  • 15 Sep 1948: Mulgrave “Booze" Blamed For Bike Theft
ON THE NIGHT on which he was alleged to have stolen a bike from a shed behind a New St. house, John Albert McCarthy, laborer, of Upper Beaconsfield, told the police that he and his brother had just finished drinking four bottles of wine and he was “boozed” when he took the machine.
Wallace Dent, gardener, of 29 New St., Dandenong, told the court that the bike, which belonged to him, was in the shed at the rear of his home at 5.30 pm. on August 19th, but was gone when he looked in the shed at 11 p.m.
Although it was in bits, the mudguards were damaged and an attempt had been made to paint it a color, witness identified the bike in court as his.
Detective G. H. Staneslby, who prosecuted, told the court that when he and First-constable G. Trainor interviewed defendant at Upper Beaconsfield on the morning of August 28th McCarthy said, “Yes, I got that bike. It is still down at my brother’s place. ... I was boozed the night I took it and when I got it I found it had a fiat tyre.”
Later, defendant said, “You can blame the booze for this. . . . About three years ago I left a bike here with my late mother and I believe she gave it to Dent, and when I got “boozed” I considered I was entitled to my own bike back again. . . . This bike is not the one I left at my mother’s place three years ago. ... I painted the bike, but I was “boozed” at the time—just have a look at it!”
In convicting McCarthy, and fining him £5, or 14 days, and ordering him to pay 12/6 costs, the chairman of the Bench (Mr. F. A. Singleton) told accused that his action was a very foolish one.3
