railway accident, and never entirely recovered, and for some months prior to his death he suffered from paralysis in the lower limbs. His remains were interred in the Melbourne Cemetery last Monday. Mr Webster, for some years, was in business as watchmaker and jeweller in Bourke-street, but retired after a brief and successful business career. For years he was a director of the Brighton Gas Company, but relinquished that position four years ago. He was unmarried.15
