Newspaper-Articles

  • 30 May 1859: A fatal accident occurred on Wednesday night, to a very respectable and deserving man named Murdoch McLean, who had kept a store at Batesford for the last five or six years. The deceased had been to Geelong, and was returning home with a load of timber on his waggon, when, in going down the Batesford hill, the shoe which locks the wheel from some cause or other gave way and the whole weight of the load coming suddenly on the horses, they sprang away. The deceased was knocked down, and the wheels of the waggon passing over his head, killed him on the spot. An inquest was held yesterday, at the dangerous state of the road was severely animadverted on by the jury and the coroner.
It is most shameful that any public road should be left in the state that this one is.8
  • 30 May 1859: CORONER'S INQUEST
An inquest was held on Friday last, at the Derwent Inn, Batesford, before Foster Shaw, Esq., the coroner for the district, on view of the body of Murdoch McLean, who was accidentally killed ou the 25th of May instant, by the wheel of his dray passing over his head and shoulders.
Edward Marriott, of Bell Post Hill; laborer, deposed that on Wednesday night, about seven o'clock, as he was coming down to Batesford, he saw McLean's waggon on before him, his wife Mrs McLean and two children following. Witness asked her to ride home on his cart, but she declined riding until she saw her husband's waggon safe down the hill. They kept in company until that part of the hill where the drags are usually put on the wheels, and the deceased stopped his horses to place the drags on. Witness went from his own dray to that of the deceased to assist him if required. Deceased then took the shoe, and placed it under the wheel of his own waggon.
Before he started witness suggested the propriety of taking the leading horse off, and placing him behind. He said their was no occasion as the animals were quiet. The stick that keeps the chains apart from the leading horse had slipped out, which the deceased replaced. Witness stooped down to see if the drag was placed right under the wheel and found that all was right.
Witness then proceeded back to his own dray, and to lead his horse down the hill. The deceased had by this time got on some distance, when witness thought he heard the waggon going faster than it ought. All at once he heard a great noise, as if the waggon had capsized. Went up, but when he came to the spot where the waggon was upset, he could not see the deceased. Witness gave his horse to the woman to hold, and went back as fast as he could, when he heard the voices of Mrs. McLean with her children. She was supporting her husband's head on her breast. Witness ran for a candle and brought it to Mrs McLean, when he observed that her chest was covered with blood. Witness is of opinion that the wheel of the dray went over his head on his falling to the ground from some cause or another.
Catherine McLean, wife of the deceased, deposed that her husband went into town very early on Wednesday last, with his horses, intending to bring his waggon and loading. It came on late in the evening, and the deceased not coming home, witness became very uneasy, and took her two children with her to meet their father on the road from town. Near to the iron house we saw the dray coming, the horses walking pretty quick.
Witness said she was glad she had met him, and walked on towards home with him after the waggon. When they approached the descent of the hill, her husband stopped and placed the drag on the wheels. We again walked on, but the drag slipped from the wheel, so the deceased placed it on a second time. A person came up and said is that you Mrs McLean, and that he would get out of his cart and lend them assistance. Mr Minnett then assisted her husband in placing the drag aright. Witness told her husband to leave the drag where it was until the morning, as so many accidents had lately occurred on this part of the Batesford road, he objected to leave it, so he started again, witness following. When she had gone a short distance she saw something lying on the ground. She stooped down and found it was her husband. He breathed three times but never spoke a word. This was between 6 and 7 in the evening. Witness sat down, supporting her husband's head in her lap. It was pouring with blood. Cannot say how long she was there. Mr Minnett came back with his cart, and witness begged of nim to go for help, as her husband was dead or dying. He went and obtained assistance. Dr Hope also came, but the deceased was quite dead. The horses were very quiet, and the deceased was perfectly sober when the accident took place.
Mr David Barry, contractor, deposed that about 7 o'clock on Wednesday evening as he was proceeding to town he heard a noise on Batesford Hill, as though the Ballarat coach was coming down. He kept the side of the road to avoid collision. At length he came to a boggie which was upset; one of the horses was standing, the other lying on the shafts. He then heard some one call out from the top of the hill for assistance, saying also that McLean was killed. Witness rode up the hill about 100 yards, called for light and found Mrs McLean supporting her husband's head upon her knees. Witness instantly rode back for assistance, and also sent for Dr Hope. When witness first arrived the deceased appeared to be breathing, but was dead before he got back again. Considers the accident arose from the drag slipping off the wheel, the hill being very dangerous, as far as its incline is concerned, being very strep, and deep ravines on. each side, in fact a most dangerous road.
    Verdict—" Accidental Death."
The Jury expressed their desire to the Coroner that the attention of the proper authorities should be directed to this part of the road as being in a very dangerous condition.9
