  • 10 Jun 1898: A PECULIAR ACTION FOR DAMAGES. Melbourne, June 9.
    An action by Patrick Kenney McCaughan against the proprietors of the Argus for falsely and maliciously printing and publishing of him words supposed to be descrptive of the plaintiff's appearance at a fancy dress ball at Government House was heard to-day. He claimed £5,000 damages. The counsel for the plaintiff urged that it was a huge advertisement for the paper, and it should be made to pay for it, Mr. Purves, for the defence, caused much laughter by reading verses and explaining why McCaughan had selected the character of Lafayette, and said if he would only appear before the jury they would understand why Ceres and Venus and others fled. The counsel claimed that it was a trumpery case. His Honor said the only thing that made the claim worthy of the slightest consideration was the fact that the defendants had before been asked to leave the plaintiff alone and had not done so, though this did not make the matter libellous. The jury found for the plaintiff for £5 damages. Judgment was entered with costs.12
  • 28 Dec 1903: DEATH OF MR. P. K. McCAUGHAN.
    Mr. Patrick Kinny MeCaughan died on Friday morning at his residence at Armadale. He was a well-known figure in commercial circles, and held large interests in a number of city properties. For the past two years he had been suffering from an affection of the heart. About a month ago his condition began to give cause for grave anxiety, and he was compelled to keep to his bed.13

Book*Gaunson, David, M.L.A., Melbourne, was born in Sydney, N.S.W 19th January, 1846, being the fourth son of Mr. Francis Gaunson. He was educated at Sydney and at Brighton, Victoria, until May 1862, when he entered the office of his brother-in-law, the Hon. James Macpherson Grant, who gave him his articles of clerkship. In he was admitted to practice as an attorney of Victoria. In 1871, at the general election, he contested Dundas against the Minister of Lands, and then against the Minister of Railways, but was unsuccessful on both occasions. In 1872, on the resignation of the Duffy Government, he opposed the Hon, J. G. Francis, Chief Secretary, at Richmond, and was again defeated, but in 1875 he attempted to secure a seat for Ararat, and succeeded. He was again successful at Ararat two years later, and now represents South Melbourne in the Assembly. Mr. Gaunson is a Liberal and a protectionist. As a solicitor he enjoys a large private practice, and has offices at Eldon Chambers, Chancery-lane, his private residence being at St. Kilda.1

  • 26 May 1842: AWFUL OCCURRENCE. A most awful and heartrending accident occurred on Tuesday evening, between five and six o'clock, by which several families in Sydney have been plunged into the deepest affliction. The family of Mr. F. Gaunson, grocer, Lower George-street, and a party of friends, had been down the harhour on an excursion of pleasure in a schooner called the Eliza Ann, 45 tons, belonging to Mr. Gaunson, and on their return in the evening, about the time above mentioned, they were overtaken by a tremendous squall from the southward when a little beyond Pinchgut. The squall came on so suddenly, and with such excessive violence, that there was not the least opportunity of taking off any of the canvass, and, though the man at the helm did all he possibly could to bring the vessel up to windward, his exertions were unavailing ; she was consequently thrown on her beam ends, when she began to fill, and almost immediately went down. There were about twenty persons on board, including the seamen, nearly all of whom were at the same time struggling in the water, and unfortunately there was no other vessel within nearly a quarter of a mile of them. Providentially there was a boat towing astern the schooner, and, before she went down, one of the seamen jumped into her, and cut the towing rope, and by this means twelve of the persons who had been cast into the water were rescued. Several of the parties were below in the cabin at the time, and one of the maid servants was coming up the hatchway with a child in her arms as the vessel went over. One of the seamen caught the child from the female as she fell and handed it to the man in the boat, and he afterwards saved the servant girl by laying hold of her hair while she was struggling in the water. The boat, being but a small one, was in great danger of sinking from its overloaded state, as the water began rapidly to pour into it, and it would probably have been swamped and every one lost had it not been for the opportune assistance of Mr. Moore, of the revenue cutter, and a boat from the Chilian brig, who arrived just as all hope of escape from a watery grave was given up by those in the boat. The survivors were then brought up to Sydney under the care of Mr. Moore, who exerted himself in every way to afford them all possible relief; though some of them, and particularly Mrs. F. Gaunson were in a very weak and exhausted state. They were placed under the care of Dr. M'Kellar, and we are happy to hear that under his judicious treatment they are all likely to do well. Search was made all day yesterday for the bodies of the unfortunate persons who were drowned; but up to a late hour last evening we did not hear that any of them, except that of Miss Smith, had been found. Not the slightest blame, we understand, was in any way attributable to any of the parties who had the vessel under their charge, but on the contrary everything was done for the safety of the vessel and those on board which the circumstances of the case permitted. The following are the names of the parties who were on board at the time the melancholy event occurred :-Mr. James Gaunson, Mrs. F. Gaunson, Miss Mary Gaunson, Miss Elizabeth Gaunson (drowned), Master F. James Gaunson (drowned), Master Bruce Gaunson, Mr. James Smith, Miss Mary Smith (drowned), Miss Alice Cook (drowned), Miss B. Cook, Miss Crawford and Miss A. Crawford (both drowned), Mr. Woral, two servant maids (one of whom was drowned), Mr. Dely, and four seamen.8
  • 2 Jan 1909: DEATH OF MR. DAVID GAUNSON.
    The death occurred at his residence East Camberwell at half-past 12 o'clock this morning of Mr. David Gaunson who was for many years a prominent figure in Victorian politics, and as a legal practitioner was widely known. Mr. Gaunson had been in failing health for about two months, and under the care of Dr. Wilkinson.
    Mr. Gaunson was a native of Sydney. He first entered the Legislative Assembly in 1875 as the representative of Ararat, and in 1881 became Minister for Lands in the O'Loghlen Ministry. Then for some years he was in retirement, but in 1886 was returned to the Assembly. He again lost his seat, however, and a long absence from Parliament extended until he was returned as the Representative of the public service in the reformed Parliament of 1904. When seperate representation was abolished Mr. Gaunson once more dropped out of the House. An effort to re-enter it in the by-election for Carlton on Mr. Bromley's death a few months ago was unsuccessful.
    Mr. Gaunson leaves a son and a daughter. His wife died four years ago. The funeral will take place this afternoon, leaving his late residence, 11 Moorhouse street, East Camberwell, for the Melbourne Geneal Cemetery at 3 o'clock.9

Australian Dictionary of Biography

David Gaunson (1846-1909), solicitor and politician, was born on 19 January 1846 at Sydney, son of Francis Gaunson, grocer and tea dealer and elder in Rev. John Dunmore Lang's Scots Church, and his wife Elizabeth, née Wakeman. He was educated at schools in Sydney and, after the family moved to Melbourne in the 1850s, at Brighton. In 1862 he was articled to his brother-in-law, James Macpherson Grant and in 1869 was admitted an attorney. After three vain attempts in 1871-72 to enter the Legislative Assembly, Gaunson was elected for Ararat at a by-election in May 1875. Under the patronage of Grant and Graham Berry, he quickly won repute as the leading young native-born Liberal and was a conspicuous 'stonewaller' against the McCulloch government. He was prominent as a jingoist speaker at the Melbourne demonstration in support of Disraeli in July 1878. During his term as chairman of committees of the assembly in 1880-81, Gaunson was engaged as counsel in defence of Ned Kelly and was prominent in arranging the mass meeting and petition in support of clemency. In July 1881 when he was appointed minister of lands in the stopgap O'Loghlen-Bent government, his outraged constituents rejected him in the ministerial election.
'Endowed with a musical voice, good presence, fine flow of language, great quickness of mind, readiness of retort and a good deal of industry, ability and humour, he was only disqualified from marked successes by his utter instability, egregious egotism, want of consistency and violence of temper'. Deakin's description appears to be, for him, unusually charitable. As member for Emerald Hill from October 1883 to March 1889, Gaunson made an appalling reputation for himself as the most unruly member and was regarded with pity or contempt by most members. He allied himself with the small opposition group led by Bent in which Charles Jones was also conspicuous for almost constant obstructionism. In the 1887 session Gaunson spoke 308 times, often for several hours. He was legal adviser to Madame Brussels, keeper of Melbourne's most famous brothel, and to the Licensed Victuallers' Association. As one of the liquor industry's chief parliamentary spokesmen he appeared to overdo his maxim that a man should get drunk once a month for his health's sake. He was accused of accepting money to represent the interests of private individuals in parliament. He also had links with the railwaymen's trade union and often made vicious attacks on Richard Speight, chairman of the railways commission.
From 1889 Gaunson formed legal partnerships in turn with J. Wallace, Francis Cumbrae-Stewart and A. McG. Lonie. In the mid-1890s John Wren, financier and gambling entrepreneur, became one of his clients. The association is depicted in Frank Hardy's novel, Power without Glory, in which 'Garside' shows much similarity to Gaunson. He once boasted that he had cheated Pentridge of more deserving tenants than any other practitioner in Victoria. In 1903 he presided over a public meeting in Melbourne addressed by the visiting John Norton. In June 1904 Gaunson returned to politics and was successful as Labor candidate for the public servants who briefly had separate representation. He had not been a member of the Labor Party but signed the platform; almost immediately he left the party in order to support his old friend Bent, who was premier.
On 28 July 1875 Gaunson married Margaret McLeod Scott; they had two sons and two daughters. His brother William, who survived him, had been prominent in the 1870s in the Australian Natives' Association and in politics, although he was never elected to parliament. Gaunson had been a church organist in his youth, but he abandoned churchgoing and stated that he worshipped God according to his conscience. He died at Camberwell on 2 January 1909. Bent and Wren were among his pallbearers.10

  • 14 Oct 1876: ON the 29th ult., a carpenter named Andrew Prior, residing at Berwick, was sentenced by Mr. Thomas Henty, J.P., to pay a fine of £50, or in default to undergo six months' hard labour, for having in his possession a still without a licence. The fine was not paid, and the prisoner was conveyed to the Melbourne Gaol, where he remained until Monday, when he was brought before Judge Fellows, sitting in chambers on a writ of habeas corpus, granted on Saturday, calling upon the governor of the gaol to show by what authority he detained Prior. Mr. Samuel Lyons, solicitor, raised twelve objections to the formality of the warrant of commitment, and his Honour discharged Prior from custody.13
  • 9 Nov 1901: THE BALACLAVA SHOOTING CASE.
    An inquest was opened yesterday at the Morgue, before Mr. Candler, city coroner, on the body of Robert Alfred Berendt, who was in a row at a coffee-stall in Balaclava on the morning of the 6th inst., and died a few hours later in the Alfred Hospital. The keeper of the stall, Andrew Logan Prior, who is charged with shooting him, was present in custody. Formal evidence only was taken, and the inquest was adjourned, till Friday next at Prior's request.14
  • 16 Nov 1901: A CHARGE OF MANSLAUGHTER.
    All inquest was held to-day concerning the death of Robert Alfred Berndt, who died on the 6th instant from the effects of a bullet wound received during a quarrel at a night coffee stall at Balaclava, kept by a man named Andrew Logan Prior, who was present in custody. The jury returned a verdict that deceased died front peritonitis, the result of a gunshot wound inflicted by Andrew Logan Prior. They therefore found Prior guilty of manslaughter. Prior was formally committed for trial on a charge of manslaughter. Bail was allowed in two sureties of £100, and accused in £200.15
  • 14 Dec 1901: THE COFFEE STALL FATALITY. PRIOR FOUND GUILTY. A NOMINAL SENTENCE.
    At the Supreme Court Criminal Sittings yesterday, before Mr Justice Williams, Andrew Logan Prior was presented on a charge of manslaughter. The charge arose in connection with the shooting affray which occurred at the coffee stall of the accused on the night of November 6, by which a man named Robert Berndt lost his life.
    Mr Finlayson, K.C., prosecuted for the Crown and Mr Lowe appeared for the defence.
    It will be remembered that Berndt was in Prior's stall when a man named Campbell entered in a state which the prisoner yesterday described as "nasty, disagreeable drunk." He managed in a few minutes to provoke a quarrel, and followed up abusive words by knocking the furniture about and throwing various articles, in cluding a large lamp and a bottle, at Prior's head. The latter fired a revolver to at tract the attention of the police, but unfortunately the bullet struck Berndt and caused his death.
    Mr Justice Williams, after explaining fully the charge to the jury, said that in considering the question whether there was wilful negligence, it had to be remembered that the accused had very defective vision. The sight of one eye is gone altogether, and the other was in a very weak condition. He might have thought it perfectly safe to fire the shot in the way he did. He fired on his right—the man who was baiting him was on his left. It was evident therefore, that the accused never intended to shoot Campbell. If, continued his Honour, they could consult their own feelings, they would rather see Campbell in the dock than the poor old man who was there. Campbell was the origin of all the trouble. He came into the shop in a drunken condition and proceeded to smash up and make a clean sweep generally of the small stock-in-trade in the establishment.
    The jury, after about half an hour's deliberation, brought in a verdict of guilty, with a strong recommendation to mercy.
    The associate was procceeding to read the record of a conviction when—Mr Justice Williams interposed:—Don't bother about that. It is for discharging firearms in a public place. I have done the same thing myself.
    Mr Lowe asked if he could say a few words in mitigation of sentence.
    Mr Justice Williams.—It is not necessary, Mr Lowe.
    Addressing Prior he said that he did not propose to pass any sentence. The prisoner would be liberated on entering into a recognisance of £20, and obtaining one surety of £20, to come up for sentence when called upon.
    Prior.—Thank you, your Honour.
    Mr Justice Williams.—The man need not go down below. Let him sit in the court till the bonds are prepared.16
  • 20 Apr 1904: Before Messrs. Barnet and Morrah J.P's, at St Kilda Court yesterday, a young man named Reginald Scott was charged, on the information of Andrew Logan Prior, keeper of a coffee-stall in Carlisle-street with using threatening words, and also with committing damage to the extent of 7/5. For using threatening language defendant was fined 10/, with 2/6 costs, in default seven days imprisonment. For breaking the lamp he was fined 5/, with 2/6 costs, and ordered to pay 7/5 damages, in default 14 days' imprisonment.17
